Tracker posted a topic in Adjustment of Status from Work, Student, & Tourist VisasHi there, I had a question about using my AOS based EAD while I am an F-1 student. My i-485 application is pending, and my EAD card is about to arrive soon, but I've read that using AOS based EAD would violate my f-1 status. I've always maintained it, and still want to until I actually receive my green card and I'm still pursuing my bachelor's degree anyway. I've asked my DSO but he seems to think that I can't use my EAD, but judging from our conversations I think most DSOs are pretty unaware of the whole immigration process. So I don't want to just take his word for it. If using AOS based EAD is not an issue usually, would it be at the discretion of the University still? To let me maintain my legal f-1 status? Thanks for your help!
Wouter Erwee posted a topic in Adjustment of Status (Green Card) from K1 and K3 Family Based VisasHi guys, I am flying out to Seattle from South Africa on the 17th Apr via K1 visa, a quick wedding and then we start the AOS, EAD & AP journey. Hopefully it goes a little quicker than K1 process. Lets hope for the best. Any tips, tricks, comments or notes are more than welcome. This is a crazy journey, but it's well worth it!!! Thanks Wouter
d00dzky posted a topic in Working & Traveling During US ImmigrationHello there! I filled my Work Authorizarion request last Sep 19, 2017. And my EAD approval notice was Nov 24, 2017. I was advised before by Phoenix USCIS that Work Authorization Card are being processed within 90 days. Its been 154 days since my application and I already made two (2) follow-ups, Jan & Feb 2018 respectively yet up to this very moment I don't have my EAD Card. Is the 90 days processing time starts from the date of approval or from the date of receipt of the application request?
Hello all, My partner is a Ukrainian citizen, currently residing in the U.S. legally through a F1-OPT visa. Her visa expires August 11th of this year, however her EAD card allows her to work and live legally in the U.S. until August 28th. We want to get married and have her apply for a green card (through Adjustment Of Status [AOS]) in order for her to stay and continue our relationship. This is a recent decision and we want this process to be as smooth as possible without the help of a lawyer. So that brings us here with some questions regarding the legal side of things. We are hoping it is not too late to go through this process. I hear there are lots of forms and documents to have prepared and mailed. 1. Is it necessary for USCIS to receive these forms before her visa expires or before her EAD card expires? OR is she able to submit these forms during her 2-month grace period? 2. Does she have to get another kind of visa while she's waiting for her green card? If yes, is it possible to do this in the U.S.? 3. If applying through AOS, do we have to fill out separate I-131 (permission to re-enter U.S.) or is this included? 4. Do we need to go to city hall ASAP to go through the ceremony or do we have some time? We are determined to make this marriage happen in time and appreciate any help from this community.
