  1. Seniors, I have gone through the guide but want to ask you. After filling out form for visa application, now I have to fill AOS form and send financial documents. Their website says send tax transcript for recent year but in emails I received earlier it has a checklist mentioning to send.

      Federal Income Tax Returns
      Form W2
      Evidence of income
      Social Security Earnings Statement
      Proof of assets

    So, what all should I send? I am a US citizen and filing independently.

    Online Immigrant Visa and Alien Registration Application (DS-260)

    for my wife who is overseas as a petitioner which is me. Last page is for social security card. Should I answer Yes to both questions below?

    • Do you want the Social Security Administration to issue a Social Security number and a card?
    • Do you authorize disclosure of information from this form to the Department of Homeland Security, the Social Security Administration, and such other U.S. Government agencies as may be required for the purposes of assigning you a social security number (SSN) and issuing you a Social Security card and do you authorize the Social Security Administration to share your SSN with the Department of Homeland Security?

    remember you worked in California there for california laws apply to you and there is protection against not being paid wages. and if they retaliate against you then you tell the board and they are in a world of hurt.

    Company seems least bothered even after including the emails of govt officials and says according to contract they haven't been paid by client so I will not be paid.

  4. That sounds a bit off.. doesn't jibe with why your company has stopped answering your calls and emails.

    After several calls and then finally including few others from consulting company and the client I inquired why I am not being paid. In email consulting company mentioned client haven't paid but we processed your payment but I am yet to get anything since that email. Also, Consulting company threatening me saying if client is involved anymore they will consider contract breach.

    Since then no replies to emails or phone and no pay. I am running out of savings by the day since I am looking for another project.

  5. you can still file a complaint against the company in California since the company is based there but I would try to find the equivalent government agency in Florida and file the complaint with them too. if you can't find the Florida one here is the national level one.

    Thanks seniors, I will call them tomorrow as I am not able to find an email address to put in cc of the email inquiring about my pay from consulting company.

    That is where I would start, Usually the state gets pretty tough on companies who don't pay workers.

    Thank you sir, I will update you guys on how I proceed and outcome. These companies have gotten used to this because people let them get away.

    Consulting company is in California. I am independent IT contractor who goes onsite where end client is located. I am Florida resident. End client is the world top retailer name starting with "W".

  7. Take care of these bills first, before paying the discretionary AOS and IV fees. A savings account comes in handy when times are desperate.

    Is this one of those shady Indian consulting companies?

    It's a consulting company in Milpitas, California. They work with few big clients but it seems paying the last check isn't what they are usually interested in which I am finding out now.

    Contract says in 30 days they have to pay but if the client pays. Consulting company says client haven't paid them and in other words I will not get paid. I am owed amount around 15k.

  8. In order to take any legal actions you will need a lawyer and to take them to civil court, which will cost you money. Try talking to them and threatening them first by taking them to court, maybe they will pay.

    Accountant sits in India and the consulting company is based out of US. I m owed around 15k but he seems least bothered and now stopped answering my phone and multiple emails inquiring about pay. When I looped in client, he said if I loop client again it will be breach of contract. In contract they have said, I get paid if client pays them but he was my employer not the client.

  9. Yes it's fine to submit the payment for the IV before the AOS fee. But double check that you can't indeed pay the AOS fee.

    When you send the document package you need to send the IV and AOS documents. That includes the tax return (or tax return transcript), pay stubs, along with all the IV docs including marriage certificate, police certificate, copy of the biodata page of the passport, birth certificate etc... As the other poster suggested please read the guides and the document cover page the NVC should have emailed to you. It includes a list of documents you need to provide.

    All the documents you listed have to be mailed with fees? I am reading you can submit one year of tax return or three year but what is required or how many years should I submit? Also, the Police certificate my wife has to get from India and send me copy to mail to USCIS right? Thanks for all the help.

    Even after reading the Wiki I am little confused. I just became Agent for my spouse a few days ago on NVC. Today, I received an email asking $325 for Immigrant visa application fee which came before the AOS fee of $120. Should I go ahead and submit $325 now? Also, at bottom of these emails it talks of documents of support, so do I send my tax return, paystubs, marriage certificate with pictures now? Thanks in advance.

    My spouse I 130 got approved and I received email about next steps. It talks about picking an agent, What is agent for and will we be charged extra money for that person services? Thanks in advance.

  12. Seniors, I filed for I - 130 for my spouse two weeks ago but I got laid off from my job. I started working in May 2014 and until now that means two years working, but USCIS website says three year tax return required. I made around $50k in 2014 and $75k for 2015.

    Now, I have around $30k in my account, if I go back to India, until I find another job here. How can I still process my wife visa without 3rd year tax return :(
