  1. I went through the process 5 years ago with baby daddy. I had sufficient evidence but he was denied cause he is banned for 10 years now. He has been gone almoat 8 years. But the department of state sent my case back for review last February. I read it could go either way. Anyone heard of this happen before.

I was just wondering of what exactly to do after our K1 visa is approved? 🙂 what forms to work on, what processes to follow, my fiancé’s work visa, maybe if there is a master list on visajourney I could refer to, to start from? I just don’t want to miss a thing and I want to do this entire process properly for the both of us. I just want to stay with my love. I know there are a bunch of tiny little details and stipulations, and I really want to make sure everything goes smoothly. He lives in Ireland if that helps any. Thank you so much!
  5. Hoping someone out there has dealt with a similar situation or has come across it before. So here goes... My fiancee and I are related. She is from the Philippines and I was born and raised in the USA. I had initially thought she was my 2nd cousin which would have made things a lot easier. Upon further digging into it she is actually my "1st cousin, once removed." (Her mother is the niece of my mother.) I had never even heard of the "removed" part until I looked into it. In my state of Ohio it is not legal to marry a "1st cousin" and I believe it is the same for the Philippines. I have not been able to find out if there are exceptions to this or if it is fine and I can just go to a different state to get married. I do not know if they take this into consideration for approval/denial when the papers are being processed. If there is an exception for "first cousin once removed" marriage in the Philippines that would be an option too. Then I would just file for Spouse Visa instead once married. Which process might be easier/better? Second issue is at the moment I am currently unemployed but actively seeking work. I do however own a house as assets which would put me above the requirements for 3x poverty level. Can I file with assets alone or is that just asking for an automatic denial? I don't know how strict the Philippines Embassy (or US for that matter) is going to be with the whole process. Any information that can be given on either subject would be greatly appreciated. Also please be civil. I know cousin marriage is a widely debated issue, so don't make this post about that. Just support that we are happy and love each other. Thanks for any help. P.S. I have obviously done general research on all of this, so specific information/details when replying would be a great help. Links to sources would be preferred so I can have it for reference myself.   6. Help, My wife came here on a k-1 visa and we applied for her green card shortly after getting married in the US. A couple of months after that we got in a financial pickle and my wife decided to look for jobs. She had received an SSN after we got married and we thought that she could get a job with that while we waited for her EAD (been 200+days and still waiting for that) and her green card. Long story short she got a job at the chiropractic office and everything was fine for 6 months. Just last month I stumbled upon a rule stating she technically isn't allowed to work with her type of SSN. We are freaking out because we are near the end of the green card process and most likely have an interview coming up. She quit her job as soon as we realized what she was doing was unlawful, but I fear that she had the job for much too long and that her green card application could be denied. Is there anything I can do?
  7. Hello everyone I have just received our NOA 2 (K1 petition approved) and are getting prepared for when the time comes to head to Cuidad Juarez, Mexico for my fiancee's interview. I seem to have a decent grasp on most of the things that are needed however, I need some clarification as to how the Consulate determines income eligibility. I currently reside in a family home with 8 people (including myself) which puts me BELOW the poverty guidelines (based on 2019 Poverty Guidelines). Please keep in mind, when i say household, i am talking about a physical home that 7 people (family) reside together. I do not care financially for all 7 people (only my two grandparents) My job pays very well, I do not have to pay rent, or in any sort of debt, i have enough money saved in my bank and i know I can provide for my fiancee. It is not very clear as to how USCIS determines whether or not I meet the poverty guidelines for caring for my fiancee given that I KNOW, i can take care of my fiancee Has anyone every had a similar situation? Did you meet the income requirements having a large "household"/family that lives together? Thank you !!! *p.s This is the Poverty Guideline I am referring to https://aspe.hhs.gov/poverty-guidelines Also anything else I should know about Cuidad Juarez? Did they ask for anything in particular from you guys?
  8. My fiancé (K1 visa) has over 10k in account. She will move some of the money into our account in the USA. At the day of her entry into the USA her foreign account will have less than 10k. Is she required to file at FBAR for that year regardless of when the account exceeded the 10k threshold?
  9. Hello friends. I am going to be the beneficiary(We have not yet filed) and I am a lady. My fiance who is a US citizen and the petitioner is 10 years older than me. I know it would probably be a 'redder flag' if I was a Nigerian male about to marry an older woman but reverse is the case and it is normal in the Nigerian culture for the man to be older. Still, I would love to get answers from y'all. Is 10 years age gap too much for a USC male filing a K1 visa for a Nigerian female. Thank you

    K1 After NOA2 Dominican Republic.

    Hello! K1 petition hoping to get NOA2 sometime next month (September), I've been trying to prepare for the next steps to make but the Dominican websites are very confusing so I have some doubts on what is supposed to happen post-NOA2 when you are dealing with the Dominican Republic. If someone who has already been through this could answer please! Im not going to bore you with a list of the steps I already know.. here is what I am not sure of: 1- after NVC assigns you a number and they forward your case to the embassy, do you submit the form DS-160? or you have to wait until you have an interview date? 2- do you get an assigned interview date and time or you choose it? 3- do you also have to make a separate appointment at the VAC for Biometrics? 4- This Famous Packet 4... Do I really need it? and what should I do if I don't ever receive it? 5- Do I have to send any documents to the NVC or the embassy prior to the interview? 6- my fiance is not planning on attending the interview at the embassy, is it really necessary for him to do so? he is a USC. 7- Is the Police Certificate the same as an: Acta de Buena conducta or Cartificado de No Antecedentes Judiciales?? Sorry for all the questions but I've ready many other posts and the wiki page and these items were a bit unclear for me. Thanks!
  11. So we just checked our status and we got this... we were approved on January 16th 2019. At the montreal embassy. Now I know there were a few flags for my fiances part. We sent in the petition (i29f) in a few times and it got sent back to us for silly reasons such as not having the correct payment (where we did, just two different money orders totaling to the 535 amount) and another time for not having a signature. They did turn my fiance around at the border when he was coming down to visit me for thanksgiving and told him he had to be patient and wait for the k1 process to be finished (in which he did) so im hoping the clear this up soon and offically approve us and send the visa its been well over a year and a half at this point i just want this happily ever after to start with him 😕
  12. Hi everyone! So, my fiancé and I sent off our I-129f around December 10th, 2018. And unfortunately I am just about to get my passport for the first time in my life (my fiancé visited me from Ireland so he has his passport) I’m about to get mine on February 4th, 2019. My fiancé’s passport expires around summer, but he’s just about to get his renewed as well about the same time (February 4th, 2019). My question would be, would they be able to see this about our passports when they look up our info on us? Or does it even matter? Could it even be grounds for denial? I sent in my birth certificate as proof of citizenship, and along with his just for extra proof for him, along with absolutely everything else necessary, checking definitely 10+ times.   13. Hello guys, about 10 years ago I met an amazing guy in Mexico. Despite being so far away and young, we’ve always shared a connection. we both just recently turned 19 and wanna start a life together in the US. We are not married. We have no criminal background and no kids. Im a US citizen. I also have a ton of photos/evidence of us together these past 10 years. My question is this, would it be better to get married in mexico and then file? To be honest im not sure what that form is called? OR file the I-129f and then get married here in the US? I also know Im going to need a co-sponsor ($$) because I alone dont meet the poverty line..another question is does the co-sponsor have to be part of my household?for example my mom? My parents are divorced and I really dont get along with my mom nor her husband that well and dont think she would sign the affidavit...

  15. Hey guys I've been using VisaJourney for advice all throughout my K1 process, but this is the first time I've needed to actually post something. I hope you can help. So me and my Fiancee have been going through the process since February last year. Yesterday (Friday 25th of Jan) was my interview date at the new US Embassy in London. I arrived half hour earlier than my appointment slot and was let in earlier too. I was given a number and sent upstairs. After sitting down for a few minutes I was called up to give in my official documents and answer some questions, I was then told to sit back down and that they'd call my number one more time. Another half hour passes and I'm called back to a different window with a lady who asks me some more questions pertaining to our relationship. She then says that they "should be able to approve that." I'm taken aback by how quick this was but I did clarify by asking "Did you say I was approved?" to which she responds "Yes." I then ask if that's it and if I can leave and she says I can. I leave the embassy probably about 50 minutes, maybe less, after entering. I get anxious sometimes and now I'm terrified I've done something wrong and that I was meant to stay in there or something, especially since they say you should expect to be in there for 1.5 hours on the embassy website. I've checked the visa status on CEAC using my case number on the IV section and it just says "Ready" Am I overreacting or is this a common occurance
  16. Hi guys I had my interview on 28th of august consular gave 221g form he just asked for police certificate from England I provided them on 8th of September now it says application received since 15th of September but now I can't tack my passport either can u guide me is it normal?
  17. Hello Everyone, I am in desperate need of some advice. I'll try to make this short and to the point (I'll try) * 3 year relationship (11 trips total so far to visit him) * Visa Process started September 2014 * Interview for K1 Visa - May 2015 - Visa Approved * CEAC - Case Ready- as of June 2015 Problems with systems started, no passport no visa. Both my fiancé and I were very stressed and emotional because we had made so many plans in June and we were arguing all the time. One of those arguments went to far and I sent in an email to ustravel... saying I wanted to cancel his visa and I would not marry him (on June 27). On June 29 after crying and just being completely devastated I quickly sent in another email saying I did not want to cancel explaining my emotional state.... they asked me to send a letter when I first said I wanted to cancel, which I did not send because I obviously did not want to cancel, I stated this in various emails. We continued to call and check on passport status, no info. Finally on August 7th as a response to one of my many emails someone emailed me telling me, I had sent an email saying I wanted to cancel and that I needed to send a signed letter and a copy of my passport saying "I wanted to retract the request to withdraw petition". I immediately sent that in. The response was "it will be forwarded to the corresponding unit for review". Do you think there is a chance he will get his visa issued? or not? Keep in mind I never sent in a signed letter for the cancellation.
  18. Hello , To anyone reading this i am new to the blog , and as it has been wonderful with so much information. I am at the very start of the k1 process but am having the most difficult time assembling the actual packet to send out and I'm very fearful of making any errors. If there is anyone from the orlando area , and is willing to help whom is futher along with the k1 visa process . Please contact me. I would truly appreciate any direct guidence as i have been so worried and stressed out and above anything confused with all the papers.   19. I was issued a J1visa 4 years ago with a 2 year residency requirement. I met my boyfriend/fiance during my internship and finally pulled the trigger on K1 visa in August 2018. Is it automatic that they will count from when I arrived to back to the Philippines from my J1 assignment and count 2 years from there? I have traveled back and forth to the US after that. Do they really compute for the total number of months? Or will I need a waiver?
  20. Hey everyone ~ My fiance has been on AP at the US embassy in Colombo, Sri Lanka since 4 September 2018 and our status on the CEAC site still has not changed from "Ready." We've emailed the embassy once a month and have gotten pretty generic responses. Our latest inquiry yielded this response ... "Our office is waiting for certain clearances to further process your case. We understand your difficulty because of the delay in the processing. The timing for these clearances are generally based on the history of the case. Our office will contact you as soon as your case gets the clearance." My fiance was born in Dubai, UAE and I'm aware that AP usually takes longer if the beneficiary is from a MENA country, so we're not really surprised. Has anyone else's status been stuck on Ready? Also, does anyone else know what the "certain clearances" could be? Any advice appreciated! -Anna
  21. Help !! So, I'm a bit concerned. I got a call a few minutes ago from the hospital I did my medical at. They stated that my medical will not be sent in time for the interview and that I need to come in to review the medical with the doctor. I asked if something is wrong and they said nothing detrimental. I'm not sure if I should be worried or not.. I'm thinking of changing the interview date. What could possibly be wrong? Thoughts??
  22. Hi, I have seen conflicting accounts that a police certificate from the US is not required as the immigration authorites will automatically conduct a background check on applicants. If so do I need to get one? I lived in the US for a year so I am assuming that one is needed? I already have obtained one from the Irish authorities. Any help would be much appreciated, thanks.
  23. So I went for my interview on the 26th on November, on the day I was approved and told they didn't have my medical results. After sending an email they confirmed they had my medical results on the 29th of November. As far as I can tell in this forum, the "Case Last Updated:" should update nearly everyday. It may go from ready to AP, or back again. But mine hasn't been like that, the case has only updated on days the embassy replied to my emails, does this mean my case is just sat there having nothing done to it? Even now the last time they replied to me was the 6th of December so that's when the case was last updated. Before then it was a week with zero updates. The only thing that stands out in my experience compared to others on this forum is that the system was having issues the day I went for my interview, the person getting interviewed before me was told that he could be stuck in the embassy for two hours due to the system. But I was allowed to leave straight after, I assumed it was because they were waiting for my medical results. Only reason I'm worrying is because I wanted to be there for Christmas and I'm seeing people on this forum get their visa before me when they had interviews after. I know time can vary but my case just seems odd. I'm not really looking for a solution, just ideas or other people who may have experienced something similar. I've sent an email asking if there's any issues so that's all I have right now. Making me anxious. Thanks very much. Declan
  24. Hi everyone! So, my fiancé and I sent off our i129f around December 10, 2018. We are now looking to update our passports this week as my fiance’s is older and well, I honestly don’t have one yet, but of course I sent in my birth certificate. I checked the i129f about 10 times before sending it in and that is truly no exaggeration. We are looking to update any needed vaccinations too of course for my fiancé before the NOA2, hopefully to god an approval. I know that I must do thorough research on the embassy we will have our interview at, amongst other things. Well. While my fiancé was here with me, he actually lived with me for 2 months, he lived with me and my family, which I know is unconventional, but I and my family have never been happier than that time actually. They could see how in love we are and he instantly became part of the family. In our i129f, I included pictures of just him and I and also some with us and the family, and letters from my parents stating how they love him as well, and how they’re more than willing for him to live with us until we get steady financially. I basically let the USCIS know we have a plan already financially as well, and included an affidavit of support from both of my parents and all the requirements too (even though I know it’s not necessary yet) and we’re already saving money up as I write this. And my parents meet the financial requirements as well thankfully, very well. My question is, with this info I provided which was even more thorough in the i129f than I just stated, what do you think the chances are of getting approved with the NOA2? Because sometimes I’m crawling up the wall with nerves, and other days I’m fine.   25. Hi all! So, we sent off our I-129f earlier this December of 2018. We are now just waiting and doing a bit of further research. But as we wait, I can’t help but have a nagging feeling and question; if we were to get the godforsaken denial, or very welcome approval, would we get either answer in 6+ months time? Or if it were a denial, would it come sooner? I know my fiancé and I built an extremely strong case for the both of us, but I can’t help but follow the philosophy of hope for the best but expect the worst. If I may ask, others who have been approved recently, how long did your NOA2 take? We’ve already gotten our NOA1 🙂 thankfully. Thank you all so much for your help!
