    Based on what I've read here, it seems the girl is determined and going through the process of learning. I'm not sure how sharp she is with figuring out the best course of action to achieve her ends, but it would be prudent to assume she is very capable and likely to succeed given the current situation.
    Your friend really needs to put himself in adversarial mindset. I wouldn't take the risk that she's dumb enough to fall for returning to the PI and then missing her chance to return to the USA. Your friend also needs to assume that VAWA is an option she has considered and potentially is planning for. Your friend should focus on how to protect himself from potential abuse claims that would be supportive of a VAWA claim and pursue a divorce and remove himself from her as soon as possible.
    Your friend shouldn't be fearful of a VAWA claim. The actual VAWA petitiion for adjustment of status will be blind to him and have absolutely no consequence to him. However, the accusations of abuse that she would need to support such a claim will be a problem for him, though for these he will have the opportunity to defend himself. If she's dumb enough to bring up false abuse in a divorce proceeding, again, he would have ample opportunity to debunk them in court.
    Your friend should also not put much weigh in the I-864. Yes, as the beneficiary she would have the right to sue for support under the I-864. Yes, governmental agencies and beneficiaries have been successful in judgements against petitioner's who have signed these I-864s. However, the success rates are relatively few. It will be a long shot for her. In most cases, I believe it is most effective as a threat to get a petitioner to agree to a settlement. Tell your friend to play hard ball on this one and he'll likely succeed.
    He needs to change his mindset. He needs to understand where he wants to be when this is through. He needs a sound strategy to get there. He needs to execute that strategy without second guessing himself.

    Look at your marriage certificate, if there is annotation of the divorce then that was it..because NSO will not put your name and ex name in the CEMAR if your MC has no annotation...goin to the LCR is a redundant if the divorce info is already with the NSO..

    I taught ESL in China for a year so I understand how your wife feels. If we lived close I would have volunteered to be her study buddy. Some advice I can give is turn it into a fun activity and not a chore, not something to be intimidated by. Write the questions on flash cards and pick one or two a day to work on, play the audio cd in the car. The Chinese I worked with were preparing for much harder tests like the toefl and gre etc and they were petrified but very determined. Motivation is a huge factor. Maybe if she understood the implications of not being a USC then she will be more motivated? Goodluck and I would at least tell her to try

    I would personally write the consultant, not the client name. But to be honest, your post is a little confusing. Fill it out how it makes sense to you and then explain it during your N400 interview, which you will be given a chance to do so

    ICE doesn't have enough manpower, money to go get just an out-of-status invididual. Your story is not simple that you fail to maintain your F1 status. Once you are in deportation, removal or rescission proceedings (one yes/no question in i-485 form,) you will have a great hard time with the AOS, you need an immigration lawyer, not Google.
    Out-of-status is waived when you get married to USC, but I don't think it is applicable to someone who has an existing warrant by ICE. Please don't think a marriage and AOS right now will give you a safe card with the ICE, this is false info. Find a lawyer ASAP.

    From the time I filed my K1 back in 2010. I was part of the first month that they began using online scheduling, and the embassy was not new yet. When I visited two months ago I saw that they have since expanded. Based here, it seems that CFO is the same, maybe worse than before, still corrupt and nonsensical. Has the medical changed?
    I am finally nearing the end of my visajourney, filing for citizenship next week. Hard to believe that 3 years has gone by. We now have a perfect 1 year old and are happily married for 3 years. Just wanted to let others know to hang in there. It gets easier! AOS is a pain, but ROC is easy, hopefully N400 will be as well.
    Goodluck, and have a smooth visajourney! I will probably be back when the time comes for me to petition my mom, if I can convince her to move here someday.
    PS. If you are near Harrisburg, PA let me know. Always looking for new Pinay friends

    I would make sure to gather all the documents you need from him so that you can proceed to your interview without him. Also, make sure you have a copy of his orders when he gets it and he has a general POA for you to make things easier when he leaves and you arrive in the US. Goodluck. I survived a 12-month deployment, he got back 6 months ago. I even had my baby without him. Military wives are tough!

    AOS is pretty stressful, but once you get past that step it will be a whole lot easier. ROC is a piece of cake, and N-4OO isnt too bad. To me, the K1 and AOS are the worst stages. Enjoy the 2 years off
