3 x 125% poverty limit leniency

Hello, I have about $56, 400 in savings (about $45,000 and ¥790,000, with the current exchange rate it equals about $56,400). The current amount for 3 x 125% limit is about $56,800. Will they deny my visa since I'm $400 short? Since some of my assets are in yen and depending on the day the exchange rate changes, for example 2 weeks ago the exchange rate was 77 yen for 1 dollar, with that exchange rate I would have over the limit. Today the exchange rate was 81 yen for 1 dollar and that leaves me below the limit. I'm interviewing in Tokyo, does anyone know how strict they are? Will they consider the changing exchange rate?

If they are strict, can you use personal property as assets? Things like computers, ipads etc? I also have a job offer for when we return to the u.s. I know you cant use that to replace savings and assets, but will they take that into consideration as well?

The will not take into consideration things like personal electronics. If you're worried about the exchange rate, I suggest you exchange the money on a day the exchange rate is in your favor.

Why is it 3x 125% of the poverty line? Ours was 125% above poverty line. Is it different for Japan?

Look up the instructions manual I-864P. It is the guidelines for the minimum requirement. Even if you have 3 dependents, it's not 3x 125%.

Good luck.

Assets are 3x whereas current income is only 125%.

If you don't have a job or income that will continue from the USC after the immigration process (IE if they currently work abroad but obviously have to quit their job to move back) then you can instead provide 3x the 125% as liquid assets. I assume your USC had a current sustainable job in the US.

Oh, ok. This makes sense.

(I don't mean to poke in where I don't have solid answers, I was just confused!)

Thanks, KDubovik.

Good Idea. The exchange rate will hopefully go down soon. But I was able to use my personal electronics on my assets. I don't know if that's normally ok, but they didn't have a problem with it. I think it might be because I was so close to the required amount that even selling one of those items at 50% list price would make up the deficit, but I don't know exactly why it was ok.

The fact that you listed an item does not mean it was considered. Approving an I-864 is a judgment call.

Maybe, but I think it's better to list them anyway, just in case. It's better to over prepare than underprepare.
