    Its a bit of a "gray area". However it seems you are already doing this and are the owner of a British company and it appears you are not working in the US, which is the point of the waiting for the EAD. Not sure doing freelance work for British clients and getting paid in British pounds and depositing that money in a British account qualifies as 'working in the US" in the traditional sense. The EAD simply allows you to work in the US has nothing to do with overseas work in another country. So if you maintain the same accounts and clients in your country of origin it does not appear you would be violating any US laws.
    Another option if you are working on US Accounts, is to make the Wife the CEO of the company, and she invoices the clients for the work and uses her own SS# for the 1099 as the owner of the company. You own the company here jointly and still can get an ITN and pay taxes on the joint income.

    Men petitioning for younger women seems to fall within the cultural norms of our society (US Culture) and is not uncommon in the context of marriages in the FSU countries. It seems that the marriages that get the most scrutiny based on posted reports here are older women petitioning for much younger men in the MENA countries where it is not culturally typical for that those countries. Add in the heightened security issues surrounding this situation and it creates a major hurdle to overcome.
    I believe if you and your Fiances' ages were the opposite you might draw quite a bit more scrutiny as a 21 year old American Male "typically" is not going to be in the financial circumstance or social setting to be meeting 32 year old women from the Ukraine unless perhaps working or studying overseas.
    I think in your circumstance the only scrutiny that will be applied is the circumstances of meeting and the development of the relationship. If that is plausible then you probably will not have a problem.

    "Quick" relative to AP is probably anything under 3 months. And I think if the passport was kept its a good sign nothing has showed up in any of the electronic databases which is also a good indication. In cases where there is a "hit" they usually return the passport and AP takes longer until they sort out the security issues from the "hit".

    Regardless of the circumstances its a violation of the I9 rules to specify any particular document, Period. I don't know about the "evil" part, but they are violating a Federal Statute by specifying a document. You decide if you break the law are you a criminal?
    They can ask for an updated I9, but the employee decides which documents off the I9 list a, b, or C they provide. Suggested, demanded, hinted, whatever... they are not supposed to do it. That is what I am saying and the law backs me up.
    If you read the case that was cited earlier in this thread the Government fined them 290K for doing just this, asking immigrants, because they were immigrants for specific documents... and that is discriminating based on national origin sorry you cannot see that. There doesn't have to be a threat of termination its simply treating someone different because they are an immigrant.
    Its clearly laid out that you hand them the form and they pick the documents... very simple stuff. Reading is fundamental and the warning to the employer is in a box at the top of the instructions.
    HR people at minimum should read the X*&^% I9 form, since the administration is running around fining people and doing so many audits.
    In my own circumstances, Did i ask my spouse write HR a letter? NO. did he need to no, I just sent a link to HR after the third time they suggested what documents I should send, and a link to the AILA website with the instructions on I9 audits. case closed.
    Had the situation been turned around and they asked for my spouses GC after proferring the DL and SS card, I would have encouraged my spouse to speak up and helped writing a response to HR since English is not the spouses first language.
    personally I think our spouses face enough hurdles in the process of getting established here, they don't have to put up with extra scrutiny because of ignorant HR people.

    Can we agree that "most people" who are in this process intend to live in the same country?
    Can we also agree that "some people" in this process will never get a VISA?
    Can we agree that for "some children" who will have to live a life without daddy in the country or mommy in the country ... that child might suffer in many ways, not only economically, but socially and psychologically?
    If we can agree that it would not be in the best interest of the childto live without both parents due to some bureacratic mess, then perhaps careful timing of childbirth for some couples is not such a bad idea.

    The largest of "hurdles" you will encounter is the Fraud issues with the consulate and USCIS having already attempted to immigrate her when she was married and the two tourist visa applications that it appears might have also falsely represented her as not married.
    When you tell one lie it leads to another, and in this case the Consulate that interviews her eventually if ever divorced will not take that lightly. Read the rules on Marriage Fraud because that is the charge they will
    be coming at you with. Not even sure if there is a waiver available if you could get approved at the consulate.

    I would STRONGLY advise against manufacturing evidence in this scenario. A better solution would be an explanation letter regarding your living arrangements and affadavit signed by both parents.
    Also address the co-mingling of funds issue and utility bills in this scenario. If you are paying your parents it makes sense to pay them using your joint checking account. It appears you have a joint bank account, provide additonal statemets.
    If you have had medical bills the address should be on the bills, if you pay in person ask for the bills and copies of the records listing your address.
    Go on Free Credit Report.com or similar site and run a credit report on each of you which should support your explanation the lack of co-mingling is simply you don't have many/any open lines of credit. Alternately you can apply for a loan somewhere jointly and they will run a joint report on you that you might be able to get a copy of.
    Your best source of evidence without making stuff up as ID cards don't prove anything except you went and ordered them last week in response to RFE... is affadavits from people who know you and have knowledge of the relationship.
    They should discuss where you are living, or mention and event they attended at your home, or you attended as a couple at thiers .. that type of thing. They could also mention if they attended your wedding or engagement party etc. As long as various documents span the length of the marriage it does not necessarily have to be financial related if you provide explanation of lack of money is the reason there is not much "co-mingling" evidence.
    If you filled out anything at work regarding selection as "married" such as insurance declination letter or w4 claiming multiple dependents etc that would be helpful.
    Pictures from the vacation you mentioned and the reciepts from the hotel for two people would be good as well as any other evidence from the trip.

    Broken is right about the I212, its 5 years.
    The reason there is little chance of getting another VISA is basically the consular attitude "fool me once shame on you, fool me twice shame on me". Since you did not comply with the rules of the last issue, its very unlikely they will consider you for a second chance. If you want to try go ahead nothing ventured nothing gained. I would lay out a very strong apology, with the theme of youthful indiscretion, but it is entirely up to consular and you probably wouldn't need to spend the money on the visa application and the attorney just to get denied.

    When you went over the expenses did you decide to cut back on food to Grandma or reduce her allowance for medication? Did you decide to raid the money that was paid in over the years and set aside in that specific savings account (medicare and Social Security)to pay for other "more important things" like fighting a war in a foreign country, or building prisons to incarcerate marijuana users, or spread the wealth to give subsidies to farmers, oil barron's or tax breaks to people who don't need tax breaks?
    As for increasing income 10% of the population is without jobs many of which have been outsourced or moved to foreign countries to consolidate even more wealth in the hands of people who are hell bent on decimating the economy even further. How does it lift your boat or better our common cause to give a bigger slice of the pie to those that already have had more than a fair share?
    I like my fire, police and emergency services. I want services to the elderly so we can be productive and not have to quit our jobs to care for parents at home. I like the public parks and open spaces and the museums and the enviornmental protections. I have traveled where they don't have these things and choose to live here where my quality of life is substantially more comfortable than many other places.
    If you have been building infrastructure for 35 years you know the government is key in planning and funding those projects so if the government decides to spend less on infrastructure and more on drug wars, foreign wars and wars on immigrants or unions and the middle class it may well have an effect on your family. Further the money you have been setting aside for retirement and elder care Social Security and Medicare is INSURANCE not an 'entitlement" and if your private insurance company decided to change the contract after 35 years and give the money to someone else or use it for some other purpose you might be screaming bloody murder. Ooops you cannot collect at the time we agreed on we just randomly decided you need to do back breaking work for another 4 years and retire at 79.
    And Yes helping the poor and the disabled and disadvantaged helps everyone since they are not breaking into my home or yours to get food, money and the necessities of life. The rich and greedy seem to always live in gated community with private security ...... signs of things to come if we continue the war on the middle and lower classes.

    Just like in the FSU you need the government in America to do what individuals cannot do.. like Infrastructure for a start. Young people old people, white people black people, rich people poor people need to be able to transport themselves to work. With the exception of a handful of sinfully rich people with helipads on the roof of their own mega structures the rest of US need state, federal and local governments to provide the transportation routes to get us to and from our daily grind where we earn our bread by the sweat of our brow. If you think getting the government out of our way will provide a way for the infrastructure to be built by individuals banding together to create it think again.

    Given the country of origin (a high fraud country) and the timing of the revelation and the fact she and he are there and you are here, its highly suspicious. Did she look him up in yellow pages and call to say, hey we have a child I never mentioned? What are the background circumstances? How well do you know this person and what else don't you know? It certainly begs the question as this came out of nowhere apparently.
    This is not what you planned or signed up for and its perfectly legitimate and reasonable to reconsider the application as CLEARLY the original plans have dramatically changed. Whether the child comes to US with him or not the implied obligation for future child support and all the other attendant responsibilities and expenses go with that.
    Not everyone wants baby mama drama and if you don't that doesn't make you a bad person.

    In todays current climate you should carry it everywhere, especially if you live in Arizona, Ga, Cali, or anywhere within 150 miles of a US Border. Better safe than sorry. If you get pulled over for a routine traffic citation and run into a vigilante cop you could end up missing for a couple days without it, makes no sense to take the risk.
