    Technically he only requires his valid green card in order to re-enter the US after being overseas for fewer than six months. 
     
    If he's a citizen of NZ them he doesn't need anything other than his valid NZ passport in order to enter NZ.

    Not as of yet. Apparently their vacation was a lot longer than I knew. I heard they are supposed to come back sometime in January, but I don't know when. I haven't seen much on Facebook lately either. All is quiet, but I know they aren't back yet.

    I'm not sure if she was actually in the proceedings or not. I just heard she was 'facing deportation'. I didn't ask past that.

    And yes, Jawaree, this is for a friend of mine. The reason for the great concern is because she is married to a family member of mine. I know this forum helps people immigrate the legal way. Check my signature. It was a long (LEGAL) process for me as the part outlined in my signature wasn't even half of it. My husband and I started as an I-129F form that got held up and ended up with me having to enlist the help of my local congresswoman to move it along. It was a painful, expensive, and torturous process.

    The reason for the 'sham marriage' comment is because my husband and I DID do it the legal way and when we hear of people avoiding immigrating the legal way, it's like a slap in the face to us. We spent loads of money to wait for our forms to be processed, and had to 'prove' we were really going to get married within 90 days just for him to join me here in the USA. So to have people come here illegally and stay, it really is a slap in the face. To avoid the laws of immigration and then get married to avoid being deported is hurtful and makes us angry.

    However, he is family and she is a friend of mine. I like her as a person and I understand coming here as a child was not her fault. They came to me and told me about their situation because they knew I had dealt with USCIS for quite a while. However, they chose to leave the country anyway. I do not know why, as I really don't know how she intends on coming back in. Unless she has AP and didn't say so, I don't believe she can. Hence why I was asking here.

    So, Jawaree, I understand where you are coming from, but please do not question me or my motives. I am torn because am passionate about how I feel about illegal immigration now that I've been through the heartache that is 'legal immigration'... and also because I am talking about my family and my friend. Thanks for your reply.

    Please do us a favor and update us whenever your friend attempts to come back to the US. I have a gut feeling she won't be allowed back in unless she filed for advanced parole.

    Previous posters are correct. All USCIS cares about is if you get married. Whether she's having your baby or not... they don't care.
    Might be a different story when it gets to the Consulate level... but for the I-129F petition, the pregnancy part is worthless.

    Sent my papers out today. Sent the original RFEs, the letter from my employer, pay stubs for the last 8 months (they only asked for 6 months though), and a letter stating that since I verified my income was above the 125% poverty line.. that information about my assets was not needed.

    I agree that you have no obligation. However, personally, I feel this is sad. I mean, person did take a large step in coming here.. I do feel that you take larger responsibility when you file for K1. Responsibility for the person that is coming here. My feeling (only mine, personal), if you decide to send this person back and this person entered relationship with you in good faith you own them ticket back, ride to the airport and reimbursing any disruption that you caused in their lives, such as if they sold apartment you have to help them get it back.

    I would first suggest giving it some time. Sounds like you are going from being single to having inherited an almost wife and two children. This is a really big change. On top of that you lost your employment which is additional stress you really didn't need right now. Also look at it from their side, having to adjust to you, a new home, a new country, etc. Lots of stress all the way around.
    Your almost family can remain in the US for up to 90 days (check the I-94 in the passport). Can I recommend that you give it a little more time before giving up on the whole thing? They must leave prior to the expiration of the I-94 or they will be out of status. She and the children (most likely) can still adjust status at any time if she marries you and only you. Thus, if you delay things a bit, while she runs a risk of being discovered and placed in removal proceedings, if she marries you after the I-94 expires she can still adjust status. What she cannot do is marry someone else and adjust status from within the US.
    A true gentleman would give it some time and a lot of talking and adapting to the situation and if all fails provide tickets back to the home country and part with her as friends.

    Just a random note, but you should probably tell your fiance about this if you haven't. I am reading your line of "This is something no one knows, I don't even think I've discussed it with my fiance to be honest" to mean you haven't told him yet.
    I would be more concerned about keeping a secret like this from your fiance... even more so than the health questionnaire for the Medical Clearance.

    The K1 is a fiance visa. If you get married, you no longer have a fiance. The main condition of the K1 visa is getting married within 90 days of entering the United States.
    This seriously needs to be stickied, it shocks me how many people think they might be able to do this.

    I just feel bad that we are getting half of the story by only hearing one point of view and the other side is not able to defend herself. That's why I'm trying to keep it in perspective for everyone here... by reminding everyone that there are two sides to every story, that everyone makes mistakes, and that no one is perfect.

    I'm sorry, but I refuse to believe that in 2 1/2 years that a person can only make ONE mistake in a relationship. I think both sides make mistakes all the time, whether they know about it or not. I'm sorry, but saying that there was 'only one mistake in the entire relationship' doesn't sound at all accurate to me. It kind of sounds like blame shifting to me. Now I'm not saying it's 'all Al's fault', but I am not saying it's all Elena's fault either. I'm sure both parties had a part to play, as this is how it goes with every relationship.
    Also, professing love for someone, and then bashing that person to the ground... I don't understand that. I don't understand how anyone who truly LOVES another can do a complete 180 on them in that amount of time.
    I don't wish ill on anyone here though, and that include Al. I do hope he finds the person he's looking for and finds ways to improve his life and himself along the way. (Everyone can use improvement!!)
