  2. Hi, I have a question regarding my case. Here is a bit of background first: My wife is a U.S. citizen and filed an I-130 for me, her foreign spouse in April 2013. At the time, we weren't sure where we'd settle. We then filed the I-485 separately in October 2013 once we decided to settle down here. I got the approved AP document in November 2013 and the approved EAD card in January 2014 (AP and EAD filed separately too). Then we got interviewed in February 2014 at the NYC Manhattan office but the officer said he couldn't determine "admissibility" since the I-130 form was not at the office we were interviewed in (it was still at the Nebraska Service Center after being transferred there from MSC-National Benefits Center). He said he would request the file from Nebraska and then we could expect further documents/instructions in the mail. As of today on the USCIS case status website, the I-485 status still shows "Testing and Interview" (it hasn't been updated since the interview). However, when looking at the USCIS case status website for the I-130 petition, it shows "post-decision activity" and the following text: "On March 12, 2014, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly". I called USCIS and they said that this is weird and that it wasn't supposed to be transferred to the State Department since there was a I-485 filed. The representative said to make an InfoPass appointment with the USCIS office to have them bring the file back to USCIS from the Department of State. I also called the Department of State today who said they will have no information regarding our case until 8 weeks after the date USCIS sends it to them... So, 1) Does anyone have any insight or experience as to what we are supposed to do? 2) And regarding InfoPass, there are no appointments at the NYC Manhattan office that we interviewed at or any of the other two offices for our New York zip code. When I type in a zip code in New Jersey which is close to where we live, there are available appointments at that office. Would I be able to give/get the information I need at the New Jersey office even though my case was interviewed in the New York office? Thank you in advance VJ community for your help!
  3. Guys, need your help. My I-94 expired in the end of February and we still didn't send papers for AOS/EAD/AP because we're moving to another city in May. So, my question is - will I have any problems since my I-94 expired? We got married in January

Here's my timeline: Date Mailed: 01/18/2018 Date Received/Priority Date: 01/22/2018 Received Text/Email: 01/29/2018 Date Received NOA Letters: 02/02/2018 Received Biometrics Letter: 02/08/2018 I did Biometrics today. Yesterday I received a courtesy letter from USCIS on a yellow paper informing me that they have reviewed my documents and noticed that I haven't submitted the form i693 and to bring an updated from(medical exam) at an interview. They also said not to send it right now, to wait for a RFE before the interview. However, I haven't received an interview notice. I know it's too soon for that but I was wondering what it meant. Does it mean that I wouldn't get an RFIE and my case is ready to move forward?
  5. I am starting to gather documents for my AOS applications and I have numerous questions 1. I have filed a Social Security Number before my marriage. I am planning to change my name, is it smart to update my Social Security number first with my new name? 2. Do we need to send in supporting documents such as pictures of the wedding with the I-485 or is the marriage certificate enough? 3. Do I also need passport style photos of my husband or do they only need mine? 4. I completed my medical examination and vaccinations, where do I put my medical records? Thanks in advance!

Since Houston is one of the most slowest offices currently, it would benefit all of us to communicate and share any experiences we are going through when it comes to the AOS from a K1 visa in Houston. Please share any communications you have with Infopass associates or USCIS phone calls, and any other movement or changes with your case.   7. Good afternoon, I just wanted to fill you guys in on my experience renewing my MO drivers license today. I filed for EAD/AP/AOS early November and it's still pending. I took my US MO Drivers test in November using my I-94, Passport and K-1 Visa page but my license was only valid for the length of the I-94 document. Of course this expired a little while ago, and I have been unable to drive. So my wife emailed the DMV requesting information as to whether or not we'd be able to renew my license for the time being. There is very little information out there in this. I have included the e-mail below. I walked into the DMV today, and brought the following documents with me: Marriage Certificate Passport AOS Receipt (With stamped biometrics) EAD Receipt (The DMV scanned this document) Utility Bill (Something with my name on it tying me to the address I live) It took her a few tries of various numbers on the EAD receipt but it was approved for renewal of my DL. The process took about 10 minutes once I was at the desk. So those of you wondering about drivers licenses, e-mail the DMV and ask about your state's laws regarding it. Remember: Not all DMV staff are competent. I hope this helps someone out there!
  8. We are just about ready to send out the Adjustment of Status (from K1 Visa) packet, but there was one thing I was not sure of regarding the marriage certificate. The certificate of the town we got married in has a notice at the bottom with something like: "Warning: It is illegal to duplicate this copy by photograph. Not valid without city seal" ^^The city seal also does not appear on the photocopy. While I know that USCIS requests photocopies of original documents unless said otherwise, in this case I am worried about an RFE for the real marriage certificate due to this message at the bottom. It's not a huge deal to send in the original marriage certificate, as it is really easy to request additional certificate copies from the town, but I would prefer to just send in a photocopy if possible. Has anyone else had this issue?
  9. I've had a bit of an unexpected situation come up and I'm curious for anybody's take. I've seen a lot of old threads about AP expedites but am curious for more up-to-date information. I came to the US on TN status, and am still working for the same employer (my status expires in September 2020). I applied for AoS/EAD/AP on 12/01/2018 based on marriage to my USC husband. I've completed biometrics and am now waiting for EAD/AP, which is estimated to arrive May 13-17, 2019, according to today's VJ estimate. The situation Every year, my boss attends a very important conference for our industry overseas -- it's a huge opportunity to network with our international partners and possibly bring in more money for the company, not to mention that the trip itself is also a financial investment. This year's conference is the first week of April, and my boss already made tons of meeting appointments with important contacts, booked hotels/flights, etc. Last week, she broke her foot really badly and has since been advised by her doctor in follow-up appointments that she won't be able to travel by plane by the time the conference comes around. She stands to lose a lot of money if we have to cancel everything (not to mention the lost potential income to the company if we don't attend at all). Today, she asked if I would be able to attend in her stead, as I work closely with her and am familiar enough with her work to act on her behalf. It would be a great professional opportunity for me as well. I know it might be a long shot, but with a note from the doctor and a letter from my boss, is it worth trying to submit an AP expedite request so I can make the trip for her? One of the USCIS expedite criteria is "severe financial loss to company or person" -- does that need to apply to me specifically, or can a loss to the company I work for also count? I know that this doesn't qualify for an "emergency advance parole" but perhaps a case can be made to speed it up. I'm based in NYC, and my field office no longer takes InfoPass appointments. As I've seen it, I would need to call the USCIS Contact Center number, tell them my request, and then they would ask me to follow up with evidence by mail/fax? Does anyone know how long this process usually takes? Would my boss need to provide flight receipts/accommodations to prove that expenses have already racked up, etc? If the expedite doesn't go through, my boss would never want me to risk my status/AoS (of course, I'd never risk it either!) by leaving, but it would be really beneficial if I could make the trip. I appreciate anyone's experience with expediting AP for work travel. I know I'm in a bit of a different situation as I'm doing AoS with valid U.S. work authorization, but maybe other TNs out there have encountered it? Thanks!
  10. Hi everyone, I'm newbie here so I wanna apologize if my given information isn't clear. So my PD for I-130 is 05/22/17 (still pending) however I've heard good news that there a quite a few people are getting approved for May 2017, CSC and from my country. I filed for AOS with I-765, I-131 06/25/18. I expedited my I-765 and got it early September but until now I have heard nothing about my I-131 even tho I've tried to call them 4+ times to expedite/investigate. Still nothing. Anyways, I got RFE for I-485 last October and I already sent out the package to respond November but it seemed that they lost my package and they claimed they never received. We tried to call 5 times and they told us to wait till they respond but no respond so far, investigation was opened but no reply, tier 1 said tier 2 would call, NO CALL. NOTHING. Until we freaked out and re-sent the package once again in 02/01 (friday). 02/04 I got the status changed " respond ... received". Okay, great this time they got it. Fast forward I got the status changed "case is ready to be scheduled for an interview" 02/12/19, which was yesterday. My field office is Mt. Laurel NJ. I've read a lot of people had to wait for 7 months + for the status to change from "ready to schedule" to ..."interview was scheduled". However, since I already sent out the i-485 last year, would it count the pending time as waiting time? Or I would have to expect the date to reset from the time they received my RFE respond? Any odd chance that I will have my interview before my I-130 is approved? I know I won't get a GC if my i-130 approved, but I just wanna make sure I understand everything clearly. I enter US through K1 visa and then we moved out of my Fiance's parents house to an apartment after the wedding. The address indicated in K-1 (I-129F) petition is his parent's house. Do I need to change address online before AOS application?

I was just wondering of what exactly to do after our K1 visa is approved? 🙂 what forms to work on, what processes to follow, my fiancé’s work visa, maybe if there is a master list on visajourney I could refer to, to start from? I just don’t want to miss a thing and I want to do this entire process properly for the both of us. I just want to stay with my love.   13. Hello Everyone, My wife recently adjusted her status from a K-1. We received her Permanent Resident Card in the mail the other day and her category code is listed as a CR1. Since she is a K-1, shouldn't her category code be CF1? That being the case, should I have her Green Card corrected? Or does it matter? Thank you so much for your responses.
  14. Hello everyone, I'm looking for some advice on filing a 2nd AOS after I cancelled the first one. My wife and I had some culture shock problems and it looked like everything was irreconcilable. We have both looked at our mistakes now and decide to work things out. I cancelled the AOS but we are still married and I plan on filing another AOS with her. Does anyone know if there is anything different I need to do the 2nd time filing since I am the one who cancelled the first time? Should I write a letter explaining the situation? Should I talk to an immigration lawyer or anyone else? Also a more urgent issue is that I'm moving to a new apartment and my application was approved, I am moving in a few weeks, does anyone know if there will be a problem approving her to be on the lease since her AOS was cancelled and is not currently pending? Thanks very much for any info or replies.
  15. I m trying to fill my I751 to Remove Conditions on Permanent Residence to get the 10 years green card. I have couple more question my first question is I went to USCIS and i have seen for Kentucky i have to fill to Texas address but they have 2 address one for USPS and one for FedEx/UPS/DHL does it matter which one i send to? My second question is do i have send a check to pay for Biometrics fee or not, by the way we do not have kids. I hope you guys answer my questions i really appreciate it. Thank you.

On the I-864 Affidavit of support, my spouse has not filed her income tax returns for the most recent year (2018 ). She has not received her W-2s yet. Can we possibly use the tax returns for 2017, 2016 & 2015 instead?

Hi guys, based on some of the posts I've read around these forums, I understand that having a joint bank-account is one of the important proofs that can validate the genuineness of the marriage, & therefore, K1 couples should get a joint bank-account immediately after getting legally married. This being the case, when we're filing for Adjustment of Status, how much of the assets in the joint-account can be claimed by the US citizen-spouse on I-864 for the purpose of income-requirement? For instance, if a couple has 50k in their joint bank-account (some of which was brought over by the immigrant-spouse when they came to the US), can the US citizen claim the entire 50k as belonging to the US citizen, on their I-864, for the purpose of meeting the income-requirements for Adjustment of Status?
  18. Hello everyone. Please advice i came to US on tourist visa. Five months in my boyfriend proposed and we decided to get married as he didn’t want me to leave. We got married on the last day my I-94 was expiring (October 2018). We have been doing research on the adjustment of status and now we’re ready to file. Do we need a lawyer? Considering that I’ve been out of status since October 2018 (4 months now) even though I was legally married when my I-94 expired. Please advice. Kind regards
  19. I already posted a question asking if adjustment of status were possible if i came to the states under ESTA. And the answers I got were positive, saying that i can and will have no problem. But there were some opposite opinions about when the ideal timing is to do so. Is 90 days rule a thing actually? Is there any certain time that i have to wait? I’m curious about when I should get married and adjust status, thanks.
  20. I came to the US on an F1 visa. I got married in 08/17 and filed for AoS in 11/17 (My wife is a US citizen). Both my wife and I have been working all these years. I received an EAD and Advanced Parole in 12/17. I traveled abroad and got a PAROLED stamp on my passport on my return to the country because my AoS was pending. My understanding is that currently I do not have a status (even though the F1 visa on my passport is unexpired) because I have the PAROLED stamp in my passport switching my status from F1 to 'no-status'. My AoS is still pending, and I have sent a follow up to USCIS since it is outside processing time. In the past I have used tax prep software that was provided by our university. The forms used were Form 1040-NR and Form 8843. The forms need to be physically mailed in, and couldn't be filed online. My question now is: Which tax forms I would use to file this year? Should I jointly file with my wife? If so what status would I say I am? Thanks for your help!
  21. Hi, I’m a South Korean who has been in the states on ESTA for less than a month now. I was planning to go back to Korea after my visit but after i proposed to my girlfriend who’s an American citizen, now she wants to get married and me to stay here. I’ve seen a lot of posts about adjustment of status for ESTA/VWP entrants but still am unsure if it’s possible. And if it is, I’d like to know when the most ideal timing is to apply for it. My fiancée is 20 years old and i am 19. I got to know that there’s a thing called minimum income requirements for my fiancée to ‘sponsor’ me but her income isn’t enough to meet those requirements. My question is, will the price of a house that her mom owns be admitted as assets to meet the requirement as long as there’s no loan on the house and the price is accredited? & if not, a joint sponsor who’s not a family member of my fiancée could sponsor me instead of her if we can find one?   22. My husband is a full time student and working part time. He was recently hired this September 2018 and we are filing now the AOS this February 2019. He used to work back in 2015 and had to stop because he got accepted in his desired University (Also here in the US). I have several question regarding the I-864 affidavit of support. Our current situation is: - He didn't made it to the poverty guidelines that is why we're filing a joint sponsor (his dad) - He doesn't have 3 recent tax return sheet (only 2015, his previous work and 2018 his part time work now) My questions are: 1. In the part where he should input the 3 most recent tax income, should I leave the other two blank? the 2nd and 3rd most recent? 2. As I believe so, the Total Income per year stated in Income tax return is different from current annual income. We will request Certificate of Employment reflecting this current annual income so that it is visible for the checker. I just want to verify if we are correct? Thank you very much for all your help.

Hi, My interview is in 10 days so I’m going through my files and I have some questions: 1 - Can I bring my baby with me (I’m breastfeeding)? 2 - My husband was born in the States, does he need a birth certificate or can we use his passport? In the request for the interview they ask for his birth cerificate 3 - I’ve already submitted the affidavit of support, but in the letter they ask for my sponsor’s letter from current employer and proof of US citizenship, Is the passport enough proof? My husband is currently unemployed, so what document should we bring? 4 - a certified copy of our marriage document, I have the original (certified) and I sent a copy with the packet, so I need to get an extra certified copy? What is the reason they ask for a certified copy for the marriage document only and not for other documents, like birth certificates? 5 - if I’m currently working, should I bring any proof of employment? 6 - do they ask for copies to keep or can they copy a document in their office if they need to keep more evidence,? thank you so much, is there any checklist that you recommend for the interview?   24. Almost complete with my AOS filling but... I was quite hesitant with the signatures. The signature I used in the Marriage License and my signature in Passport biographic page is my maiden name signature. That's the only official documents with signatures I have. Should I use my old maiden name signature or make a new one in these forms? TIA!
  25. My main question is: is me getting married before applying for OPT going to prevent me from being approved? I know I can apply for adjustment of status, but I feel like getting a job would be easier if I started with an OPT, and then adjusting my status while working.
