  4. Hi all, I am newly registered but have been reading the post for quite some time and it has been very helpful. My story goes as follow: I had my Eb-2 visa interview at Guangzhou Consulate around mid October 2018. I told the VO that I currently work for a state-owned employer in China but have never been a CCP (China Communist Party) member. At the end of interview I was issued a green slip "final processing letter". It said the visa has been preliminary approved, but I need to submit additional information regarding to my current employer. I submitted relevant info accordingly. A few days after my submission, the Consulate emailed me with a new white 221 (g) sheet says “SAO Sheet-D”, requesting a statement re CCP and a detailed resume, for “Administrative Processing”. I was confused because I have never been a CCP member, and I promptly submitted the requested information which clearly stated so. Unfortunately there was no further development on my case since then, except for a couple of case status "last update date" change about 2 weeks ago. Today the case status still remains as “Administrative Processing”. The passport is still with the Consulate since interview. Later I learned that SAO stands for "Security Advisory Opinion", and many people who were previous CCP members have been requested similar information and gone through the process which takes extensive time. In my case there is a key difference however: I have never been a CCP member at all. I thought maybe it has to do with my current employer which is state-owned, but my affiliation is solely because of employment, and it should not be a ground for inadmissibility. Therefore I’ve got a feeling that this might be a mistake. I wrote to the Consulate, to the Department of State and asked my district congressional representative to explain my situation and for further help. All inquiries were eventually directed to the Consulate (or it's IV unit) and the response were all like: "...case is currently under AP in accordance with Section 221(g) of the Immigration and Nationality Act.... AP often lasts several months, but in some instances it can take significantly longer". No case specific discussions were shared. It has been more than four months since the interview and I really don't know what to do at this point. I would appreciate if anyone could share any similar experience, resource to go to or advise on what I should do. Thanks in advance!
  5. Hi everyone, I am positing behalf of my friend. My friend got 221G for his H1B visa interview and asked to submit the documents. He went for interview on 12th March and VO seems to be happy and asked to submit the documents and he submitted them. After the interview his case was updated to "REFUSED" and on March 19th it changed to "Administrative Processing" and on April 2nd it changed to "REFUSED". Now my friend is stuck in India as his passport is with embassy. Is anyone facing the same issue changing from AP to Refused after US closing the embassies in India or other countries? March 12th - Interview March 12th- Refused March 19th - AP April 2nd - Refused
  6. Long story short i was studying in LA 2012-2014, took a leave of absence with intention to return fall 2015, in march 2015 i went to renew my visa which was expiring in may, the visa was renewed, in may i flew over to LA to spend the summer there before school started. I was turned away at POE because my sevis was cancelled (which i had no clue about and was not informed when i renewed my visa). I was given a 5yr ban because i didnt have $3k on me to pay for a return ticket. I want to finish my degree so I got a lawyer who prepped the 212(d)(3), went for the interview this july. The officer asked me to explain what happened and why I got the expedited removal. I told her what happened she said she believed me. She gave me a green 221g but said she didn't need the waiver packet and didn't look at it. I tried to insist but she said it wasn't necessary, she was going to 'make my application nice' and would get back to me. She said she wanted to keep my passport so that I could just "pick up the visa". The only document she looked at was my i-20. Its been 3 weeks and they havent requested any documents, status is still under AP. Uni starts in 2 weeks. I cannot find anything online anywhere about a 5yr ban 212(a)(7) waived with a 221(g) with zero documents so i dont get whats going on. Anyone know anything about this or had a similar experience? TIA
  7. Has anyone had experience with the DNA request process? My fiancee was given a 221g with a request for dna to prove she is the mother of her daughter. This is even after supplying a birth certificate and several other documents. With in hours after finding this out I placed the order for the dna test from a company in Cincinnati Ohio called DDC. They are on the list that the US embassy in Manila accepts. They mailed the swab kit out the very next day. The problem we are having is when the package arrived in Philippines customs it seems to have stalled there. The company used DHL for shipping. It just updates daily with the terms "clearance event" and states the "the shipment is being cleared under Diplomatic entry". Has anyone had experience with shipping to the embassy and does this seem normal? Thanks for any help provided.
  8. Hi guys...my visa is Cr1...I had my interview in the end of jan 2020. My case has been pending in AP since then. As u all know that all of us got our status changed from AP to Refused around 3rd/4rth march I just want to ask anybody who got approved after that. I got few updates after 3rd march..like my date updated to 5th march...then 12th march...nd on 13th it got changed to AP again. My status went to AP again from refused on 13th march 2020. I have noticed in many cases that when a person goes to AP from refused, the person got issued visa the very next day. But, I did not get any update after 13th march when my status went from refused to AP again. Anybody with similar case? As per my understanding if a person goes from refused to AP, it can only mean that the case is done with the so called longer AP thing...otherwise why would the status change from refused to AP(when all other people still have refused status)....ANY SIMILAR CASES?
  9. We have our spousal interview March 24, 2020 in Manila. Well that is before they closed the Embassy to Visa services and put Manila on a lockdown. Anyway, last week we received a email from the Manila Embassy requesting us to provide them with a Certificate Of No Marriage (CENOMAR). Up until now we have had no delays or additional requests of any kind. It has all went smooth albeit very slow. We already summited every legal document proving our marriage is valid in the Philippines. They requested that the CENOMAR to have been issued in the past 12 months. Ours is 13 months old. Since the purpose of the CENOMAR is for a unmarried person seeking to get married, the PSA will not issue my wife a Certificate Of No Marriage. We have went to several locations and they all refuse to issue because, well, she is now married. Since I'm sure that the Embassy is very familiar with the Philippine marriage process I'm very concerned they asked for this because they know its impossible to obtain. Has anyone experienced this situation before and if so, what is the remedy.
  10. Hello, I had my Visa interview a couple days ago and was given a 221(g) with instructions to mail in a police clearance along with my passport. Has anyone else had this experience? If so, how long would it take for me to get my Visa after submitting the requirements? Pls share. Thank you! 🙏
  11. Hello I am new to this website so I am a little nervous but here is my past two weeks in a nutshell. I had my interview on the 26th of February at the Montreal Consulate and I was given a 221g to submit a new passport. I submitted my new passport on the 2nd of March and it got to the consulate on the 4th. On the ceac website it says that my case has been refused since the 26th of February. On Monday March the 9th my case has been updated to still say refused. I have emailed the Montreal consulate for clarification on what to do next. I'm very open to see if anyone would like to share their advice on what this means or if I should panic.
  12. My passport got damaged (threads came loose) during 221g administrate processing phase but I was able to renew it. For the visa stamping, I have no option but to submit both new+old since the old one is mentioned in the petition, I-797, DS-160 etc. Is there any reason that I will be subject to another interview or further administrative processing. Please advise how I can prevent further delays. Thanks, folks.
  13. Hi all, I was given 221G and asked to provide proof of domicile for petitioner. What are some qualifiying docs to overcome this?
  14. Has anyone been asked to submit documentation via DHL then asked to schedule a second interview? When i try to get the interview it says no appointments available at this time. Anyone know when they schedule interviews for Accra for 221g?
  15. Hello! good day! My mom went to her interview in Juarez Mexico but the consular officer handed her a blue paper 221g asking for more documents. We sent them but after 2 weeks we received the same 221g paper asking for another document which we sent as soon as we could. I called 4 days ago to ask for information after 2 months of the last request and they said they had in the system that in order to continue with the case we have to send her passport. We send it that same day and arrived the next day. 1 day after they received it they updated the system in CEAC but still appears in "Administrative processing ". I was wondering what does it mean that they asked for the passport? Is it a good sign that her green card will get approved? But why is her case still in administrative processing? Thank you
  16. Hi, my PD Nov 16, I had my interview on March 2019 but CO gave me 221g in which I had to summit my birth certificate and he said you case is being returned to NVC. He need more proofs now there is no sound we asked through senator USCIS replied him case received and pending for review. Now my husband called USCIS and lady told him your case is not in USCIS. She gave him Homeland contact number and said you should ask here. I don’t know what we have to do? And where the case is ? Can you help. Thanks
  17. Hello everyone, my fiance had his interview on november 22 2016, at jamaican embassy in kingston. They issue him a white slip 221g. The additional documents they needed were my tax return transcript, and w2 1040. They gave me the option to email those documents. I emailed them the next day. When I go on the ceac website, it looks as though they've looked at his case, I see a date of december 12. This is the second time they've reviewed it, last time it was december 2. So it went from November 22, to dec 2, to dec 12. But status still says administrative processing. Can someone please tell me what's going? Im very nervous....im nervous because I'm hoping I have enough income to sponsor him. I have a household of 5 (including him) and made only 35,000 last year 2015. This year, I made 37,000. I see for a household of 5, I would have to have made at least 35,550. So I missed it by 550 dollars. Can someone please give me insight? Does k1 go by 100% or 125% poverty level? Will they turn him down because of This? I had to complete form i- 134 affidavit of support, if that helps. Thank you.
  18. Hey guys, I had my interview on September 25th. I was given a 221g for my fiance's divorce documents as they were not certified. After finally receiving the documents, I sent them via courier to Montreal Embassy, in which they were received on November 7th. I got a "date update" on November 21st, (which was I think because they sent me an email that day) as well as November 27th (which is currently the last update). I know it says 6-8 weeks of waiting... but is there any chance I'm gonna get issued before then? It will be 4 weeks this Thursday. Can people please share their experiences of their 221g, and how long it took to get issued? I really think I'm starting to go crazy... All I want is to spend Christmas in the U.S. with my love.
  19. HI All, So I asked my local Congresswoman to step in after hearing nothing for 2 months on our AP. She did and to my amazement got a detailed response. Backstory....So after my fiance had a very good interview back in September in Jordan and was told by interviewer "Everything looks good congratulations and have a seat" we got called to a final window where they returned his passport and said we will call you in a few days. That followed with another email saying we will call you shortly. Shortly turned into 2 months. Via email they requested proof of evidence of our relationship. Ok of all things????!!! That was the most obvious. But ok...we sent them the same stack we dropped off 2 week prior to interview and even more....chat logs, video logs, call logs, photos, photos with family, family statements and then some...I loaded them. He sent it them via Aramex. They said "Received! Give us 4-5 days". That was on November 5th. Congressional aid stepped in recently and sent them an email with a confusing reply from Embassy that read "They are refused under INA221g pending evidence. Once we are done Administrative Processing we will update you". The Congresswomans intern was confused. She said "I don't know what it is they actually confused me . You are either refused or under AP. However you submitted evidence 2 months ago". I filled her in. I told her we never received a 221g but I guess asking via email is the same? Never knew! At any rate, the evidence was sent in. By the way interview questions were simple...just 5, same as the others, I know my petition was flawless. No issues. Congress is sending another email today and will ask for clarification. However, has anyone in here gone through the same?
  20. Hi! My case has been in AP for about 63 days after sending out my documents for 221g. Today at 5pm when I checked ceac it changed to “Ready” Does anyone know how long it takes to change to “Issued”? If you have been through this, can I hear your experience?
  21. Hello, Fiancé had interview November 15 and was issued 221g for joint sponsor and W2. Have had updates every week and today I checked and the case creation date and last update date were updated to today’s date. Still in administrative processing. What’s your experience with this? Going in the right direction?
  22. Hi, I just had my K1 interview, where I found out I had the wrong type of police background check, so I was issued a refusal 221g letter that clearly states I need to send them the correct police certificate and my passport. The lady at the time told me what she was doing and phrased it as "this is what you need to do to overcome it' Obviously I'm going to do that, but also obviously I'm freaking out because I'm terrified of being rejected. Has anyone else had a similar experience? And does anyone know if it's a good sign that they're asking for my passport directly with the new police check? I can't find much on 221gs that aren't for administrative processing, 😣
  23. Hi all, I've been a long term reader of this very helpful and supportive site! As I've been reading so long, I'd like to share and ask if anyone is going through a similar situation as my fiance and me. 1) My fiance had his interview in Guangzhou on 2019-01-24. The interview was ~10 min, and the CO did ask about his PhD in Materials Science & Eng and also kept the resume my fiance brought. None of the instructions asked to bring a resume, but we wanted to be very prepared as my fiance is in a TAL field. Atfer the interview, the CO gave my fiance the blue slip with only "Administrative Processing" marked and informed him there were no problems and the processing would take ~3 wks. 2) On 2019-01-28, we received a follow-up instructions email from the consulate with a Word doc attached named "SAO-M" (we presume SAO indicates Security Advisory Opinion-Mantis"??). When we opened the doc, the header was "Administrative Processing". The doc asked for my fiance's detailed resume in both English and Chinese (format resembled the DS-5535). And on 2019-01-29, we emailed the resume as instructed by the consulate, and we have been waiting every since.. 3) We have emailed the consulate multiple times. I have called and emailed both my senators and my congressman. My congressman has been very helpful in contacting the consulate and then the DOS (Bureau of Consular Affairs). But each time, we still receive the same AP comment. I did call NVC last Fri, and received conflicting responses: 1st response said a note had been placed into the system stating the case has been returned to the USCIS on 2019-05-31. When I called again to confirm, the 2nd response said there was no such note. One of my senator's office did say the consulate will often return cases for further background checks. Right now, we are just very confused and frustrated. Any tips would be much appreciated; thanks!
  24. Greetings, I am the petitioner and my wife went to the interview in Hong Kong 2 weeks ago and received a 221 (g) blue slip stating: Proof of your petitioner will establish a permanent residence or domicile in the United States, and she needed a certificate of No Marriage from the Philippines to be mailed directly to the consulate. The (CENOMAR) has been taken care of and someone from the consulate contacted her asking about my proof of domicile. We are planning to move into my parent's house. I have been gone several years but I have maintained a local bank account for the last 4 years, State driver's license, and have a local storage unit with invoices that are all mailed to my parent's address. I just got a quote for car insurance with my home address on the quote and I mailed 80 pounds of personal belongings home thru the HK Post office a few days ago. I have the shipping labels and receipt for the two 20kg parcels. My question is: I sent my father a Rental Deposit Receipt with the security deposit and first month's rent. He signed it and I signed it. Do I or my father need to get a Notary Public for this document? My lease here in HK ends in the middle of January. So I was planning to submit my rental agreement to show expiration, my shipping receipts from the HK post office, drivers license, driving record, my father's Rental Deposit Receipt, Storage Receipts, and 2 emails from recruiters that I replied to about employment and sent my resume (although there is no job offer). My 2nd question is: If for some reason my Rental Deposit Receipt is rejected, will I get another 221 (g)? I am eager to get this submitted as I just received it, but I am nervous it will get rejected. If necessary, I will go home beforehand, but it would be nice if we could go back to the USA together. Any helpful advice, thoughts, or experiences on this matter will be greatly appreciated.
  25. Hello everyone, I recently had my interview at the Juarez consulate on the 21st. Everything went well, but at the end of the interview I was issued a blue slip (221) stating that I had to submit my husband's long birth certificate. We originally submitted a certification of vital records, which did not list the hospital he was born in. Jump to the 22nd my in laws back in Arizona were able to get a copy and email it to me. Which I then printed out and shipped out that same day with my passport. DHL is showing that it should deliver by the 25th, if anyone knows how long does it take for the rest of my case to be processed? I’m a bit nervous because I do anticipate to be here for the next 2-3 weeks. I informed my employer about it, but I’m honestly scared to loose my job. We have so many bills back home, and due to this bump on the road it’s going to affect my partner and I a bit financially. Also if 221 is only stating that document and my passport that means everything else was cleared correct ? Thank you all for your help much appreciated.
