My EB2-NIW case was approved in December 2018 and I received the approval notice, but NVC never received it to continue with consular processing despite the submitted and approved I-140 for my case included the request for consular processing (I am abroad US). It has been over 18 months and NVC has not received the case. (USCIS seems to have lost my file). I need ideas/advice on options to get my case to NVC. Background and what I’ve done so far: - Case approved Dec 2018. - Multiple Inquiries to NVC (apr to sep 2019). NVC claimed they never received the file. - After NVC contacted USCIS they asked me to file a duplicate petition - Duplicate filed in October 2019 per their guidance, but no receipt received. - Jan to Apr 2020: Multiple inquiries and calls to USCIS without success. Last inquiry suggested submitting a form I824 (6 to 12 month processing time!) as if I was requesting a change to consular processing (but the original submission already requested it) - March 2020: submitted claim to DHS ombudsman. Case was received but no progress yet. Any ideas what else I can do?! Any similar experiences?
  2. I read at many articles it states that consulates have suspended "in person" activities and interviews. Does anyone have any experience knowledge ir updates on their AP cases ever since covid19 Closures? Do you, or anyone you know, have gotten their visa or passport after being in AP cases during covid19? Curious to know if islamabad consulates are still working on ADMIN PROCESS since they arent "physical - in person" activities, which can be done remotely! Thanks and good luck.
  3. I got my 601 Extreme Hardship waiver approved last week, March 11. However, CEAC updated the status of my case, MArch 16, and is Saying REFUSED. " The Consular Officer adjudicated and resfused you a VISA . Please see the interview letter we gave you during the interview" My question is, can they still REFUSE you even though the INADMISSABILITIES were already cured by the 601? Is the CEAC peopl accurate?
  4. anyone here doing consular processing thru the London embassy or requested expedite at NVC level? we've been waiting so long to hear back from the NVC as to whether or not the London Embassy will grant the expedite.
  5. Does anyone knows what are the required vaccines for the DR for adults and children? Also, do they accept the lab results that shows that a person has the antigens in the body (in case they have received vaccination and/or have had chickenpox or viral hep previously) I tried calling but they are no help. Said that I should come and have the evaluation and cannot go out to get required vaccines outside the very expensive medical office. I want to make this as inexpensive as can be since 5 of us are going for the medical, and it's a lot of money thanks,
  6. Hello all, I am in a dilemma at the moment. Initially they told us to be watching the Visa Bulletin for when it will get to our turn( For Family Based i30 Visa) Now we are told (and I checked online status as well) that the status is showing ISSUED. It was said to be issued in may 2019 This is where the confusion is. My son and his family still have their passports with them and they have not done any interviews also. I am lost here. Oct 2008 is the date. I need to know if anyone is in thesame category can say how the whole process happened! I am so lost. Consulate is Nigeria.   7. Hi I'm a little bit new here. Quick question My kids and I will be a permanent resident very soon. We are now living in the US. My wife live in Canada (she is Canadian). I want to minimize the time he will be separated from me and the kids. Of course she can cross the border and stay in the USA for 182 days every calendar year. I know we can do all the processes thought a Canadian consular. But can she do all the process while she is in the US ? Like the statement below she will enter legally without the requirement of any Visa. No. If your relative is outside the United States, filing an I-130 does not allow your relative to live or work in the United States. An I-130 petition only establishes your relationship with your relative. Your relative should wait outside the United States to immigrate legally. If your husband or wife, unmarried child under 21 years, or parent is already in the United States after having entered legally, they can apply to adjust their status to permanent resident at the same time you file their I-130 petition. If so how can she apply to adjust their status to permanent resident any additional form of the I130 and can we combine both document at the same thing when sending documents ? Thanks !
  8. Finally after 6 years our I-601, and I-212 was approved on 07/13/2019. How long does it usually take for the consulate to reach out with a decision? they already confirmed that the consular officer was working on the case. I'm beyond anxious, reading, researching, I can use any help or info you can share please.
  9. Aloha, My fiancé and I have our interview coming up in the end of February. He is Australian and I am American. I'm feeling pretty good about our documents, I've been working very hard to make sure we have everything they require and then some. The one thing that is pressing on my mind is that I have not made enough money the past few years to be required to file for taxes and I haven't filed. I feel a bit dumb, but I did not plan ahead for having tax returns to bring with. I read somewhere that I can bring a letter stating that I was not required to file along with my I-134 Affidavit of support and that of my joint sponsor. My joint sponsor is my retired father you gains money from his retirement plan. He has plenty of evidence, tax returns from three years prior, bank statements and proof of his retirement payment each month. My question is, will this be enough evidence to get by? My fear is that my lack of tax returns will be an issue with them. Any constructive advice would be welcome! Thank you!
  10. We are trying to ask consulate if they will except my 2018 tax return in lieu of a sponsor. We emailed LagosIV and received an auto response that they would respond to email in 5 to 7 business days. We sent email on January 15th and still we have no response. How can we actually speak to someone. A real person 2nd can explain what we can do it other options outside of a cosponsor.
