  1. Okay because if you enter the US via tourist visa (presumably since you will visit your family), you will not be allowed to adjust status because tourist visa is not for immigrant intent, even if you have a pending F2A petition.

    Processing of your F2A petition and F2A visa will be done in your home country.

    Do not speak unless you got information. I was told on two occasions that once my I-94 is valid and PD becomes current, I would have to submit I-485, copy of approval, and $1070 to make adjustment in USA. So i guess its up to whomever who wants to spend the extra $1070. Have a great night

  2. If what you claim is true, create another thread or forum about it and post all the details of how you can adjust status from F2A. :thumbs:

    I do not have any reason to lie. I called today because i was hesitant in travelling since i could become current by this month or next month. So i simply question what if i am in the USA and the PD becomes current. I do not need to adjust status in USA but you can question NVC yourself.

  3. No one knows the state of mind of the poster and therefore we should be careful of the responses given. Even if the response was recorded by the IO, isn't it the poster word against his? What if there was a misunderstanding or error and an immigration officer made a mistake on his record, would that be a ban for misrepresentation?

  4. Hi VJ Family,

    My friend is currently in the USA on her valid tourist visa. Her I-94 expires in December 2012 and she is also documentarily qualified under the F2a category and is awaiting her visa interview; priority date June 2010. I explained to her that based on the current bulletin trend of six weeks movement, she could become current by September 2012 and could therefore adjust status in the USA when she becomes current, if she desires. Her husband and her are happy to hear this and are giving it some consideration.

    Pls advise if she would contact NVC or make Infopass appointment if she chooses to adjust status and what forms she would need to file along with the I-485. Also would she get an approved EAD to start working before the green card interview, and would she remain in status should the I-94 expires befoe the AOS process is completed?
