Hi,

I wanted to know if anyone has any answers to this question... 

 

We were thinking that my fiances daughter would stay behind for a few weeks or a month when she first travels here. 

I have applied for the k-2 under her I29f. I am not worried about that... 

 

My question is, how long will it be before she can travel back to get her daughter? 

 

I dont want her to be stuck here and the child stuck there? She is still too small too fly alone. 

 

Any answers?

Unsure about Fiancé(e) visa vith dependant(s) applications, but from travelling into the the US, your fiancée (and you :D ) has 3 months to get married. The sooner you apply for AOS (preferably before the 90 days too) + EAD/AP the sooner they can get processed. So after your fiancée getting into the US, you should get married ASAP, and have all paperwork ready for the AOS, and after filing AOS it still takes around 3 months to get at least the AP that would allow her to leave the US without abandonding the AOS.

If it's of any help, she could arrange to have her medical as late as possible, as her entry into the US will be the latest as her medical exam expires (6 months?!?!) , and travel together WITH her daughter, as the EAD/AP card takes around 3 months to arrive, and she won't be able to re-enter the US without her AP (if she does leave the US without AP, USCIS will consider her AOS application abandoned, and you guys will have to go the CR1/IR1 route: 1 year or longer process).

Any other opinions?
