    Received my greencard in the mail today! WooHoo! Done with USCIS for a least 2 years when I apply for citizenship! Are we supposed to dispose of our old greencards? Shred them? Or maybe keep them as remberance for all the mountains we had to climb to get here?!

    WooHoo! Literally just got a text message saying my case was updated! Checked the website and sure enough it says 'new card in production'!!!!! I am so FREAKING happy! I leave for Canada for 7 and a half weeks on March 24, so here's to hoping the new card gets here before my daughter and I fly out!

    Note to readers - it's exceptionally useful to study this fellas prior posts here. I did, and came up with his pattern of continuous gaming of the system, for 2013.

    I do not have a problem waiting. It's waiting in limbo without any solutions that is horrible. If these documents were easy to obtain, then I would have no reason to say anything. When dealing with corrupt countries like India and Thailand where making up the rules is the norm, it can be impossible to navigate around these obstacles especially when I get such limited vacation time off to travel with my husband and attempt to take care of these problems.
    You are very quick to judge me despite not knowing the obstacles I have already faced. When we got married, the official in charge wouldn't even look at our documentation. We still have not been able to register our marriage, something that is considered compulsory in India now. But you cannot force the hand of corrupt officials. We were able to counter with evidence but it took months of gathering information. This was over the course of 6 months PRIOR to even submitting our I-130. I am trying to do the same thing with our missing documents now.
    Yes I was lucky in that our I-130 was approved extremely quickly. But I would hardly call our visa journey normal. It has been the journey from hell. My husband and I have spent 4 years on separate continents.
    Again, it's not the waiting. I can wait. If this long separation has taught me anything, it's to be extremely patient.
    I am asking for advice not for criticism. I get enough negativity from people around me who do not understand anything nor care to understand anything about my visa journey.
    This is the only place I can find competent people with real world experience who can assist me with visa related questions. I am simply a woman desperate to be with the man I love so dearly.

    On another ANGRIER note. Its because of people like you doing like this that honest, real couples who are in love (aka me and my husband) have had to live in near poverty because the government makes such tight guidelines.

    How about this scenario. An illegal alien with a deadly and highly infectious disease doesn't go to the hospital due to the fear of being deported. How many US citizen would be affected by the policy you are suggesting?

    I think that despite the fact that some people have shown their obvious frustration in their posts. They have all been honest in trying to answer your questions. There really is no round about way of being with your spouse sooner rather then later, if you want this all done legally. My thought is, you now have many different answers to your question(s) so I would continue to research to see what your best options are... Like starting from scratch... Or hire an Immigration lawyer.
    I don't claim to know everything about all this immigration stuff. But I do know that if there was a round about way where we could all be with our loved ones SOONER, we would be on it like a hot damn. Correct me if I am wrong, but that's what it seems like is going on here is trying to find a way around all the TIME of not being together....? Legally we all must wait.... I haven't seen my husband for 7months. There are others on these forums who have gone A LOT longer than that.... It is what it is...

    The DS-230 is a general visa application form. Sometimes the person applying for the visa was petitioned by their parent, child, or sibling. These preference categories sometimes have waiting lists so there are options for spouses and children of those categories. That person may have a spouse or children who are joining them or following them later for example. They are asking about non-USC who are or will be immigrating.
    A USC is never immigrating to the US. If you do not have a non-USC child who is joining you now or who may be following you at a later date, the correct answer for both questions is NONE

    What happened to people being able to come to this forum and ask questions?! Regardless of them being hypothetical, or asked repeatedly, or even answered 1000 times over..... Or even asked in a different round about way?!
    If you don't have anything NICE to say then DON'T say anything at all....
    Quite frankly I am a little embarrassed at how mean some of these posts in this thread are....
    This kind of thread and the posts in it are one of the many reason I chose NOT to make threads or ask questions.... Because some people are SO MEAN

    But I would venture to guess that "they" ( the people you reference ) did not already try to AOS before.... I personally was married for 7 years before husband filed for GC and he came 3x a year VWP to visit.. And yes, he returned to Italy to complete the process in Italy, we did not AOS as i did not want to risk any bans.
    however, You are free to try for her to visit, but be ready with plan B. she is not longer able to AOS from the VWP, that ship has sailed already for you I am afraid and you missed your chance... File and wait it out, try to get her here for a visit (for 90 days, not to stay) and if successful, she goes back to her country to complete the process... That looks like ur only safe route at this point. Sorry if not the answer you want, but Best of luck with your journey

    You admit you have been shopping for answers because the correct one is the one you didn't want to hear. That frustrates me because I helped you from the very start with your AOS. I wish you had asked once your spouse left the country and we could have helped get you on the right track, by not withdrawing the I-130.
    People who visit with CR-1 pending didn't already try to AOS on the VWP.

    I think that for many of the senior members who have been here a while, after a lot of time answering seemingly the same questions it gets aggravating at some point... And some posters can be a little "thicker headed " than others... So people snap sometimes... Don't take anything too personally and take the consensus. But the OP should at this point have the general idea that they made an error and this will cost them time and money, but as long as they understand that at this point there is ABSOLUTELY NO MORE "grey" area and they must play by the rules, and by doing so, they should be able to complete the legal process... However visitation might be an issue. My suggestion would be for the OP to plan on spending some time in his spouses country if they want to pass the time together as VWP is a long shot.

    Not long at all. I emailed them on May 1st and had my appointment booked for the following week May 8th. They had originally booked me for May 7th, but that date did not work for me as I was coming from Vancouver Island, so I emailed them back and asked for the 8th and it wasn't a problem to change the date.

    This is a place to ask questions and to share a common ground, not tear a person down. I understand that you were trying to provide information, but there is absolutely no need for your comment. We are all in this together, this at times can be extremely trying; there is no reason to make a person feel worse.
