  1. Hello, My wife who is a USC and I just received an RFE that said the below; "The petitioning sponsor lists their income on form I864 as an amount considered as sufficient however no evidence has been submitted as proof of current income". They then proceeded to ask for Paystubs for the past six months and a letter of employment. When we filed we only submitted tax transcripts for the last three years for my wife and also a joint sponsor affidavit(with their W2, last year tax transcript and current Paystubs at the time). To respond to the RFE do we just submit the Paystubs and letter of employment since we already submitted everything else or does my wife and joint sponsor have to fill new I864 affidavits and then include all the requested income documentation in the RFE? Secondly do we have to attach the Yellow Rfe letter when sending or a copy would do? Thank you.
  2. Bummed....after 125 days , just received an e-mail notice that there has been an update on our case. I got very excited that all will be done soon....well the excitement diminished after I read I should be expecting a RFE letter within the next couple days. I thought I did a great and complete job with my I-485 packet.... Of course, I have to wait for the letter to know what the USCIS is specifically requesting. Last night, I looked over my packet and realized I never submitted a translated copy in English of my wife's foreign Birth certificate....I'm hoping that is all they are requesting ... I went ahead and got a certified translation of the birth certificate, so its ready to send off ASAP. Anyone else have similar experience with RFE's? --I'm worried it will set us back a lot. Any suggestions or info would be greatly appreciated.
  3. Hey!! Hope all is good with everyone. So my form I130 got approved in February and they initiate the processing and now I just received a letter from USCIS asking me for a request for initial evidence of BONA FIDE MARRIAGE. So the thing is I have never been to USA and the USCIS is asking for the evidences like property leases, mortgages, or registrations. Now I want to know what kind of evidences should I send them to prove that our marriage is bona fide? I am already sending them the evidences like the conversation between me and my wife, money transfer transaction, emails, pictures, and affidavits. Would anyone please let me know if I have to send the USCIS a notarised/attested affidavits or it’s other way round? I’d be so grateful for any kind of help. Thank you!!
  4. Hi, everyone! I just need someone to tell me that everything is alright with my husband and i's application. We just got a mail from the USCIS of a Request for Initial Evidence. What we're mad and frustrated about is that they're asking for A COPY OF MY BIRTH CERTIFICATE in which I do have a duplicate of what we sent to them and we did send them a copy of my birth certificate. We followed everything they asked from us. Are they doing this to make our application long or THEY'RE NOT JUST DOING THEIR JOB? I hope they're taught how to read (in which they should because they're supposed to be smart people working for the immigration). Also, I do not need to translate my birth certificate because it's already written in English. Ughhhh. I am just so frustrated right now because we did send them more evidences as we could. We would still send them ANOTHER copy of my birth certificate along my college transcripts tomorrow. In line with this, does this affect the timeline of the process of my application? I am really bored staying at home and I do want to have my employment authorization already so that I can start working.
  5. Hey guys!! I filed my AOS after marriage but I received a request for initial evidence stating they need a copy of my birth certificate. I was adopted by my stepfather in 2008 after my biological father unfortunately passed away in 2004. I submitted a copy of my adoption certificate but they’re requesting a copy of my birth certificate. Does this mean the adoption certificate copy is missing or not enough? And do I need to provide both or just my adoption certificate again? My adoption certificate was all that was required for my K1 as my original birth certificate is technically invalid because my adoption certificate supersedes it. (Sorry if that rambled on a bit I just want to be clear) many thanks VJ community!!
