    This one of the many drawbacks of the K-1. Unfortunately many people stop reading when they see the part that tells them it’s faster than a spousal visa and make the decision it’s the right visa for them. This is food for thought for anyone still deciding which path to follow. And for those that still decide to pursue a K-1 it’s good to have the cost of the AOS filing factored into your budget before you start so that this situation doesn’t happen.

    To qualify as a commuter, you must have a stable job in the US and already a green card.
    If you do, you must file an I-90, Application to Replace Permanent Resident Card, choosing C2 category -commuter-, pay the fee -540 dollars-, and include pay stubs for 6 months. 
    You'll pick up your green card at a designated port of entry and must present form I-178 plus proof of employment to CBP every 6 months, 
     
    On this category you will never qualify for citizenship and if you don't work for 6 continuous months, you lose the green card. 
    If your state in the US requires residence for a driving license, you won't be able to get one.

    Update:
     
    Nebraska has now lengthened their processing time once again. We have decided to go ahead with AoS. I've arranged for my important documents to be sent to me from the UK and once I have everything together we will be filing the paperwork. As we see it, we have an opportunity to stay together which is better than being apart for an unknown, and ever lengthening, period of time - even if that time is spent in limbo.

    Once EAD and AP are granted I could travel, which would only be around 5-7 months. 
     
    We saw a lawyer yesterday who was very helpful but as yet we have not made a decision. I'm still leaning towards leaving in July at this point, but we need to sit down and make a budget and a list of pros and cons for both options and decide what is going to work best for us. For now we are both taking some time to mull things over individually and next week we will look at it together and make a mutual decision. I'm not in a hurry to decide right now, I want to be sure we do the right thing for both of us.

    Unfortunately the backward state of California is an outlier. Instead of only issuing election ballots in English they issue bilingual English/<insert language from list below> ballots
    Cantonese Mandarin Tagalog Ilocano Vietnamese Korean Cambodian/Khmer Panjabi Spanish Hmong Armenian Bengali Persian Arabic Syriac IMO, citizens (both natural and naturalized) shouldn't need bilingual ballots. English should be sufficient.

    Please you have to be very strong for your family and yourself . I don’t know exactly your situation but it doesn’t seem that all is lost . Put your energy in fixing this problem by getting the correct documents and getting married again and file as a spouse . Time goes by very fast and working on the process again the right way will make time go by even faster. It’s a very tough situation but you did not fail anyone , you didn’t do this on purpose , it seems you were confused and unaware of what was happening , honestly it can happen to anyone . Now you have to be strong for your family and yourself .

    When you file for AOS you need to also file for your EAD and AP. OTherwise, you will have to wait until you have your green card to work or travel and return back to the US

    I have seen some people who have been waiting for 6 months.........you will file the I-765 along with your I-485 and I-131 after marriage.....then wait....and wait...for approval......then you can legally work.......that is a downside of a K-1.

    Why is this surprising? The American is entitled and spoiled and they have the immigrants come over to work for them. Then they take your hard earned money and accuse you of using them for a green card. This happened to me.

    Evidence that he entered into the marriage fraudulently, only to get a green card, would have to be proven with documentation, like a fake marriage certificate, or you never really met or lived together. Did you submit false documents with the I-129F petition?  When you filed AOS?   It sounds like from your post that your marriage was very real--maybe not a very good marriage, but it was a valid legal marriage nevertheless.  What documentation do you have to prove that your marriage is not real?  Feelings or suspicions are hard to prove with hard evidence.  Focus on getting a divorce if that's what you want, try to heal from this, and move on.

    I am sorry to hear about what is going on. But to be honest, it is difficult to have someone removed after they get a green card. Since he is here, he can continue to have a path to remain in the US. There is not much you can do unless you have extremely good evidence of fraud (btw, cheating is not fraud).
     
    I want to address what you said above about citizens having protection from this. There are tens of millions of visa cases ongoing currently. You have to realize that the US government does not have the resources to do a thorough investigation of every immigrants true intentions. That is where you come in. It is up to you, as the petitioner, to provide the evidence that you and your ex is in a legit relationship. You are the one that sent in evidence of you and your ex are in love. You sent the evidence, filed the paperwork, signed legal binding documents to bring him here. There is not much immigration can do because you did everything legally to vouch for your husband. It is not the government's fault that people get fraud. The government set up a system to where a person has all these things they must do to prove a legit relationship. The problem is too many people spend too much effort trying to bring their love to the US as fast as possible and don't spend enough effort to truly find out about their significant other's true intentions.
     
    You are not the first and you definitely will not be the last this has happened to.
     
    No. The petition is yours. You signed the affidavit of support. By signing the affidavit you are telling the government that you will be responsible for your husband. You should take some time to thoroughly read the affidavit. In fact, it states in the Affidavit that even if you divorce, you can STILL be held responsible for your husband. And he can sue you for support based on the affidavit. 
     
    If you really read the affidavit in great detail, you will see just how serious it is.

    The issue is that this has happened too much in the past, so the government had to have a way to cover its tail because too many people got scammed and the US government was left having to take care of an immigrant. So the affidavit is a way to prevent people applying for immigrants and the US government having to pick up the pieces when the marriage doesn't work out. It is a way of immigration saying that, if it wasn't for you, he wouldn't be here in the first place so why would they be left being responsible for him.

    https://www.healthcare.gov/login  Most states use the marketplace however some have their own websites. Start on the healthcare.gov site and when you enter your zip it will direct you to your states website if applicable.

    Thanks, yes timing was our main concern, but now we're ok with waiting a bit longer if it means if Cr1 is a bit easier/straight forward and less hassle in the long run. Thanks for all the comments everyone!

    Here is my experience. My husband was in the country with an expired tourist visa and he didn't go back. He actually joined me to my oath ceremony without any issues. After the oath ceremony was over we went to the post office to drop off his AOS package. He has a Green Card now!
     
    They didn't ask him for his ID when he joined me. He had a ID from Colorado which they give to people without status. It says something along the lines that it's not good for identification or something like that but again they didn't ask to see it. My ceremony wasn't at a courthouse.

    There is no actual deportation at this time. They can get the case re-opened or refile up until an NTA is issued. At that point they would need to go through an IJ to handle the I-485. All indications are that the letter received is the standard denial letter, not an NTA.
     
    I would note 2 things:
    Cards are sent via Priority Mail, not Official Mail. This is forwardable (although I have been required to pick up a forwarded Priority Mail package at the post office directly). USCIS is (was?) testing out a process as of last year to require signature confirmation for delivery of these cards, along with verification of identity via ID.     Hi Everyone
     
    This site is always helpful for me so I decided to share my experience here. I had Interview scheduled for citizenship in Oct 2015.  Few days before the interview I got the call that my interview is on hold due to some reason and they will send me a new date. I went to the local office many time, visited the congressman office, etc did everything which I could. And the answer was the same (Application is under background check) Finally I got my interview today. and Guess what. It took less than 30 minutes. I passed. Officer was very Nice. and it was one of the best experience. my message to other waiters. Please don't lose patience. The process takes time but it will be fruitful one day.
