  1. hiii. My case was completed by NVC on Oct 28th 2010(learned via automated telephone service of NVC). According to the visa bulletin of Jan 2011, priority date has retrogressed to Jan 2008 in F2A category. I want to know I’ll get an interview letter soon or I need to wait until my priority date gets current once more.Thanks.

    You will have top wait till your priority date become current to get an interview..

  3. hello to all,

    this is my first time here so hopefully, i can get some guidance on this subject. here is a quick rundown on our situation.

    my wife (filipino citizen)came to the US in 1981 on a visa through her father, who was working for an embassy. her visa was good until 2001 where she became and still is an overstay. in 2000, she was convicted of a felony and a year before that was convicted on a possession of marijuana charge (misdemeanor). she also gave birth to child in 2000 that is a natural born US citizen. since then, she has stayed out of any trouble except for a few traffic tickets.

    we were married in 2005, and again in 2008. we have three of our own children, all US citizens.

    is it possible to adjust the status of her visa, even though she has overstayed for such a long time and with her criminal record? i am trying to go back into the military and want to add her as a dependant and make it possible for her to travel overseas with me and the children.

  4. F4 Category Brother or Sister of a United States Citizen Priority Date goes backwards again. Just spoke to Visa Specialist at the US Department of State. Last month priority date was April 1991. They were saying that if you Dont recieved a Visa this December 2010 all F4 category with the priority date after January of 1988 will be on hold until your date becomes current. this is so inconvinient for those people already submitted papers to NVC with expiration like police clearances.

  5. Hmmm, I got a rfe due to not having a court record so... BUT I was told that I could have sent a letter back stating I was in the process of getting it and they more than likely would have let me case complete and just show it at the interview. (however I wasnt told this till I had the damn paperwork)

    did you present the certified record check at the time of interview? or mail it to NVC.

    NVC told me to submit my DS-230 part 1 and 2 eventhough i am missing my police report.

    I am just wondering how to get an NBI clearance if you are living out of the philippines, i have been out of the philippines since 1995 and the US requires a clearance from the philippinesfor the purpose of US Immigration. Anybody's input is greatly appriciated

  8. How far is Medisys in Montreal from the US consulate? We are coming from Alberta for interview? It would be hard for us to go there for Medical and come back again for interview. I was wondering if we could be intervied the same week as the actual inteview date?

  9. I am also in the F4 category (my brother is my sponsor) and we are waiting for our interview notices. According to my attorney the main purpose of the interview is to verify identities and familial relationships. Of course, one can expect the regular questions about origin, background and personal history too but it does not sound nearly as invasive as the couples interviews in other categories.

    when is your interview? and when did you submit your ds230 I and II?

  10. hello once again i would like to ask where is the nearest Philipine embassy here in south seattle washington i am being confused about the location i browsed it thru computer but a lil bit confusing we might lost again on the way there Pls help thanks guys ...

    there is one in Vancouver but they dont service south of the border...the one that service in seattle area would be the philippine consulate in san francisco...

    Does anybody recall when did the CBP (customs border partrol) start using I-94 for entering the US as a non-immigrant visa and Does this includes Canadian Citizen visitng the US as canadian does not require a Visa to enter US? Because in Part II of the I-94 there is also a question regarding arrest charge similar to Question 41 on DS230 Part II. So if you have answered No on your previous visits to US in form I-94. previous visit like years and years ago and then you answered YES on DS230 question 41.. it can trigger a mis representation and can cause you to file I-601 in your visa interview. So anybody knows when did they start using I-94 it looks to me that this is just recent or maybe a few years back?

    I just crossed the border yesterday but am curious how long I have to wait to apply for my SSN. On my ds230 I checked No to the SSN as I had seen some long wait periods and even some horror stories. Also what do I say?? Is there anything special? I saw somewhere about mentioning a certain system but I am not sure what it is?

  13. I had a conviction when I was 19. The matter was discussed at the time of our interview, so nothing was held back from the person that interviewed us to the CBP Officer that canceled my Visa. After having us sit down for 2 hrs the person that interviewed us said that seeing as my conviction was a long time ago and that I've been good since, he granted me the Visa. But I guess that the CBP Officer had other ideas of that and decided to cancel the Visa. We will have the lawyer do the I-601 waiver so that we can hand it in after our interview for the CR-1.

    cody what exactly is the conviction all about... did you just have one cimt oz if you have only one cimt they should have allowd you or does your conviction fall into the petty offence or not?

  14. I need some knowledgeable people to weigh in on my problem:

    Brief background - on Aug 4 of this year, I had my visa interview in Montreal. I have a criminal record (which I fully disclosed). It involves ONE charge of theft under 5k in Canada. I got a summary conviction (equal to a misdemeanor in the US), the MAX I could have been sentenced to was under a year (I served no jail time), I got a conditional discharge and 15 months of probation. I never got into any trouble since then.

    Here's my issue (and what I need help with):

    At my interview, the interviewer thought that maybe my probation sentence would count towards the whole "sentenced over 1 year", which, of course if it DID count, I wouldn't be eligible for the petty theft clause and I'd have to get a waiver. He (the interviewer) mentioned he was "going to have to check with the lawyers in Washington". I have spoken to three different immigration lawyers (one being Laurel Scott during her internet chat on a Wed) and ALL three have assured me that probation does NOT count. In fact, here's a portion of what one of the lawyers told me:

    "Thank you for your message below. The petty offense exception applies to offenses for which the maximum possible penalty for the crime does not exceed imprisonment for one year. So the length of time you were sentenced to probation is really irrelevant for purposes of a petty offense analysis. Instead, I would need to review the statute of the CCC under which you were convicted in order to determine whether you qualify for the petty offense exception. "

    Well this morning my hubby's senator liason contacted the Montreal consulate on my behalf and she just emailed me back with the following:

    "Good morning Kathy,

    I spoke with our liaison at the US Embassy in Montreal this morning regarding your case. It appears that the embassy has not received the documents (I-407’s, etc.) you submitted earlier this month. He advised that you email montreal-iv-div@state.gov and inform them of when you sent them and of any routing numbers, if available. He also indicated that there are some outstanding issues regarding a criminal history that will need to be resolved before they can issue a visa. This may involve certain a waiver(s) from the Department of Homeland Security.

    Please let me know if you have any questions or concerns.

    How can I address this to make sure that it's taken care of so I don't have to wait forever because my hubby is fixin to deploy soonish and I would like to get home...

    sweetcheeeks,, just a quick question have you done the fingerprint criminal records check as well prior to your interview and how long did you wait to get them from RCMP?
