    The DS-260 asks information about the beneficiary. You the petitioner can fill it out for them, there is a section at the end of the form asking if anyone prepared the form for the beneficiary, you can just put that you filled it out for them.
    You need to call NVC for the beneficiary ID and invoice number. You should have your CDJ case number by now, if you don't, call NVC for that too.
    Go to Mexicos embassy page here on VJ. It has a lot of information including the website that you need to go to in order to fill out the DS-260, pay the fee, and schedule the appointment. It also lists the other forms that you need. You should also visit CDJs website, they also have a list of forms that are needed as well as a PDF file of instructions and information you should read.
    And yes the DS-260 can be filled out before packet 3

    BOING Why do you always have something to say about Ciudad Juarez? Have you been? Hundreds of thousands of people have gone through Jaurez for visas and it's been ok... you never have any real helpful information for us all you do is fear monger. I can't speak for the others, but I know that I don't appreciate it.

    Same sex marriage as a matter of civil rights. Unfortunately, it is often a lawsuit that changes things.
    Brown v. Board of Education (1954): African Americans suing for the right to attend the same school as whites. One of the biggest cases in US history. Would you suggest to Justice Thurgood Marshall that he "wast[ed] state resources on this when it's obviously" not allowed for black children to attend the same schools as whites???
    Loving v. Virginia (1967): Yes. In 1967, it was illegal for an African American to marry a white person. This case ruled that prohibition on interracial marriages violates the US Constitution. Would you suggest that it was a waste of state resources to overturn a discriminatory law like this which prohibit two people from marrying????
    Are you suggesting that same sex couples should not sue for the right to marry and accept the laws as they are even if the laws discriminate against them??? Are you suggesting they not exercise a right and give in????
    So suing for a civil right is often the only tool to achieve justice.

    I have to disagree that the K1 is to allow a couple to get to know each other. Although that may be what many people use the 3 months for, I believe the 3 months is to plan a wedding. If you aren't sure that you want to marry the person you are petitioning, in my own opinion, you have no reason to file a K1 petition. It makes the wait time and process longer for those of us who ARE sure we want to marry the person we've petitioned for.
    On top of that it seems the OP allowed less than 3 weeks to "get to know" his fiance? Unless he thought he knew her and she turned out to have a completely different personality once she arrived in the US, this sounds like a really ridiculous situation where someone did not take the responsibilities of a K1 visa seriously.
    BUT the OP did not come here for criticism or judgement, just advice. My advice - to "extricate" yourself from the situation don't marry her. You legally have no financial responsibility for her or her children. Like many others here have suggested though- you may have a moral obligation.

    Contact CDJ in writing and let them know your name, case number, interview date, etc., and tell them your relationship is over and you no longer wish to apply for a fiancee visa. If you don't live near Juarez, then traveling there just to attend and say you don't want the visa seems like added expense and stress that is not needed.
    You can call them as well, but you should send them letter and keep a copy of it.

    In one of his earlier posts he wrote that his fiance, now wife, came to the US with explicit intent to marry, which is why he was advised to do the CR-1 so that they are not breaking any laws. If they just AOS from the tourist visa, it's visa fraud. As someone who just spent the last 8 months doing things the right way, I would urge the OP to do the same.
    To the OP:
    The I-130 is the name of the form that you will need to file.

    Your wife does not need to leave the US right now, and she does not file anything with the consulate. You need to gather the forms, papers and payment mentioned in the guides and send it in. Your wife can stay with you until her tourist visa expires, at which time she should go back to Mexico. Once she goes back to Mexico she can always try to re-enter with her tourist visa but it's not guaranteed she will be let into the US at that point, but then again it is never guaranteed someone will be let in.
    Since I'm assuming her tourist visa is good for 6 months, you're going to be able to spend much of the wait time together, which is a better situation than a lot of other people have on this site.
    So to recap: your wife does not need to leave the US right now and since she entered on her tourist visa knowing she was coming to get married it would be illegal for her to stay and adjust status without applying for the CR-1. That's not to say many people don't do that, but not only is it breaking the law, if you get caught she's facing a lifetime?* ban from the U.S.
    *not sure if it is a lifetime ban or a 10 year ban.

    w00t! Just got the call from my fiance that all went well and his visa was approved!! Many thanks to those of you who have chipped in when I was a newbie and helped lead us towards today.
    Advice to those of you just starting the process now...positive, positive, positive! Don't bring each other down. Research as much as you can, learn learn learn and ask questions even if they're stupid. Don't stay at home. Get a hobby! Something new and exciting.
    Good things come to those who wait, however impatiently

    I meant 2010. But you're welcome to hang out. Thread was made for a group of us that have supported each other the whole way. We know each other based on when we all filed for K-1. Nice to meet you, too.
    Those that have benefited from this "decemberite" group know who they are and will be here to gather info once we've all gone through POE.
    Doesn't matter that we'll file at all different times. What matters is we know we can count on each other to get through it, because we've already supported each other through the last 7 - 10 months.

    OMG! NOOOOOOOOOoooooo!! I'm so sorry! I totally understand. This process is so stressful and causes so much anxiety and stress. It takes an incredible amount of strength from BOTH of you to make it. Give it a little time. He either will come back around, or you will realize that you dodged a bullet. You support each other through better or worse. Doesn't sound like he could handle the "worse" bit. Heart goes out to you...someone out there has bigger plans for you. Keep your head up!!!

    I kind of look at it as a vicious circle, immigration is so strict because people came illegally, but now people come illegally because immigration is too strict.
    and strict isn't the right word.. maybe "ridiculous" works better.. idk.

    Cite your evidence for these contentions.
    As I have said previously, we are too often sorry excuses for citizens by accepting the fascism of the state. The OP's experience before the USCIS has been deplorable. However, rather than address the iniquities of the state, too often we scapegoat, not unlike what Germany did in the 1940s.
