    If your wife wish for the kids to go to an American school they need to return to Peru, your wife needs to get them accepted to a Private school, they will issue the kids a international acceptance form 1-120. This is the correct process if you wish to give them the American experience.
    All other methods are illegal.

    Please stop scaring people with your unknown facts.
    This is a very simple AOS cases, please follow the guides above that related to adjusting your status within the US. Your overstay will be forgiven if your marriage is to a USC. Your work without authorization will be forgiven as long as you didn't use someone else social security number that could lead to claims that you are a USC.
    There is no need to leave he US before this process is completed, it would be in your best interest to not leave the US before the AOS is completed.
    Your case is a typical AOS within the US case.
    You do not need a lawyer, just follow the directions.

    There is good and bad in every case, even those with no red flags. So should I tell you that with your petition bearing evidence of being file thru the Morocco embassy you have less than a 75% change of approval from the initial petition. Or should I just say based on the facts you have presented there looks to be a fair chance that your petition will be approved.
    I can search and bring to your attention AOS petitions that have many more red flags than the OP and they have been approved. Do some more reading, or if you wish to represent the OP, offer him some assistance.

    You will be given a chance to reply to the denial when USCIS send you a NOIR/NOID.
    This statement confuses me "They stated that USCIS would contact me to see if I wished to continue with the process."
    Why would they make such a statement if you wish to continue with the process. Something happen durning the interview... Ask your question to give you details about the interview. Ask him to state all questions asked of him, and how did he answer them.

    The only option is the CR1. Nothing else will work.
    This situation happens more than I can count, I don't get it but I guess he did what he wanted to do. Now, he is stuck back in UK for the next 9 to 12 months.

    wow! well an ap is better than a denial right? it think this is good news kay...as i understand it tho an ap can take up to 6 months (that's what i've read on here) but it could take less time...i mean there cant b that many jamaican's on ap right?and if i understand correctly its the embassy that does the additional processing (not sure abt this)...
    can somebody say if at the end of ap there will be another interview??
    if so then kay u have to find out exactly what went wrong and what ur fiance said to get them in a frenzy...

    The point is the difference between visiting and immigrating. Following the law or ending up with a potential ban to ever entering the US (worst case scenario).
    Entering on a visitor program (as one may currently do as a Canadian citizen) means that it is a temporary trip. You aren't planning to live in the states permanently. A fiance or spouse visa allows a person to immigrate to the US and obtain legal status in the U. This enables one to work legally, obtain a drivers license, attend school, etc. All things that do have a point dontcha think?
    For the purposes of immigration, Canada is just like any other country. Just as the US is a foreign country in Canada.
    A less expensive route is the spouse visa.
    Do some reading to learn the costs and process. It's a few thousand dollars whichever route you chose.

    As the Indian spouse of an LPR, you have virtually zero chance of being granted a student visa.
    Simply "visiting the US regularly" also may not be enough for your wife to maintain her GC in the future. In order to keep the GC you have to live in the USA, not just visit. If she works and lives in India she risks losing her GC at any time if she is suspected of abandoning her residence when she reenters the USA. The risk is even greater now that she is married to an Indian citizen living in India, and visits the US by herself.

    Oh . . . my . . . God: that's exactly like in the movie 'Love Story' with Ryan O'Neal and Ali Mac Graw!
    His dad also believed that a person first should get an education, then a job, and when he (or she) had that taken care of, look for a suitable spouse and eventually get married. That's basically a sensible approach to life, if you want to call it that. But at least in the movie the head-over-heels approach of throwing everything we know to be true over board worked like a charm. Oh, no, it didn't. In the end she dies and he ends up alone. Most likely--and that's after the movie ends--he eventually gets married again and at that time the marriage will last as all of the obstacles that put lots of strain on a marriage are out of the way.
    But I digress: it's possible that you are an extremely intelligent young lady who has it all figured out at a very young age and just wants to get some feedback. If so, here's mine: I agree with your family. Finish school. Get a job. Save money . . . and socialize while doing that. Once you have become a successful attorney, revisit the issue of importing your boyfriend from your olde school days.

    Recommendations should vary widely by country. Your survey will be virtually meaningless without being specific to Pakistan. Also, the K3 visa is NOT available at this time. For Pakistan, spend as much time as you possibly can together before and after marriage and as many and as long a trips as you can without losing your job. You have a tough road ahead.

    In Jamaica the test does not need to be postive, he has admitted it and it will be written in the medical report. Question' Did the patient admitt to drug usage? check box yes or no. The doctor will check the box that say yes, the CO will see the yes check box, and they will use this as reasion to deny. I have seen it many times......

    YES he can be denied, they will deny him and give him the opportunity to re-apply a year later with evidence that he has not done anymore illegal drugs. In Jamaica they do not take this lightly. So be prepare for the worst and be surprise if he is granted a visa.

    And, after all that's been said so far, especially by Kathryn, how can you be engaged to a woman and willing to marry her and stay with her until death do you part if you haven't even met her once in your lifetime? Don't you think there's something terribly wrong here? I understand that people sometimes buy a car from far away without looking at it first (and often regret it), perhaps a camel or a goat, but a wife?

    Joe, with all due respect, I hope you've not sent any money to her. This has SCAM written all over it! Anything and everything can be duplicated in the Philippines. It sounds like you've not submitted the petition yet. If this is the case, good for you! Anytime a relationship begins with the petitioner or USC being asked for money is a huge indication that it is a SCAMMER! Don't get me wrong, there are plenty of Filipinas out there who are genuine and have good intentions, but, please cut off all communications from this one!
    If you've met this gal in one of those online dating websites, you have the capability of reporting her as a scammer.

    There is nothing your Senator can do. You are essentially asking the father to give up his son. This is a family matter. You will need the father's consent or a court order allowing the child to immigrate.
    The problem is international kidnapping by one parent. The US government requires the consent of both parents in order to issue an immigration visa to a minor as a precaution against international kidnapping by one parent. The US government will not assist a parent to move a child to the US permanently and deprive the other parent of his/her parental rights. The non-immigrating parent must consent to letting the child immigrate, or there has to be a court order allowing the child to immigrate without the other parent's consent.

    Do an immediate debriefing with your husband. Ask him to write down every question he can remember and every answer he gave--this is not the time to be defensive, but rather to put yourself in the place of the CO and see how you would have reacted to his answers. Also, what other red flags are there with your case--a few bad answers usually aren't enough to derail a case. Be brutally honest with yourself--and do it immediately while everything is fresh in his mind.
    Then come back and tell us all the red flags as well as the questions and his answers, and then we can start to help.

    That is the crust of the problem, the money was not considered to be stable, and the CO looks at the money as if it is intended for the usage of the business, therefor it could not be counted on to be used for the purpose of day to day living. Therefore , the CO has requested that you obtain a cosponsor.

    Our joint family income will be in the 6 figure area and my real estate equtity is over 1/2 mil . Not sure where you get him being a potential burden to society from that other than making an arragant assumption that non white couples are welfare types If you want to prevent burdens to society get rid of co sponsors and substituting assets. But I bet most of those are the poor white trash that want to come over and live off mommy daddy and welfare.

    Apparently your Ivy League education didn't bother to teach you basic reading skills. Maybe the reality of you is closer to your profile image & name than your claimed pedigree!
    Nowhere did I claim that criminals can't be American, in fact our prisons & jails are filled with American Criminals. I stated that his felonies make him deportable and that his false claims to US Citizenship make him inadmissible with no waiver available to overcome the inadmissibility. That is a far cry from you failed attempt to understand basic English.
    I would like to know where I described myself as a "middle salary man"? I have not felt the need to flaunt anything here including the respectable salary that I earn based on my knowledge & skill. The amount of that salary is not the business of anyone here and was only ever mentioned because you implied that since Vargas is a good earner & prize winning writer he deserves better treatment under the law.
    FWIW, Vargas will suffer very little if deported as he'll be able to world for any multitude of international organizations from his home country of the Philippines and will receive compensation allowing him to live like royalty and travel the world (with the exception of entering the US) whereas he currently cannot leave the US with any hopes of every returning.
    I see his "coming-out" as very self-serving and not the admirable sacrifice he is claiming it to be nor does it carry the prestige of the noble gesture many want to call it. He has nothing to lose and his freedom to gain my doing this regardless of getting deported or not.
