    I don't think it's that easy...Nobody is going to make her leave when her conditional greencard expires...she has rights too, she can ROC on her own if she has enough evidence of a bonified marriage. Like the OP mentioned in his post SHE CAME HER TO MARRY HIM and like someone mentioned above, if she had to give up all she was doing back in her home country to move her and start a life with him and has nothing to go back hme to, then she deserves to be here and he just has to deal with it.
    Sorry for what you're going through OP, but NO you can't have her deported, at least without evidence of fraud.

    That's rather harsh.
    I don't carry my GC because the driver's license I carry requires me to show proof of permanent residency before they will issue it. My proof is my GC. My DL is proof that I have a GC. No way am I taking the chance of losing it.

    Come on --give the guy a break . we do not know his circumstances and he do not wish to explain . He have a job that requires him to be away for a while or on a ''special mission '' or deployed in a foreign country etc . He know the consequences and is willing to pay for it . Best wishes .

    Firstly, forget the K-3, improved processing at USCIS and NVC have eliminated it.

    K-3 served only one function, it was derived at a time when I-130 was taking years to get approved, however now since I-130 is approved at same time as I-129F the function of K-3 (Entry to USA and WAITING for I-130 approval) no longer exists, so NVC kills the K-3 in favor of the superior CR-1 or IR-1 visa.
    You will start by filing an I-130 for a spouse visa.

    You can still visit while in process, however be prepared to provide solid evidence of ties to home country.

    One of the things they look for when trying to determine if there was preconceived intent is a change in circumstances after arriving in the US, and which was not anticipated, that led to the decision to apply for AOS. The change in circumstances for most people entering with a non-immigrant visa is that they got married, so they would question whether the marriage was anticipated before entering the US. The scenario Bob was describing was someone who was already married when they entered, and there was no change in circumstances that would indicate to the IO that the AOS application was not preconceived before entry.
    In your case, it sounds like you've got sufficient evidence to show that there was a significant change in circumstances, and that the change in circumstances wasn't anticipated. I think you'll be fine.

    I came to U.S with my B2 Visa. i got married in Vegas 3 months ago then i filed AOS in Chicago Lockbox. I interviewed last week in San Jose, California. IO took my I-94 away and I need to wait his decision within 2 weeks. I received a text from my phone my case is updated with card production notice after I left his office about 2 hours later. I just got a Welcome to U.S letter this afternoon. I think you have no problem with B1/B2 Visa without intention getting married in U.S. Good luck!

    Third option: Marry now and file I-130 for a CR-1 spouse visa. Then don't overstay and return home for visa interview.
    This will cost less in fees, Spouse visa ~ $800, AOS from VWP ~1500+
    As for birth of child, the birth can be reported abroad getting US Citizenship for child, and getting a US Passport for child, thus no visa needed for child.
    AOS from a VWP can be hazardous..

    Please don't get an abortion! Does babies are more important than any GC or Naturalization. You don't have to be in this country to have a good life with your children. You and your baby's father can move to your home country if that's what it comes down to. YOUR BABIES COME FIRST!

    The avatar is in the public domain and free for anyone to use. There are other VJers in addition to me and HeralMounia using it - it really isn't a problem and as was mentioned above, the real problem here is the one Mounia faces.
    Mounia, I hope you know you are not alone and are able to take advantage of some of the suggestions people here have made. Gather the evidence you have now available to show how you and your husband have shared your financial concerns and liabilities. Don't hesitate to gather information that indicates the difficult times you have been having in making ends meet for you and your baby. Your husband signed a contract with the US government to ensure that you did not need to seek public assistance and the fact that you needed to will be his problem, not yours.
    Do consider getting a divorce, even though it is something you feel uncomfortable doing. You don't need to remain tied to a man who has so many problems looking after himself that he is not capable of looking after you and your child. I am sure this isn't the life you expected when you arrived here on the K-1 and it is so sad that your dreams have not come true. What you have now is a nightmare and you deserve so much better.
    Something else that might help when it comes time to file to remove conditions is USCIS now has a fee waiver form that you can complete if you cannot afford the cost of an application. A situation such as yours seems to be a perfect example of when this form should be used. You have a requirement to remove conditions and through no fault of your own you do not have the fee to apply for the application.     USCIS doesn't keep their promise when it comes to updating case status'...Some ppl go through the whole process without getting a single touch...Your case is just one month into the 5 month processing timeline. just be patient, you'll hear something soon.

    Total nonsense. You've been your husband for 8 years, married for 5, have an unconditional Green Card . . . there's nothing he can do to hurt you in any way (immigration wise) short of producing hard evidence that you only married him for a Green Card . . . half a decade before you got it!

    I disagree.......giving the baby to the mother should be the last thing she does, if she has absolutely no other choice and can't take care of her child. The mother (and father) can later claim abandonment and use that against her to gain custody. You never know what people will do when it comes to their families, especially a mother and son, even if she knows he is in the wrong..........
    A shelter would be a better option than that.

    Good grief! It also does no good to tell people they should panic, or to lecture them about proper planning. Most people DO plan, and things DO happen to affect those plans. Let's say you set aside $1500 bucks to cover the AOS and associated costs, and then the transmission goes out on your car? Hmmm. Fix the transmission and postpone the AOS, or walk to work and file that AOS ASAP?
    People come here asking for factual advice and not pompous lecturing. When you have the finances to resolve only one problem then you need facts in order to make an informed decision about which problem is the most urgent and has the most dire consequences if postponed. The fact is that, for the overwhelming majority of people, there are no dire consequences to postponing the AOS until you can comfortably afford it. By all means, plan ahead - it's the prudent thing to do. But don't do something rash if an emergency comes up that is more urgent than paying USCIS. Don't borrow against your credit cards, sell your only car, or skip your mortgage payment in order to come up with the fees. It just is NOT THAT URGENT.
    Please come here for honest help with real problems. If they want a lecture I'll be happy them give them my mother's phone number.

    Few questions.
    When did he get his conditional greencard? How long have you been married?
    Now that he's gone some of his behaviour might now be obvious as red flags. For instance, you said he always called to "make sure I am ok as usual" and did that morning. That makes it appear to me that he might have been planning this for a while, or having an affair and making sure that you were still at work, or home, or wherever he's not so he wouldn't be discovered. Can you think of any other behaviour that you just ignored? Was he secretive with the computer? Did he insist on doing the laundry? Did he shower right before you got home, or right when he got home?
    If I were you, I would be checking the computer history, or phone history, or card history to see if there's any indicators. I don't know if I would accuse him of fraud just yet unless you have any proof. I WOULD be removing him from your health insurance, car insurance, bank cards and anything else. If he used to be on the bank account I don't know if there's a way to flag the account so the bank knows he's definitely not supposed to be there anymore.
    The main thing is for you to do what's best for you and the baby. He packed his bags so whether he used you for immigration benefit we don't know, you don't know.. yet.. but you do know that he's lied to you because otherwise why would JUST his stuff be gone? He might try and come back. You might want to consider speaking with a counsellor because you are going through something right now, and whatever the result when he eventually surfaces (which I believe he will) you will need the emotional support of family and friends, as well as someone else who's objective.

    I doubt that's the point she's trying to make....All she's saying is though it is ADVICEABLE to file ASAP, if for some reason you're unable to file for a while (hey may be 50 yrs...you never know what situation ppl are in), there'll be no penalty from USCIS. Like she mentioned, you MAY have to sumbit more proof than other's but there's no "penalty" for not filing within the 90 day period.

    No police record needed for I-130 unless you have a criminal record.
