    The OP has received the suggestions that we can offer her, and the thread has degenerated into bickering. Therefore, the thread is closed to further comment.
    Very strong administrative action has been taken against one participant for multiple violations of this item in the VisaJourney Terms of Service:
    "Make comments in a Post either direct or implied toward another member that are purposely designed to upset, antagonize, make fun of, belittle, harass, insult, or otherwise instigate an argument that takes away from the personal enjoyment of the Service by other users." In addition, another participant insisted upon condemning the OP's actions multiple times before the extenuating circumstances were made known. This is an example of how jumping at a conclusion can be dangerous. It's also unnecessary to "stick the knife in and twist it." For the purpose of showing appropriate and inappropriate posting behavior, all posts are being left visible in this thread.     actually, she did NOT share what the emergency was. She merely said she went to stop a disaster, you have no idea what her disaster was, nor does it matter in the least. She came here asking for help, not for a bunch of drama queens making judgments. In a perfect world she would have gone to USCIS and applied for emergency AP, but she CLEARLY stated she did NOT have enough time. And why does it matter to you or anyone else on this site if she was "careless", as you state? She had an emergency, she went home, it's water under the bridge. It's no ones business, including mine, why she went.

    Honestly it doesn't matter at this point, and it's really not your place to judge her. Leave well enough alone. If you can't post something productive, stop making her feel worse than she already does.
    To the OP, your only real option is to have your husband file an i-130 on your behalf and get things in motion ASAP. Right now it is taking about a year from NOA1 to visa in hand, but processing times are constantly fluctuating and you never know, perhaps it will happen faster. Good luck and keep us updated.

    Stop beating the OP up, she feels bad enough without you rubbing salt on the wound. Seriously you have posted at least 3 times about how stupid you think she is. You have no idea what her circumstances were, or why she had to leave so quickly. Obviously if she could have done it differently she would. Enough drama.

    I appreciate all the helpful answers. To the ones that are blaming me, I had about a day to get home before something really bad happened and if I hadn't gone back home, I would probably regret it forever. So please, don't be mean to me. It wasn't em easy to buy a plane ticket at 4:30pm to board a flight at 10pm the same day and leave my husband, all we worked so hard for and our GC application. It hurts and we are desperate.
    So I kindly ask you guys to be judgement free and mindful to all the pain we are feeling right now.

    Just an FYI: English is not the official language of the United States. The United States has no official language. There've been repeated attempts, especially recently with the anti-immigration crowd, to pass a bill declaring English as the official language of the nation, but all attempts thus far have failed.

    OP, it sucks that you misunderstood the question. At least he didn't ask you if you've ever been a member of a terrorist group.
    English being my fourth language, I usually ask people to repeat themselves if I even have the slightest doubt. Next time, I know you'll rock the test.

    The OP said that the he/she misunderstood the question... he/she thought the interviewer was asking about the desire to vote... it's easy to make mistakes if English isn't your first language. If the OP wrote his/her own post, I'm sure she speaks English well enough to pass the naturalization test. Hopefully the next interview will be successful.

    Giving up after only just filing last June ? Seriously ? It took us 5 years from meeting to finally being together. We were in AP for 16 months
    and then our case was denied and returned. We filed again and were approved. It was a rough journey. If you can't handle your delay for 6 months then
    yes it is better to quit now. Not sure why you even started in the first place with that 'giving up' attitude.....perhaps it was not a real love but a fling because
    true love endures all, especially a few months or year of waiting.
    Just shaking my head at the instant microwave expectations when it comes to some people's visa journeys.
    Reality check....yours is not a nightmare but the normal procedure, come on, one months of waiting after the interview ?!

    Matt,
    First step for her is to get the K-1 visa, enter the U.S. (on her current Dutch passport), and get married
    (to you.) Then, she can/will change her last name. In The Netherlands, this is usually done using a
    hyphenated form: Mary Steenburgen will then be named Mary Hubbiename - Steenburgen. In the
    U.S., this can either be JUST your last name, or with her maiden name tagged on.
    Once married, she can get registered with SSA under her new name - they want to see her original
    passport, AND the document that proves the name change, in this case the marriage certificate. Once
    you have the SSN and the card, you can usually apply for a drivers license / state ID. That will also
    be in her new name if you mention that to them - they will, again, need both her passport AND the
    document that proves the name change.
    Then, you file for AoS/AP/EAD, and you can include both her names in that paperwork. Her "full
    name" would then be her married name, and for "other names" you add her maiden name.
    After AOS etc is completed (meaning, she gets her 2-year green card), she has that in her new
    name.
    Two years after that, she files for RoC, which results in her permanent green card.
    Sometime after that, she COULD file for naturalization. Since she is married to a U.S. Citizen, she
    can keep her Dutch nationality as well (Holland allows dual citizenship in certain cases; being
    married to a foreign national is one of those.) Naturalization results in a U.S. passport being issued
    to her, of course.
    She can request a new Dutch passport at any time after her marriage, but I'd wait until after AOS at least,
    because of the original K-1 visa stuff in her current one.

    Based on what the op has said, VAWA will probably be inevitable once she realizes he's not going to comply any longer.
    OP, make sure you document all interactions with her and do not meet with her privately, always make sure you meet in a public place or with other people around. Also try to document everything she has done since your marriage.

    Blue Blood, your fellow countrywoman is telling it to you best.
    And she does it very well.
    Yes, you and I and all here can file AOS from Tourist, Work and Student Visa.
    But that is little comfort to those who suffered much more being away from their loved one while going through the K-1 process.
    So those of us who avoid this 'being away from their loved one during the AOS process' need to be quite humble and not argue back against those who followed the longer, more painful route.

    File for AOS, wait until it is through if you want to avoid the ban and dealing with waivers.

    Really?! That is so inappropriate I can't even.... Is wish someone from admin would delete that. If you need to go down to that level you should not be on here.
    To the OP, I admire your persistence in answering everyone attacking you, I surely would have ignored a lot. I do think some are going overboard but you do have to understand that a lot of us can use ESTA but we did not misuse ESTA like you did. I know my spouse for a decade as well, have friends in many states, a college degree, job and apartment..... But I came to visit on ESTA like I am suppose to. Then I went back home and filed the right paperwork to come over and got married.
    The reason a lot of people are attacking you is because we did use ESTA to come and visit or come and get married but go back home and file for K1 or CR1.
    I'm not sure why you keep thinking people are saying your "illegal" action is to file months later, they are talking about misusing ESTA to get married and stay. Yes AOS is to adjust status, I did it that way too but I came into the US on a K1 like I'm suppose to.
    I'm seriously not trying to attack. I'm sure you had your reasons for spontaneously getting married or not filing right away, all I am saying is that the fact is you misused ESTA. If this is the legal/right way or whatever you want to call it, everyone would do it and there would be no K1.

    If you leave the country before getting AP (or a green card) you will have a ban, and will have to file for a spousal visa from your home country along with a waiver for the ban. If you can wait 2-3 months before leaving, that would be best, as you can file AOS now and you will have your AP in 2-3 months, allowing you to leave the country and re-enter.

    This is absolutely untrue. Overstay is forgiven for the spouse of a US citizen (just don't leave the country, it only kicks in then).

    Hi, thank you for your response but you absolutely assumed and read something into my post that is not there. I did not come with the intention to get married (hence tourist visa and not K1). I can definetely stay if I file for AOS, as a spouse of an American citizen overstay does not matter as long as you entered legally (which I did over VW). I was told this by two USCIS people on the phone - there is no ban if I simply stay, file and wait. The only problem is the AP which is EXACTLY my problem as I need to go home sooner rather than later. I would appreciate constructive feedback and not trying to paint me a criminal with the limited info you have read. Thank you.

    I don't know how up to date this info is but you clould try this number, 020-575 5309.
    Calling this number, you get into a menu which will refer to the information number underneath for all visa-related matters.
    You should call this number between 9-12 am. Choose option 2 for Dutch menu, then option 5 for the immigrant visa department.
    You could also call direct: 020-5755331 or 020-5755333 (the last number is the one to which you are being forwarded when you call the above number).
