  1. Hello, one and all! I'm new to this here community, but my fiance directed me to you because I've been plugging away at K-1 paperwork today and the flowchart of Visa progression really helped settle a bit of my anxiety! But of course, I still have a good many questions to ask and not many answers are forthcoming. As the topic title states, I'm currently struggling with the whole Affidavit of Support section required for my interview with my Embassy in London, UK. It is listed as a required document, but then goes on to state that it MAY be required. My fiance and I want to be ahead of the game (I already have everything else done and prepared from the checklist; DS-160, ACRO, Birth Certificate legal copy, Evidence of Relationship... you name it!!), so we'd really appreciate it if somebody could clarify whether the Affidavit of Support is required for us to file on the K-1. As an aside, I'm currently in contact with the school district where I'm moving to in the Lacey/ Olympia area of WA, and have submitted an application to be a Substitute Teacher with them. So, if that proves fruitful, would I be right in saying that they could provide me with the evidence of support? Thank you all for reading! And wish us luck for a speedy rest of the Visa process.
  2. Hi, my fiancé has her K-1 visa interview next week. When we started this process, she was here visiting when we decided we wanted to see what we could do so she could eventually be here with me. We hired a lawyer. Long story short, he lied to us, took advantage of us knowing we were young and uneducated on immigration and such. He told us she could stay in the U.S with me while we filed. She overstayed 120 days, but she left as soon as we talked to another lawyer and found out she’s WASNT allowed to be here. The lawyer stopped contacting us, and wouldn’t admit his lies and manipulation. Has anyone dealt with overstaying and still been approved and do you think she will be approved or denied? Her interview is in Montreal, Canada and she was here in the U.S. just with her passport.

  4. I just had my period today (saturday, march 9).. I'm going to have my medical exam on tuesday(march 12). I can't back out now because I already booked my hotel.. and my interview schedule is on march 22.. I just want to know if they will allow me to do the urinalysis test and physical exam?.. or Would they allow me to proceed the medical exam even if I have menstruation and then just tell me to come back after my mestruation to do it but I can have the other tests like xray, blood test,..etc?
  5. Hi all! We received the NOA2 about a week and a half ago, I just want to make sure I understand the next steps. Here is what I believe is next: Until the application has left the NVC, we will not hear anything. When it does leave the NVC, we will receive notification of this and receive the case number. I understand that in the meantime, we can call the NVC to get the case number prior to receiving the letter. Once it gets to the London Embassy, I (the beneficiary) will receive notification of this and the next steps. I assume this will include information on how to pay the visa fee and how to book both the medical and the interview. I pay the visa fee and book the medical and the interview. I make sure I have the following information: Passport with at least 6 months left before expiry 2 photos that meet Department of State requirements Birth certificate (I have a certified copy) Police certificate Form I-134, Affidavit of Support (As my Fiancé is at university and does not meet the income requirements, I have a form filled out by her as it is required for the petitioner to fill one out, but I also have one filled out by her mother to meet the income requirements) $265 ready for the Visa Fee Vaccination proof (Question about this below) 4 photos that meet Department of State requirements for the medical £330 for the medical exam A printed copy of DS-160 completion confirmation A complete copy of the initial application (I-129F) Copy of Form I-797C and Form I-797 (NOA1 & NOA2) Proof of ongoing relationship. Go for the medical exam, and then wait at least 5 working days for the results to get to the Embassy before having my interview Go to the interview. Get Approved (Hopefully) Wait around 1 week to receive the Visa and have the passport returned Questions: Vaccinations; I was born in Greece (I only have British Citizenship though), and the vaccinations I had are on the vaccination proof, however, they are missing the batch numbers. I read on another post that the medical requires the vaccination proof to also have the batch numbers on all vaccinations. Can anybody verify if this is the case? I am going to my doctors soon anyway to make sure I have all of them as I don't fully understand how to compare the letter from my doctor to the vaccination chart provided by the Embassy. Medical History; Do I have to get my full medical history for when I go to the medical? Am I missing or misinformed about anything?   7. Hello, First time posting so sorry for any double posts/wrong forums. My fiancee and I just had our "interview" at the U.S. Embassy in Bogota, Colombia yesterday to discover that our case was sent back to the NVC back in November 2018. Some background information: We started on the K-packet back in November 2017 but had to delay the process due to me getting some things arranged in my personal life that took around a year to resolve. We both decided that we would wait this out and continue our relationship to pursue marriage using the K1 visa. During this time, our immigration lawyer had filed three extensions for us to present ourselves to the embassy. The first was scheduled to September 2018, the second, December 23, 2018, by which time we were back to submitting the necessary paperwork. In each petition for an extension, our lawyer clearly explained our decision to wait to marry and that we were indeed still moving forward with our relationship. We had informed the consulate of our intentions of continuing the process and the legitimacy of our relationship in addition to a letter of intent from both of us explaining the delays. In January of this year, we set our interview date, March 4, 2019, with no problems. As a precautionary measure, our lawyer asked for a final extension with us, which was granted until March 31, 2019. She clearly stated we would be presenting ourselves for the interview and our relationship was valid. All of these extensions were confirmed by the Embassy. However, the Friday before our interview, March 1, my fiancee received a call at 5 PM stating that our case had been sent to the NVC back in November 2018. She stated that she sent my fiancee an email regarding this. We searched high and low but found nothing. We decided to present ourselves at the embassy anyways only to get the same response from both a official and supervisor so we left empty handed. Both were confused as to why our petition was sent back to the NVC and recommended we get in touch with them. Yesterday, I managed to get through to the NVC and spoke to a gentleman that was equally confused as to why they had our case. He stated that this was still "processing" and would be sent back for revalidation to the USCIS. I know there is no way to expedite these things, but to think that this has been processing since November seems a bit extreme. Does it seem like our case got lost? Is this USCIS just going to throw our case out? I have reached out asking to see if a supervisor can look into this to see if, at the least, it can be pushed to the USCIS. Our lawyer has also written a similar request. At this point, my fiancee and I are exhausted physically and emotionally from the toll this has taken on us. I am assuming that this has been sent back because they may have doubted the legitimacy of our relationship due to our decision to wait to marry until things in our personal lives were resolved which took some time. What would be our best bet at this point (I know this isn't an easy question to answer)? We were planning on getting married next month but that's ruined now. Would a K3 seem like a better bet at this point? Since our K1 application seems trapped at the NVC, can we even start a new one? Should we wait it out? I've tried to ask some of the Senators from the state of Pennsylvania to look into our case, which one replied and said she would. To me, our only other option is for me to apply for Permanent Residency in Colombia and I'm not sure what this would require.   8. Hi Guys, My fiance and I filed the I-129F on the 22nd of October 2018. We still haven't recieved the NOA2 but we're still within reported processing times on the USCIS website for the service center it was received at. My fiance and I have a solid case: She's been here for over 2 years doing her masters at the American University in Cairo while I finish my bachelors. We met during her senior year study abroad at AUC. I met a lot of her family, specifically her dad and brother, her mother passed away in 2013. I met her dad when he came to Egypt for a brief visit and another time when I went on a family vacation with them in Europe. On the Europe trip I met her aunt, her brother, the dad's girlfriend and the brother's girlfriend. All of this is documented with photographic evidence. We have affidavits of support from her dad, a friend of hers from the US who came to visit, a friend of mine here (He's the once who told me I should grow a pair and start talking to her at the start of our relationship), and her roommate during her first year here (also a US citizen and a professor at AUC). We hired a lawyer in the Boston area to help us with filing. We also have evidence of a wedding dress, wedding bands, and within a few months a wedding venue if we get the NOA2. The only red flag we have is that I didn't get an affidavit of support from my family because they didn't like her that much and didn't want to help me because they just didn't approve of the marriage. Post filing, my situation has changed a bit and they've stopped outright rejecting my desire to marry her. From what I can tell this is apparently a death sentence when it comes to administrative processing in Egypt. She has no problem staying in Egypt for as long as necessary to get the Visa assuming she can find work. The only problem with that is we can't realistically live together unless we get married here because Egypt is incredibly conservative. If we decide to get married here we'd have to withdraw our application for the fiance visa and start the process all over again with the CR-1. I realize this fear may be incredibly premature but to be honest I am absolutely terrified and I'm genuinely losing sleep over this. Has anyone every experienced a scenario like this before?

So my question is what do i and my fiancee need to be getting ready at this point. She is going get her nbi today. has birth certificates ,passport, photos, and passport of course. So what else is needed and is anything needed from me?

  11. Hi Everyone, My name is Claire. I'm from Cork Ireland and I'm getting married to my fiance in 10 weeks in Ireland. He is a US Citizen. We hope and plan to move back to the US together. Can anyone advise on where we should start? How do I get a Case number from the US Embassy in Dublin? How do I get an appointment after we have our marriage certificate? Are we chosing the correct visa type? I-130? Will I be able to return to the US with my future husband after we get married? I hope someone can guide us in the right direction. Thanks Claire
  12. Hi, My EAD/AP runs out on August 28th so I was starting the renewal process today and planning to send everything by tomorrow or the next day. However, as I've been doing all the paperwork I've discovered that I've lost NOA1 for the I-485 and I need this for the renewal (and yes, I've 100% lost it). I need to send the renewal stuff by the end of this week because it's now 6 months until my EAD/AP runs out, can anyone please tell me how I can get another NOA1 for I-485 quickly??? Thank you in advance!!
  13. Hi! I am currently preparing for the interview in a few hours. My only issue is that I received an e-mail from the medical institute yesterday to cal them urgently but I did not receive this until today. I do remember that they told me I can leave after the X-ray. They did not weigh me or check my eyesight, etc. All they said is that they will take the documents yesterday night to the US Embassy in naples. Is there anyone who had a similar situation? I am on my way to the medical institute. I hope I make it in time to the interview.
  14. Good day, I met my Girlfriend via a dating website. We are a solid match and are planning on meeting soon this coming October to be exact, She is currently finishing her contract in Malaysia, she is from the Philippines. In October I will be flying to Malaysia to pick her up and we will be flying together to the Philippines. I will be spending my two-week vacation with her and her kids (Ages 6-3) We are planning family activities such as traveling & amusement parks. We are very happy and can clearly see a future together. We make a year together in July (sadly only online via facebook messenger) as her current employer does not allow visits or allow her to stay outside for a night, so we will have to wait until October to meet each other. I will be flying down again in December for a week vacation. Marriage is in the talks as I stated we definitely see a bright future together. Since the first time, we talked we have a very positive vibe. I have helped her with the kids almost monthly around 50-100 USD I've done this on my own will and have never been forced to do so, on the contrary, small little arguments have raised since she feels shy I've been helping her without yet being able to meet her. I would like to the know some advice from this community since we are starting out and definitely can see a happy future. what are things we should keep saved and what are things we should start doing and keeping records of? If she & I decide to marry then it will be in July 2020, when we make two years together, as of right now I'm helping her family rebuild their home after it was severely damaged. Do I keep a record of this or will this be useless? I have never done online dating before of has marriage ever even come to my mind, out of my previous relationships none ever really sparked that "This is someone whom I can spend the rest of my life with" So I am a bit clueless on some of the processes, I have looked online but everyone states something different. Some state we need to live together first, this will be hard for me to achieve since I have a very good job working for Harvard Univerity, the IT company I came from has a location in Manila should I bite the bullet and apply? What do you guys think, and for those of you who have been in a similar situation how did you deal with it? The distance does hurt as we all know and since I'm a full-time employee its difficult for me to take a flight and go whenever I want. I would greatly appreciate all and any advice as we want to make sure we do things correctly from the start. I've read stories of couples tossing very good evidence not knowing and then being stuck.   15. Hey guys! I spent the last 4 hours looking for answers I can't find, so I figured I'd just ask on here! My husband came here on his K-1 visa and is now waiting for his AOS to receive his green card. I'm filing my 2018 taxes right now and I'm filing as married. My husband does not have an SSN yet and does not have work documents yet. he obviously isn't working right now, do to that. I'm confused as to what I should do. Is he eligible to fill out a W-7?? or should I say he's a non-resident alien? In my head I thought he's viewed as a resident alien because he has an alien ID number. Please give me guidance if y'all know how I can properly file my taxes! thanks in advance!!
  16. Help, My wife came here on a k-1 visa and we applied for her green card shortly after getting married in the US. A couple of months after that we got in a financial pickle and my wife decided to look for jobs. She had received an SSN after we got married and we thought that she could get a job with that while we waited for her EAD (been 200+days and still waiting for that) and her green card. Long story short she got a job at the chiropractic office and everything was fine for 6 months. Just last month I stumbled upon a rule stating she technically isn't allowed to work with her type of SSN. We are freaking out because we are near the end of the green card process and most likely have an interview coming up. She quit her job as soon as we realized what she was doing was unlawful, but I fear that she had the job for much too long and that her green card application could be denied. Is there anything I can do?

  18. I'm married to a USC and we filed for AOS in August 2017 and are still waiting for the interview to be scheduled. I was approved for EAD/Travel in November and had to travel earlier this year to visit family for an emergency and ended up staying for a few months. Long story short, the day of my flight I realized I didn't have my combo card (advance parole) and was unable to board the flight. The US Embassy said they could not issue a transportation letter since I am not a Lawful Permanent Resident and the USCIS field office told my husband they could not issue an emergency parole document without me being present. Has anyone been in a similar situation? Please advise, as AOS is kind of a grey area the embassy won't touch the case. I have a picture of the card and my approval notices for travel and employment but they seem to be of no use. PLEASE HELP.
  19. My wife and I filed for AOS, along with EAD, back in November. We got a letter from USCIS, just before the holidays saying we didn't give them enough information, I'm guessing proof of her income, to provide a new affidavit along with additional information. We put it off for just after the holidays as that was stressful enough, then the shutdown happened which meant we couldn't access the IRS resources for a time, luckily we were able in the end. I'm going to list everything we now have and we just want to be sure if this should be enough now: - Photocopy of the letter that was sent, this was requested by them so no doubts there - New affidavit of support, this time we listed my assets as I have over $50,000 in checking and savings which we didn't disclose before. When we got that letter there was conflicting information, one saying we didn't give evidence of proof of income (despite including a letter from her employer). And the other saying we didn't meet the minimum requirement for the feudal poverty guidelines, which according to my maths should be about $20,575, and then saying we would need a joint sponser. My wife currently makes $35,000 a year, although she started this job in April, would this given them some issue? - We have included her W-2 for 2018, which we weren't able to before but we have it now. It doesn't say on the W-2 when she would have started, the overall income is lower as she only started in April, but she still made $25,000 in that time so that should still be enough? With the letter from her work backing this up allow them to work out how much she would have made over a full year, then take it all into account. - We've printed off bank statements from the last 12 month for my wife's checking account. I don't have an American bank account that goes back 12 months. We have a joint checking and savings but both have only existed for around 6 months, and were in her name initially and now have both of ours. Would they be able to tell it's the same account just by looking at the A/C, plus would they mind that they don't go back 12 months since they haven't existed that long? Likewise I do have my own checking account but that's only 3 months old as we only opened that after we got married. - We were able to get her tax returns again. Last time we included the last 3 years, even though 15 & 16 were optional. We have decided not to include them this time. I can't imagine we'd be able to do 2018 just yet, or anyone for that matter. But we have her W-2 as mentioned and her pay stubs and letter from employer again. - Six months of pay stubs as said above, didn't include these last time, mistake on our part we admit. That's everything we have and everything that the letter listed that we needed to include, to the best of our understanding. A whole section of what they needed was dedicated to getting a joint sponsor, would they still expect us to get one, even though we've proved as much as we can that we don't need one according to the guidelines. I'm thinking this was maybe added automatically as before there wasn't enough proof before? Should be still get one of her parents to joint sponsor just to be sure? Or would me just including everything about my savings be enough, along with the additional evidence were supplying proving with little doubt what my wife makes? Thank you for anyone taking the time to read this. It's been stressful for us since filing it, only to get this back at us. We just want to get it right once and for all. Then relax for a few months before preparing for the interview 😁.

I am at the very start of the k1 process but am having the most difficult time assembling the actual packet to send out and I'm very fearful of making any errors. If there is anyone from the orlando area , and is willing to help whom is futher along with the k1 visa process . Please contact me.   23. Hello everyone, this isn't the first time on here but now I am here because I am very desperate for help. Let me tell you guys my story, I fell in love with my current BF who is also my ex husband in 2015, we were together but because of distance and other problems we broke up in 2016, we had gotten married that year. Filed divorced in 2017. Recently we have rekindled our relationship and want to get back together... the distance is a problem. He is in DR and I am in the USA. He has gone to apply for B1/B2 visa but was denied. I am a US citizen and want him to come stay with me. What is the best and route you guys reccomend me taking. We were already married, should we get married again and go for an I-130, or go for K-1? Will him applying for B2 and also us being divorced affect either of these processes? We do not have any kids... but want to get pregnant very soon.
  24. My mom's visa was approved and today we realized her appointment confirmation has a typo (our mistake) the DS 160, the passport and everything else has the right name. Visa is on the process to be delivered. What name appears on the visa? the DS 160? or the appointment one? In case the visa has the name wrong on it. What should we do? Can she travel regardless with it? It should say Maria but says Marcia. Help please..
