At the time of his departure, My husband was unlawfully present in the United States for more than 180 days, but less than 1 year (from November 6, 2007 to September 11, 2008 – the date of the issuance of the NTA). INA §212(a)(9)(B)(i) states, in part:
“Any alien […] who-- §212(a)(9)(B)(i)(I) was unlawfully present in the United States for a period of more than 180 days but less than 1 year, voluntarily departed the United States prior to the commencement of proceedings […] and again seeks admission within 3 years of the date of such alien's departure or removal […] is inadmissible.” Italics added.
Since My husband voluntarily departed the United States after the commencement of his removal proceedings, he is not subject to the inadmissibility criteria as outlined in INA §212(a)(9)(B)(i)(I) or INA §212(a)(9)(B)(i)(II) or any other relevant section of INA §212(a),

Got there really early, 7:30 so didn't wait too long. You sit in a waiting room that has the windows that you get called up to, first you get called and you hand in all the paperwork and forms, then I sat for another half hour and was called for the interview, it was short and friendly and on the spot was told that within a couple of hours after my fingerprints will be verified (given I don't have a crazy criminal past) the visa will be officially approved.
all in all, it was a good experience.

I had my interview last Friday (July 16th 2010). It was scheduled for 8:30am. I arrived at 7:45am and after a short wait outside the building was directed upstairs to the waiting room. I waited about forty five minutes before I was called to one of the 'booths' where I was asked to submit all my medical files. I was also told that my photo was not acceptable as my bangs were slightly covering my forehead so I needed to bring them another photo before they could process the visa. They confirmed they had recieved all the other necessary documents and sent me back to the waiting room to wait until I was called for my interview. I waited about twenty five minutes to be called up again, and was called back to a different booth for my interview. I didn't expect the interviews to take place the way they did, with four other people lined up in booths next to me, all answering questions like I was, through the glass, straining to hear. My fiance had her interview today and since I wasn't present I will relay what she told me. She got their at 8:20 AM for her 8:30 AM appointment. She had to bring our 1 year old daughter with her to the interview, but once there they would not allow her to bring the baby stroller in, strike 1. She then told me the first CO she talked with was a very nice young man who gathered all the paperwork they would need from her, he also noticed that our daughter was starting to get really unhappy and put her application at the top of the pile so she could go first., got the strike back. The next time they called her up she met with a woman whom she said was not very nice at all. She asked her questions about how we met. How did we prove that my daughter was mine, which was stupid because on my last trip there I registered her as a US citizen born abroad which was a pain in the rear in and of itself. My wife had her interview this morning. The woman who interviewed her was very cold and didn't convey much emotion. Questions included:
- How did you meet?
- Why did you get married in the US vs Israel?
- What do his parents think of you?
- What do your parents think of him?
- What does he do?
- Are you serving in the Israel Army?
- What do you have in common?
- Explain the age difference. (She's 19, I'm 31)
- What did you do while you were in the US?
At the end, she said "You're finished" but didn't indicate YES or NO. The CO, however, took her passport.
My wife asked her, "What should I tell my husband?" The CO replied, "I will keep in touch."
My wife then left. Not sure what to take away from this.
