    Having a language difference is one of the red flag for the K-1 visa. If the couples didn’t have a common language to communicate each other, it is difficult to convince the CO about the relationship. Wait until the USCIS tell you what to do next. You could get a chance to appeal, or file another one or otherwise you can get married and file CR-1. Recently, I have been reading issues from Morocco, and I thought the embassy looks getting harsh on the applicants. I hope you will get a solution as quick as possible and I wish you the best of all.

    You do not need the joint account evidence, pictures or anything else. All you need to send is a copy of your certified marriage certificate with your AOS filing. Bring all the other evidence like that with you to your interview, if you even have one.

    It's only an issue if he either didn't file but was required to, or if the IRS has issued a tax lien against him. If he owes the IRS money, but there's no tax lien, then it's not a problem.
    FWIW, there's no way he got through the tax preparation steps in TurboTax and did not know he wasn't finished until he either filed electronically or mailed a paper return. It's just not possible. TurboTax makes it very clear that you're not finished until you've filed. I can understand perfectly his wanting you to believe this was an honest mistake. However, I've used TurboTax and I know this sort of mistake isn't possible.

    People who try to create some sort of hope for a person attempting to avoid the requirements are NOT doing them a service and I wish they would cease and desist such nonsense. It is virtually impossible to get the waiver on religious requirements for one simple reason. You are saying you cannot meet in person before marriage, yet you are applying for a visa to DO JUST THAT!
    Any person forbidden from seeing the other in person would best be served religiously by getting married in their home country and filing a CR-1
    These are silly excuses. Spring break is coming, get a babysitter and go to Pakistan. Sheeesh.
    The only such waivers I have ever seen are for medical harship and only after the foreign beneficiary was denied for tourist visas to the US.
    I suggest people stop giving false hopes to others because of some obscure boiler plate language in the law which exists mainly to respect some obscure religion that may exist.

    All indications are that you are an adult. My advise is to make an adult decision. Changing the location of papers is easily accomplished in a matter of days, if needed.

    More useful information could be provided if the OP would tell us which country/consulate they're dealing with. The visa application fee has been covered. Whether you pay it at the consulate or somewhere else (e.g., a bank) depends on the consulate. There's also a medical exam fee which varies, depending on the country and sometimes also on the panel physician. Some consulates ask the beneficiary to pay a courier fee to deliver the passport and immigration packet.

    Never ever give up. My fiancée’s first K-1 application was denied and returned to the USCIS on Sept 2010. I started all over again on March 2011 and this time she is approved. Actually you are not denied, even if you are denied, I can tell you there are a lot of other options and ways you can get her next to you. The embassy officer should never decide on your life. Fight until you get what you want. It took me 16 months to get the visa. I advise you to get up, organize yourself and respond to the embassy’s request.

    My fiancée has been on the AP for the last 4 weeks. There is no time limit to conclude the AP. It could take from few days up to a year. There is a better chance of approval after the AP. It is not the way they reject the application. The CO has nothing to worry about rejecting your application at the time of the interview. Embassies were rejecting visa application right up front for very silly reasons too. They put you on AP because they have something to clarify before issuing the visa.

    K3's are rarely issued anymore. They were introduced as a stop-gap measure at a time when spousal visas took a lot longer than fiance visas. To apply for a K3 you must file both an I-130 and an I-129F petition. If the National Visa Center receives both approved petitions at the same time, which they will in 99% of the cases, they will administratively close the I-129F and only send the I-130 to the consulate. This means your husband would be applying for a CR1 visa rather than a K3. The upside of this is that a CR1 is an immigrant visa - your husband would receive his green card automatically within a few weeks of arriving in the US.
    Anyway, your fiance is probably less than two months from getting his K1 visa, according to your timeline. Why would you want to start over now just because of the timing of the green card, especially if finances are an issue? If you get married tomorrow then you'll be waiting another 8 to 12 months before he gets a CR1 visa, plus you'll have wasted the money you've already spent on the K1, in addition the added expenses of traveling to France and filing a new petition.
    Let him get his K1 visa and then stay in France as long as he needs to finish up his work. The visa is valid for six months, unless his medical expires sooner than that.

    GOOD NEWS. My fiancée received an email from the embassy stating that the embassy reached a decision on the AP and issue a visa for printing. She has been in the AP for the last 28 days. Thank God, the first chapter is over and second chapter will start soon. I would like to thank the members of VJ for the help I was getting throughout the process. With out GOD and VJ, it will be really difficult to reach to this point.
    Thanks everyone who posted question so that I can learn a lot from the responses and also I appreciate those who took time read and responded to my questions.
    This process was not easy. I started the process on May 12, 2010 and the K-1 visa was denied at USE @ Addis Ababa Ethiopia. The second petition sent to USCIS on March 28, 2011 and my fiancée was interviewed at USE Frankfurt, Germany. After 16 months and 10 days, the first part of the journey is over. I am pretty sure, I will use this website and recommends as the best tool for any kind of immigration issues.
    I wish you the best of all and I advise you NOT TO GIVE UP AT ALL.

    Yes, he can apply for the K-1 visa at the Mozambique US consulate. However, you should be able that your fiancée moved there not for visa reason. The Embassy at Mozambique might consider he moved there for the visa reason and gives some hard time by putting him in AP. So if you decide to have the interview there, you should have ample evidence to prove that he is not there for the visa. This will add more stress on the top of proving the relationship between you and your fiancée.

    All I-129f application first has to be send to the Dallas Texas lockbox and then forwarded to the service center. Your lawyer did right. It doesn't mean that your service center is Texas. Most probably, it is CSC.

    These people will ALWAYS assume that the marriage is for immigration ( fraud)purposes. It is up to you to PROVE they are wrong. Sometimes all the papers in the world mean nothing.
    When my wife went to Warsaw, alone, for her interview the woman said to her " do you know your fiancée is still living with his ex-wife in her home..we have proof". Wow. My wife looked her right in the face and said " you are wrong. He lives alone at this address. I do not believe you. You cannot show me proof because you do not have any". And she was very confident in her answer. That was enough for the woman. She got her visa.
    One of the problems with these interviews is that the fiancée is intimidated.And nervous. It can be difficult. Most USC who accompany their fiancée ( usually they must wait outside) will not take no for an answer if there is a problem and maybe even argue a bit because it is THEIR government and they have the right to question the CO's.

    I don't think this information is right.
    If a second petition is filed in less than 2 years of the previous approved petition, there must be a waiver letter for a limitation waiver. Otherwise there will be RFE. I have been in that situation. If you go through the instruction of the I-129f Section 2 specifically instructed to have a waiver letter.

    My K1 was refused in Casablanca last January 2010. I was advised that I should wait for my petition to arrive back at USCIS and file a freedom of information act request to know the reason. I wasted months on this. And when I finally received the Consular noted pages from my returned K1, they were mostly blank and provided no real useful information as to the reason. Consulates are not required to give a reason for returning a K1.
    So.......based on my own experience and having read here of the dozens of returned petition stories of other people over the last couple of years.....my thoughts to you are this:
    1) Go over the interview questions very well from your fiancee. Try to determine from that where things went wrong. Come here and post the Q&As if you need some outside insight.
    2) Then either go to Casa and get married or refile your K1. No reason to waste more months of your life following a dead expiring petition.
    3) Be sure to address any possible issues up front in your next petition. Frontloading will be of great benefit for that Consulate in your situation.
    4) Be prepared for a long road ahead. You may encounter further scrutiny in your next petition.
    Best wishes to you in your decision. I know how hard this can be.

    The OP appears to be Indian, because he said it is a traditional arranged marriage, and that he is of the same caste etc as his wife. He knows full well about all the "cultural" stuff going on there.
    If it is a traditional arranged marriage, and they didn't bother to have the traditional religious ceremony, but rather did the bare minimum to get a legal marriage, and furthermore lied about what ceremonies they had actually had, then you can see why the CO would be suspicious.

    Our family has strong beliefs and it bothers that you put god and lying in the same question. GOD would never want you to lie about anything. God can only get you through things if you are truthful.

    There is no need to wait for a green card, AP, or EAD in Washington State. If you have the proper ID, you can get a State ID card.
    Each state has its own ID requirements to get a state ID card. Just check on the state's web site to find out what those ID requirements are.

    I would hope, I know in my situation it was true ... We as a couple, from 2 different countries had to have the conversation of whom would move to whom. And a back up plan in place, with a back up plan to that one. Just because the USA denied, didnt mean that I couldnt sponser him to Canada, and if that was denied, I was on my way to England to try there. I guess were lucky that it didnt have to go that far, but we were both willing to do whatever we had to to be together.
    Part of me is quite surprised that someone would make a finacial comment and then claim its over and theyve moved on already. I see no revelance really to this post and I scream troll. Its hard to feel sympathy for this OP with no information, no trials and tribulations being shared before hand.
    Everyone who knows anything about immigration knows that it isnt 100% guaranteed and as a couple you have to be prepared for it, you dont have to like it, but you do have to acknowledge the possibility.
    On a personal note, I did + a couple of other posters comments as I agree with them but I see no reason to debate this thread further exept to say that maybe this K1 was denied for quite obvious reasons.

    First Welcome to VJ. I hope it will be a good source for your process and a place to get answers for your questions.
    Both of them are the way of communication that USCIS passes the information to the petitioner. Notice of Action (NOA)-1 is the first letter that the petitioner receive after the USCIS get the petition from the petition and get to the line for the process. NOA2 is the letter that USCIS send to the petitioner to inform the decision. This decision could be approval, request for evidence(RFE) or denial.
