    Thankyou Bob and Vanessa I am now totally in the loop did not have my thinking cap on yesterday at all. I get so confused with some of this stuff and am I right if a person waits 2 years after marriage to file AOS they then have to send off 130 as well yeah?
    And to Lisa because she can lol and Vanessa has helped me a lot with my move here.

    Yeah no don't do that as it will get mixed up you will just have to wait for RFE. And as you have the marriage cert now you will be able to send it off pronto so it wont hold your case up.

    All I want to add to this is it is your choice of course but your Dad knew about this long ago and this could have all been sorted earlier and you would not be having this issue now. Your fiancee is waiting for you and it's not fair on either of you to have to wait longer. To the person who suggested you go CR1 route bloody stupid comment, you have just been aproved 129f and K1. If your Dad can't get this sorted now within a month sorry I would tell you go be with your fiancee and marry her. This is your life he has had his and now its' your turn. he can come over later if he gets a visa and spend time with you then. Just my opinion.

    Are you freaking crazy? A Fiance visa is a fiance visa not a spousal visa. NO you can't do that and whoever told you needs their heads read. Your fiance arrives here and you marry in 90 days and then adjust status. As said before if you marry over there and then she comes her married to you then it is immigration fraud.

    Sorry but don't be ridiculous. You are just a number on a form and it has nothing to do with the White house.Looking at your timeline you are at 6 months so you need to start calling USCIS to check on your case.

    If you did not send back all that they asked of you in the RFE then yes you will get another RFE. You need to read it thoroughly and then get all the required documents to send back.

Gee you have 1 hour aaww I am sorry but this infuriates me and you are upset because you can't get his Dad to expedite because he works for USCIS.

    NO this is very true but there is no point in whining, We all wanted our cases to go quickly and we all had to wait. I never even knew of this site when I was going through 129f petition we did it on our own . We all went through and still are or was going through stress over immigration but you have to suck it up and be grown about it and there is no need to tell the world how 1 hour is bad in time difference or that you work 10 hr shifts and so on and so on. I have been through enough ####### this last 4 months waiting for AOS so I know what stress is ok. But hey I just got word today AOS GC is on its way so am approved after feeling like a nothing in this country for the last 4 months. All anyone can do on this journey is talk to your partner daily and cam or do what ever text I don't care but keep going and it will all work out in the end. We are here to help with sensible questions not hear how hard it is being apart and as Barron said maybe they need to look at their situation if they are not coping cause it doesn't end once you get here . DONE i have had my rant for the day

    They may forgive her overstay because she willingly went home of her own accord and not deported.I know that overstays can bestow an instant ban but hopefully someone else with more knowledge can help you. Bottom line is she did break the law she overstayed her visa. Not something USCIS look upon nicely. Talk to another lawyer too. Good luck
