  1. So we got an RFE asking for my husband' s(the petitioner) tax return but the thing he was in the peace corps and did not have a job when he came back from the peace corps, he has a job now and is above the poverty line yet he does't have the tax return yet so I was wondering, how should we proceed in that type of scenario? Would the explanation and proof sufficient to say that the US law did not require him to file for tax return?
  2. Hi guys... My fiance worked remotely in Taiwan for a South African company for 2 years and before then he had already lived in Taiwan for 4 years at least, I believe he didn't file taxes for the last 2 years.. Last time he did file was in 2016 I'm now waiting for Packet 3 with the embassy instructions and obviously freaking out about this. He didn't want to file because it was pretty low for American standards, but high enough that he should have filed. I searched Online but couldn't find any specific requirements of the affidavit for support from the embassy in Taiwan. I believe my fiance submitted pay stubs, employment statement and bank statement in the first stage while filing for i129F. is it definitely required document to provide any past tax return for this? Say if I have good savings can I also provide my own financial statement, will that help? Thank you guys...I just really want to know + persuade my fiance that he might have to wake the IRS beast at some point.
  3. Hi all, I was thrilled to finally received my interview date email the other day for my spouse-sponsored green card (CR-1) at the Consulate General in Sydney. I got an automated email from the Consulate today with general info about preparing for the interview, but the email also had a message at the top in a bright header reading: The 1040 US Tax Return will no longer be acceptable for your application. Applicants who are required to submit a US tax return with their application are now required to submit the US Tax Transcript. The IRS generated transcript can be obtained for free from the IRS website by filing IRS Form 4506-T Request for Transcript of Tax Return. I'm being told this 3 weeks before my interview, even though the NVC accepted our joint 1040 tax return as supporting financial evidence (the option was to submit EITHER the tax return+W2 form OR a transcript). The IRS hasn't processed our tax return yet (it's going to take a while given the backlog and because we had to apply for and ITIN simultaneously) and so it's impossible to get the tax transcript for at least a couple more months. Has anyone else been in a similar position? Can they really change the required documentation rules just before the interview and after the NVC has given the all clear? I've emailed the consulate but I'm expecting their usual generic replies. Thanks!
  4. Hello, hope someone can really help me... I really don't know what to do... The first thing is that I'm getting divorced from a TN Visa holder (I'm a TD Visa holder/ dependent) and he committed physical and sexual assault against me in Mexico this year (we used to live together first in MI and then in CA, I came to Mexico to finish my studies for 6 months, and when he visited me he did committed the assaults and then leave to CA again)... When I asked for the divorce he just took all our money from the bank account (his bank accounts because he never let me have my bank account or a familiar bank account), leaving me without any money, now, I have a lots of debts behind (medical bills to pay because I was the patient, scholar debts, etc), he told me he was not going to give me any money, besides that he always sent a lot of money to a house he has in Mexico so that he "could finish to pay it ASAP" but he knew I wasn't going to have any benefit from that house (he bought it before our marriage, in his past marriage). It been already 2 months and he haven't send me any money, and I don't have a work because I'm not available to work as a TD holder. What can I do? PLEASE HELP!
  5. I, the petitioner, received a request to submit all the W-2s and 1099s for my 2018 tax return, which I did. Then I got a message after 3 weeks making the same request. I've checked and double-checked the W-2 (1) and 1099s (2) that I've uploaded. The 1099s were accepted and the W-2 rejected with the note to upload all W-2/1099s for [NAME] 2018 tax return. I have checked to make sure all the numbers are reported as they should be on the return, so it is not that they don't match. Has this happened to anyone else? It is making me feel crazy and I'm not sure what to do. Should I upload the same W-2 again with a note that it is the only one and hope it works? Should I upload all of them together in a single PDF with an explanation showing where the amounts appear on the tax return? I know 1099s make the income confusing. If anyone has advice, I would so appreciate it. My husband (the immigrant) is in England until the visa is approved, while I am in the US. We've now been apart for more than a year. The continued delays and feeling at the mercy of cryptic messages is so frustrating. Thank you thank you
  6. Hello everyone, our interview date got moved up to next week and we are scrambling to get things together and we want to know if tax transcripts and W-2s need to be originals or will they accept them scanned or printed? thanks for all your help!
