  1. Why Ready status takes 7 weeks and still after AP? I had my interview Nov-16th-2018 for DV1 visa and they kept my passport, my visa status was on AP (221g) until Jan-30th-2019 and changed to READY status and still until now not update yet, still waiting since, I would appreciate some of your wealthy information, thank you.

My husband had the CR1 spousal visa interview in Jan 2019 and was told congratulations and welcome to the US here are the forms to register to pick up you visa and to pay your immigration fee form. 5 days later we get an email from the embassy saying that they did a final review of our case and had to be put into administrative processing and my husband should pick up his passport (which he did with no visa inside 😔). They didn't ask for any additional information. We are so worried because we have no clue what's going on. We have sent several emails with no response. This has been the most painful experience ever. Even our lawyer has no clue what's going on. Pls help!!!

  7. I'm sharing my personal AOS experience of trying this approach (without a lawyer). If you see my timeline, I'm in the very early stages of the AOS process. I'll provide future updates of my AOS progress. As you can read for yourself in this recent cheat sheet for immigration lawyers, two different circuit courts have found that when USCIS grants TPS it counts as an “admission” for purposes of AOS. The two cases are Flores v. USCIS, 718 F.3d 548 (6th Cir. 2013) and Ramirez v. Brown, 852 F.3d 954 (9th Cir. 2017). But you can only use this approach if you reside in the Sixth Circuit (Kentucky, Michigan, Ohio, and Tennessee) or the Ninth Circuit (Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington (state)). Regular AOS applicants usually submit a copy of their I-94 as proof of admission, but I provided a copy of the 20 page Ramirez v. Brown decision (because I reside in the Ninth Circuit). I concurrently filed the I-130 (by my USC 21 year old son), AOS, EAD, and AP. I'll post as replies below my cover letters for each application (without personal info). Feel free to ask any questions if you are in the same situation.

    Hello. My wife and 3 kids applied for B2 visa on 22-2-2019 from islamabad US embassy. VO took their passports and handed them 221(g) white paper. VO said exaclty: " miss ... I am keeping your passports, i need some more information which i will email you by today reply to that email by today" Which we did after 2 hours of email. It contains general questions like: Your passport numbers Your siblings names Your job in 15 years Country visited in last 15 years source of funds etc. General info. Please advise what could be the reason or outcome? We are really worried. Little background: 2011 My brother was LPR. My wife and 1 kid (had 1 kid then) applied B2 in 2011 rejected. I had valid B2 visa. In 2013 my wife 2 kids by then applied for B2 visa. This time approved. I already had B2 again. Now: in 2019 My bro is US citizen. My wife's parents and her two 3 siblings are LPR now by F4 which they recieved in 2014-15. I still have valid B2. Applied in 2017 and approved. Interview went like this: VO: have you ever changed ur name? Ans: yes once. (As my wife prev name was with father as surname now with my name as surname after marriage) Vo: why you want to go to US Ans: meet my parents my bro in law and vacations ( As from 2015 to 2018 we go every year for summer vacations for a month) Vo: who are with you here? Ans: my kids Vo: what do u do? Ans: i am a teacher ( although mentioned in ds form i am sponsoring her) Vo: what do you do sir? ( As i was with them inside embassy although i had valid b2 visa) Ans: businessman( gave details well established business so no prob in that am sure) Vo: do you have a valid visa? Me: yes Vo: pl pass me your passport. Vo: ( after typing like ages gave my passport back to me) Vo: ok i think thats all. " miss ... I am keeping your passports, i need some more information which i will email you today reply to that email by today" Thats it. Any clues please? my observation is that may be it is because of her parents or my brother they want to check for immigration status or something? As in DS form we answered we havnt applied for any immigration which in real we havent. Please advise.

  12. Hi, I gave my interview for K-1 (spouse visa) at the U.S embassy in Islamabad, Pakistan, on the 20th of Feb 2019. I showed proof of my relationship with my (now) Fiance of 6 years. We have met in 5 countries and i showed the interviewer everything she asked me. I answered all of her questions and she seemed satisfied. After the interview was done she told me and i quote "We have approved your Visa, you will get a mail by american express in two weeks". She then typed something on the computer and i asked her again that does she need anything else and she replied with a no. I then left being super excited and happy but a week later i go on and check my Visa status, it had been turned to Administrative processing. According to my research i have realized that AP is very common for K-1. My question to anyone who's reading this and has some information about this, is that is possible for them to reject my visa? Why haven't they asked me or emailed me anything yet if they need further proof? What should i do next? should i send them an email? is this normal? Thank you so much in advance for your response.
  13. Hi Guys, I'm a little confused after reading contradicting answers online. My situation in short- I filed for AOS/EAD/AP based on a K1 visa on Feb 2018 shortly after I got married. I received my EAD/AP combo card on July 2018 and it is valid until July 2019 (1 year).  Meanwhile, since I reside in NYC, the AOS(I-485) takes much much longer than expected. I'm waiting for them to schedule an interview since September 2018 ("Case is Ready to Be Scheduled for An Interview"). Last month I filed for an EAD renewal and received a 797C notice therefore automatically extending my EAD card by 180 days. My main question is regarding my advance parole (I-131)- 1. Is it true that it is valid for 2 years and not 1 year? (my current combo card specifically mentions that the card itself expires on July 2019 without distinguishing between my EAD and AP) 2. If it does expire on July 2019, can I file for a renewal in similar way to my EAD renewal? (I read somewhere that AP cannot be extended) 3. I traveled abroad in December 2018 and returned on Jan 3rd 2019. Upon return the border patrol officer stamped my foreign passport, and wrote under "Paroled" the date of Jan 2nd 2020 (which is 1 year ahead). So my question here is what does this mean? Is my AP valid until July 2019 or Jan 2020? I'm sorry for my very long question Thanks, Dave
  14. Hi everyone ~ my fiance had his K1 Visa interview at Colombo Embassy, Sri Lanka on 4 September 2018. After his interview, he was given 221g with no additional documents needed. CEAC site said "Ready" from day of interview up until just yesterday. It now says "Administrative Processing." Has anyone had a similar experience? Is this maybe a good sign?

Hi guys, My fiance and I applied for a K1 visa, and I went to the CO for an interview a month ago while he put me on "administrative processing", asking for my resume (i guess im under TAL, since I work in a technical field). 2 days ago it changed to "READY", with this statement under- "Your case is open and ready for your interview, fingerprints, and required documents. If you have already had your interview, please check your status after two business days. If no interview was required, please check back in two business days for the status of your application." 2 more things happened- 1. "Case Created" was changed to the same date as 2 days ago (it originally opened on January 2017) 2. It changed from "IMMIGRANT VISA APPLICATION" to "NONIMMIGRANT VISA APPLICATION" Today (48h after ==2 business days) it changed to "Application Received", without a change to "Case Last Updated" (remained 2 days ago). What does "Application Received" means? there's nothing on google about it. Thank you all in advance! Regards, Dave
  16. Good afternoon, I just wanted to fill you guys in on my experience renewing my MO drivers license today. I filed for EAD/AP/AOS early November and it's still pending. I took my US MO Drivers test in November using my I-94, Passport and K-1 Visa page but my license was only valid for the length of the I-94 document. Of course this expired a little while ago, and I have been unable to drive. So my wife emailed the DMV requesting information as to whether or not we'd be able to renew my license for the time being. There is very little information out there in this. I have included the e-mail below. I walked into the DMV today, and brought the following documents with me: Marriage Certificate Passport AOS Receipt (With stamped biometrics) EAD Receipt (The DMV scanned this document) Utility Bill (Something with my name on it tying me to the address I live) It took her a few tries of various numbers on the EAD receipt but it was approved for renewal of my DL. The process took about 10 minutes once I was at the desk. So those of you wondering about drivers licenses, e-mail the DMV and ask about your state's laws regarding it. Remember: Not all DMV staff are competent. I hope this helps someone out there!
  17. Hey! I'm writing this to get your guys opinions on my advance parole situation - and sorry if this isn't in the right place, I'm new to this forum. My fiancé's visa was approved and he's coming to the USA from Sweden this week (8 months to the day from when we sent the I-129F), we're getting legally married at the NYC courthouse 3/1. We're having a big wedding in Iceland in August 2019 - before you guys comment, we're not getting legally married in Iceland, just ceremonially, and we're doing it because we weren't sure about the timing with the visa and wanted to have a big party with all of our friends from NYC and Sweden 🤷‍♀️ Anyway, August 3 is almost exactly 5 months from our legal wedding in NYC. We had assumed that we would be getting the K1 visa much earlier than 8 months, and also assumed that advance parole would take 2-3 months. It seems that advance parole is taking much longer than that, with an average of 5-6 months. I know it's highly unlikely we'd get approved for emergency advance parole, because a wedding is not an emergency. We've already paid for the entire wedding in full, so rescheduling it will definitely be a financial burden, but we obviously can't have a wedding without the groom. Is there anything we can do to make sure we get his advance parole before 5 months, or do we eat our money and reschedule the whole wedding to a date we know will be 100% okay? Insane that it could take up to 16 months with no RFEs and everything done correctly.... Anyway, would be eternally grateful for any advice and we're quite unsure of what to do. Thank you in advance!

Hey everyone I hope you are doing great!, Well, I had my K1 interview yesterday in the US Embassy Algiers,Algeria, the whole process was smooth, not too many applicants, the staff was very friendly, the embassy officer asked me usual question : What is your fiancé's name? How long have you been together? How did you meet? Where did you meet in person? How many days you spent together and where? How did your relationship became romantic? What do you love about him? What does he do for living? Can you list his family memebers and where do they live? Does he live alone? And then he told me "Congratulations! Your visa has been approved" I was very happy and felt a mountain was off of my back, then he told me i will be back with you, he went for about 10 mins, when he came back he gave me a a form to fill that contains my informations such us Name Address Siblings and their date of birth Employers (name, address and employement date) My emails My social media accounts Told me to fill it and give it back to him After i did, he gave me a white slip (221g) and told me my case needs some administrative processing and he gave me back my passport and told me we will email you when we are done and ask you to send us your passport, I left the embassy heart broken, waiting for (god's know how long) they email me... What made me feel sad is because they gave me back my passport. And i am more confused because he approved my application at first, so can you please tell me if you know cases like this or what do you think about it?
  19. Today at the airport, my EAD card was lost while checking into my flight to Paris. I have a flight in the morning from Paris to the US and no longer have my EAD card. After multiple attempts to find it and file a police report I haven't been able to locate it. I have photocopies of my ead card, my advance parole approval notice, pending AOS receipt notice, marriage license and original K-1 visa on me. What can I do? Can I still board my plane to the US and what are my options if not? My wife is in the US and can go to our local uscis office or anything that can help. Anyone have any ideas how to solve this??
  20. Hi everyone, I hope you're all having a good Monday. I have a quick question regarding AP with an EAD. My husband rec'd his EAD card this past weekend. We did not file a I-131 with our package as there was no upcoming travel needs for him for the foreseeable future. In light of that, and some Google image searches I did in our downtime, I fully anticipated seeing language on the EAD card indicating that the card was not able to be used for advanced parole. However, his card as printed says that we can use it for advance parole. To me, this seems weird. Any thoughts? We wondered if there was a possibility that this occurred due to the fact that he's Canadian. We have no plans for him to travel any time soon (domestically or internationally), so it's not a big issue. However, if the event arose, it would be good to know if he COULD travel while the I-485 is still pending. Thanks for any input you all have!
  21. Hey Guys, My wife just got her EAD card with AP permission after coming to the USA on a K-1 visa. She is from Algeria, which is part of MENA. I am scared that under this administration she will be denied re-entry. I am torn apart on what to do. She misses her family so much and I want her to travel to Algeria but I don't want to risk losing her and undergoing the immigration process again. I need some input. My family is deathly afraid that she won't come back and it's really giving me and her second thoughts on her visiting her family back home. Is my fear and concern completely blown out of proportion? What should we do? Thanks for all your help.

Hello Everyone, I got a call from Islamabad embassy yesterday inquiring about the contact numbers I use and my email address and places I have worked. the officer was a Paki guy and was talking in Urdu and was very strict in Tone. this is the first call I have received from the embassy after my interview, my interview was on 1st June 2016. Does this means they are about to speed up my case or is it just a normal process for the Visa Admin Processing's? I read most of the people have been visited by the field agents who were inquiring about them. BTW, my visa case is I-730, follow to join case. Everyone please kindly share your views

  24. Hi all, I am a K1 VISA beneficiary, I am now married, and I'm finally able to sit down and start the AoS application. I have read the guide on here, as well as the instructions on the I-485, I-131, and the I-765. In the beginning I thought I only had to file these three forms, and file them together. (with all of my evidence of course) I'm not always the best at filtering through the correct information but I do my best, but somehow I've now ended up with 7 different forms, and I was just wanting to check that I had it right, and that they were all necessary. My queries are with regards to the following forms: I-130 (Is this to be filed separately, or with the the I-485, I-131, and the I-765) I-130a (as above) I-693 (Does this go with the I-485 as "evidence", or does this get given at the interview?) My paranoia is usually fueled by how old the original posts are, and what updates are applicable etc. I'm almost confident I'm on the right path, I was just hoping for further clarification from anyone who has submitted these forms recently, and how the journey has been so far. Thanks all in advance.
  25. Hi VJ members, I had an interview today for CR1 in Islamabad. Everything was very smooth the interview was hardly 5 minutes and at the end, that lady gave me this 1-page white form, initially I was not sure that what this form is and I didn't even read it at the counter. I asked her to what to do with this form and she said just keep it with yourself and the form title is Immigrant Visa Section (Modernized Immigrant Visas) and it says you visa has been refused under the provision of the immigration and nationality act and also section 221g (your visa application is refused for AP) is tick marked. Under this, there is General Requirements and Evidence of economic solvency and they both are highlighted with yellow ink. Also about the passport, she said that you will get it after 1 month. My wife was also there with me and we went together to the counter but the lady asked her to stay there in the waiting area. Now I don't know what to do or what to upload and the status of my case is not changed on CEAC website. 1 more thing that initially we submitted the birth certificate from the hospital with my SSC certificate to USCIS and then NVC wasn't accepting it then we uploaded the FRC from Nadra and now on interview we took the original birth certificate from Union Council and we also gave them FRC and the hospital issued birth certificate. Please share your thoughts. Thanks alot!
