can i have the wedding ceremony before my fiance enter into us?

hi: in december 20th 2010, i got the receipt for the K-1 submission, i just porposed to my girlfriend during xmas,

i heard that you cannot be married while waiting for k-1 visa,so after she passed the interview, can i just have the wedding ceremony in indonesia (because her families are all there) and then she comes to us and we formally register at the court house?

No. A married person cannot use a K-1 visa. A K-1 is used to marry in the US. If you want to marry in Indonesia, you can marry there and then file for a spousal visa.

You can have an "engagement party" before comming to the USA on a fiancee visa, however depending on the laws of foreign country a "Wedding Ceremony" can be considered to be legally binding and if this is the case US recognizes this as being married, and using a K-1 while already married is misrepresentation and can come back to bite you later on.

I don't see any problem with an informal ceremony, as long as it is not registered in the foreign country. It's just a party, after all, and many people do that anyway, because it's difficult to combine wedding planning and law. As for the formal wedding though, I am afraid it will have to be in the U.S.

If it's important for you to have the actual wedding in Indonesia, I am afraid you'll have to file a K-3 or start the immigration procedures, which will take a little longer and may require longer separation.

Need to re-read the OP's question, they are asking if after getting the K-1 would it be OK to "Marry" in home country, they did not say that they have the visa yet. They only have NOA-1 letter is all.

K-3 is a DEAD option, would be filing for a CR-1 spouse visa.

I agree with Mathilda. You should have no problem having the ceremony in Indonesia as long as you are not registered in that country as a married couple. A lot of people have "wedding parties" in a different country, and later register at the US court. This way, both side's relatives witness how "two become one" =)

Other than pictures, you would not have any proof of your marriage, which is not enough for the US officials. As long as you did not sign any papers or get stamped anywhere, you guys should be fine. (but that's just my opinion..)

I've got a friend who married her American husband in her home country before going to the US on a K1 visa, but note that she only had the wedding ceremony - they did NOT sign any marriage certificate in her home country. After arriving in the US they had another wedding ceremony AND signed the marriage certificate there. They had no problems whatsoever.

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.
