    This absolutely IS visa fraud. A fiancee visa is for a fiancee. A fiancee is NOT MARRIED anywhere whether it is in the Philippines before she arrives or in the US when she arrives. If she gets married before she enters the US as a fiancee, then she is fraudulently using a visa issued to a fiancee with the full knowledge that she is not a fiancee but a wife. There is a totally different visa required for a wife - a spousal visa called the CR-1/IR-1.
    If there was a non-official ceremony that did not make the couple married - and some religious services in some countries fall into that category - then this isn't fraud as the marriage is not a legally recognized marriage. Any foreign ceremony that results in a legal marriage makes a fiancee visa unusable for the person to whom it was issued.
    Of even greater concern is recommending anyone to hide information that affects their eligibility for an immigration benefit or to misrepresent the truth of a situation - which is what you recommended doing when you said to enter the US on a fiancee visa even though she is no longer a fiancee. This is called misrepresentation and it is taken so seriously by USCIS that a charge of misrepresentation is often enough to bar the individual from entering the US for life.
    To use a fiancee visa the beneficiary must be a fiancee when the application is made, still be a fiancee when the K-1 is issued and still be a fiancee when she crosses the border into the US. Having a second marriage does not make the fraudulent use of a fiancee visa for a wife to enter the US legal - it just compounds the illegality.
    If you have done this, your wife is not safe from immigration. Whenever this is discovered your wife - even if it is 25 years from now and she is a US citizen - she will be deportable and probably banned for life unless the 'marriage' you had before you left was not legally recognized by the Philippines government.

    Did you submit an I-129F with the I-130? That would have been for a K3 rather than a CR1 visa. If so, that might have triggered the "hit" for the prior petition. A K3 petition is not supposed to trigger the waiver requirement, but it's happened before. If so then you just need to explain that the prior I-129F was for a K3 and not a K1.
    An abstract birth certificate is not sufficient proof of US citizenship. You either need a certified copy of the birth certificate or a complete copy of a valid US passport.
    An itinerary is useless evidence. You can go to Expedia or Travelocity and craft a nice itinerary in a few minutes without ever actually buying tickets or traveling. The boarding pass is good, but it sounds like you need further evidence to prove the year. Copies of the pages in your passport showing the visa and/or entry/exit stamps that indicate the dates you entered Syria would have done it.
    The statement about foreign language documents is a boilerplate requirement unless they specifically mentioned a document.

    Your disagreement makes you strongly WRONG.
    You need ONLY submit proof of meeting in person at least one time within two years of filing the petition. You do not need ANY proof of "relationship". You could have "met" at a "social", had NO relationship other than shaking hands, exchanging names and posing for a photo and it is sufficient for the petition.
    I sent exactly ONE photo and a two sentence description of how we met in person the first time and copies of my passport stamps and boarding passes. That is ALL. No receipts, nothing. There is absolutely NO requirement that you do so.
    "Proof of Relationship" is submitted at the interview. SOME people like to provide additional information with the I-129f for the benefit of the consulate (particularly with difficult consulates) and this procedure is called "front-loading" but it is NOT needed for petition approval and has no beneficial affect for the consulate in Kiev, Ukraine, which is not a difficult consulate.
    The OP was asking if he needed to (or should) send additional proof of relationship for the I-129f petition. The correct answer is "NO"
    If he did not include the required proof of meeting in person, he will get an RFE

    I don't know if it's the fact that I'm pregnant and have raging hormones or what but you seem to be a jerk to me. You tell her you want to hold off on the visa cause she didn't say Happy Valentines day to you. She sent you a gift it was the florist fault you did not receive it. To me that's a threat, telling her you do as I want or else I will hold this visa over your head. That is probably how her parent's see it also, the threats are already starting in their eyes and like any parent they want to protect their daughter.
    Then you find out she is in the hospital, and you question her father how can some little argument do that to her, but then you end up in the hospital over all this and get mad at her cause she is not jumping at your side calling none stop etc. Seems to me you are just as immature as she is.
    Moving and leaving everything you know and love is not easy for anyone, no matter the age. Some ppl do have very close family and family is a big part of their lives, some ppl can not handle it other's manage to make it through but it is not done over night.
    Again this is how I see it from your post.

    I have to ask - have you even actually read what I've written both here and in response to your other posts? It is almost fascinating how you completely re-invent comments that were never said, and then twist them so they fit into a tunnel vision view of the world. It is so black and white for you! If someone doesn't agree 100% with what you say, then you just attack them with little regard for the facts and circumstances of the discussion.
    Are your proposals so lacking in substance that they cannot be defended in any other way than attacking those who raised questions and pointed out problems with your plan? Since you don't answer the questions or difficulties raised about what you propose but just make innuendos and insinuations, it seems like they cannot be defended because you don't defend them - you just attack those who present information that you did not consider in your proposals. Equating my position - that a one size fits all, move everything to a computer and send all of immigration paperwork (whatever it is) to the Consulates and send all of the USCIS staff to the Consulates is not a viable solution to the problems that plague USCIS, and my second comment that since USCIS immigration is fee-based and not tax-dollar based so should not be affected by a Government shut down - how in heavens name do you get that I am flip-flopping and planning to take legal action against USCIS? If you call 'em the way you see 'em you may want to take a second look or else get better glasses, because you really are not seeing them; you are calling them, but what you are calling seems to be a self-creation that exists no where else other than in your own poorly understood conception of what is actually involved in immigration.
    Quite honestly, I don't have time for these games. If you were at all interested in discussing a topic you would at least read what was written instead of creating a conversation that never existed, while ignoring the one that did.

    They look at enough x-rays that they should be reasonably good at detecting the difference between a smudge on the film or an old scar from something that might be an active TB infection. If they do detect something then getting a sputum test is actually a good thing, and might even save your life. The x-ray can detect the infection while it's still fairly small and relatively easy (albeit time consuming) to treat. The infection grows very slowly, and responds to treatment just as slowly. If you waited until you had severe symptoms then it could kill you before the treatment could kill the infection.

    I think this does confuse a lot of people.
    Your petition is filed at the Texas Lockbox. NOT the Texas Service Center.
    The Texas Lockbox forwards your petition either to California, or Vermont depending on where you live.
    The only reason you see Texas Service Center showing up on timelines is because people have either been confused by the above, or haven't bothered updating their timelines to show their correct service center. Sometimes it makes me wish people really would pay attention to their timelines and update them correctly.
    There are NO I-129Fs being processed at the Texas Service Center.
    They are either processed at California Service Center, or Vermont Service Center.

    Ever go to the grocery store and wonder why some lines are moving so much faster than others? You see the fat lady reading the Soap Opera Digest - she got in line the same time you did, and you've barely taken two steps by the time she's checked out and leaving the store. Sometimes it's because everybody in the slow line has a filled their basket to overflowing, and the people in the fast line only have a few items, but you're smart - you check out everyone's basket before you pick a line to stand in. More often, it's because the cashier in the slow line is just really slow. Sometimes it's a combination of the two - half a dozen vegetarians get in the line with the cashier who has to look up the cash register code for every single vegetable.
    Processing petitions is sort of the same. Some adjudicators pull a box of petitions off the shelf and fly through them pretty quickly, sorting out the ones that should be denied straight away, setting aside the ones that need RFE's or further investigation, and approving the rest. Other adjudicators move a lot slower.
    Charleton Heston would have said "USCIS IS PEOPLE!". Or maybe he would have said "IT'S A MADHOUSE!". I'm not sure which.
    Call 'em. Email 'em. Other than that, try to focus on something else. Unless you're standing behind the adjudicator who has your petition you'll probably never know what the hangup was, so there's not much point in worrying about it.

    Your comment is uncalled for and insensitive. He *did* congratulate this lucky couple and then express his justified frustration honestly. And for that you publicly question his character? This type of community will best serve the members if we try to be compassionate and comfort those who are feeling frustrated, not by knocking them down at a time when we all are already vulnerable.

    Good Heavens. I thought you were working on your other topic, RE: your letter. Now I'm seeing this post which very much annoys me.
    You know what? My fiance is on at the USAF Base in Iraq. Just this morning he called to tell me there has been bombings in Baghdad and its not safe to travel. If its not safe, then military will NOT let the contractors off base to go home! And guess what?? I get to deal with it and so does he. That's the way it is. In fact, if we did get our NOA2 now, and he was scheduled for interview there is a very good chance he wouldn't make it because of situations such as this!!!
    And while this is tragic in Russia,and SEVERAL OTHER COUNTRIES whom have been terrorized, there is not one day I don't worry he'll call me during our very limited 3 min phone connection before we lose signal just to say they're going to bunker and he'll call when its safe! That happened on Christmas Morning Al, and you have no idea what I went through for 3 days of silence until he called. And still, I don't get on the forum to whine and complain about it, or grab at straws for an expedited case file.
    What you say here is a mockery of the US Govt. for attempting to use this tragic event of others and seeminly selfish of you to even think this is a way to get YOUR BRIDE here any earlier then the rest who wait patiently! Especially, for those who have remained calm, waiting for the day they see their [future] Husband or Wife come home from a war zone and knowing their life is on the line!
    I think it was already stated by Bob and Jim that an Expedite is for the USC and it requires a hardship / emergency.
    We didn't need this... it was offensive.

    Over all a pretty good letter. Just a few inconsistencies, e.g., I129F, i129F, i12F I believe. They should be fixed prior to sending. There may be others but I didn't notice.

    Well stated and I can understand the frustration, but I don't believe the 'crusade' will work. There is a lot more involvd than you guys seem to think.
    Sorry, but the 'crusade' attitude is just wearing on me. I'd prefer to just be patient. But that's just me.

    I am all for hiring more people at USCIS, better work management and an easier process. I am not for turning a blind eye just so I can get what I want, when I want it.
    If the Haitian TPS applications are truly the issue and I must wait to get a decision on my petition because they have prioritized TPS applications, then I am glad to it. I would rather wait a few extra months than to have some poor person get sent back to face disease, crime and possible death in Haiti.
    For the people who complain about Haitians and TPS delaying their NOA2, do you even care at what expense it will take.
    I love my fiance but I don't want to see someone else suffer because I want to hold hands and play googly eyes with him. I am just not that obsessed with him. God first, Fiance second in my life and I don't think God wants us to be this selfish.
    Your foreign fiances will understand, because the kindness shown to the Haitians is something that they would want for their friends and family. You will soon be able to get married and start your family's a month or 2 won't make a difference in the great scheme of things. It might make a difference in life of a Haitian though. [/font]
