I contacted USCIS and they opened up a request to find out whats going on since its been more than 5 months and online shows 4 months processing, told me it will be completed in up to 30 days and gave me a long confirmation number. That was on June 20th, and havent heard anything. Im a bit worried since my congressmans office has been trying to find the file since June 3rd and still hasnt.....

UR not the only one, I sent my AOS on Dec, on March 23 my case was trasnfered to California but i havent heard from them either.

My case was sent to CSC on March 4th and havent heard anything regarding the AOS. Recv the EAD and AP the first week of april, and since then notta, nothing, zilch

Hello All, I am new to the forum and am also awaiting AOS after filing in January. Here is my timeline and progress:
1/14/11 receipt date for AOS package
2/16/11 biometrics
3/16/11 EAD card production ordered and received within a week
no interview date yet
case update not available online
called for update and was told that case is awaiting interview in NYC
You timeline is very close to mine, and our petition was received on the same day ... however we are still waiting...

Contact you local congressmans office, and have them contact NBC and pull the file showing the document.... We had an RFE for issue similar, stating the doctor didnt sign the document, our congressmans office had filed pulled, showed signature, and back to processing we went....

AP is now combined with the EAD - it's one card. They don't usually issue the card until you've had your biometrics appointment as they need the photo for the card.
Not Always --- We just recv a EAD card and seperate AP form I-512L--

Received notice last week that our case was transferred to CSC... Then just this morning I received notice that our case was transferred to "a USCIS center" ... Is this normal for processing/transferring?

I am about tired of dealing with this... Our rfe states that reason for the denial is it is certified more than one year from date. Our congressman office got in touch with National Records Center and was told the medical was in spanish and not signed by the doctor ( had nothing to do with the date) --- so then I contact the Embassy in San Jose Costa Rica and was told the doctors who perform medicals for them only use english forms, and if the forms were in spanish or not signed, they would not have accepted it, they would of had us go back to the doctor to obtain the correct forms and signature....

My Fiance already had her medical done for what USCIS has listed on the website for Tuberculosis,
Syphilis for applicants 15 years or older
HIV (blood test) etc.... the blood test were done already in her home country ( as i was there when they drew her blood and tested her), as it was a requirement for her visa. She also had her vaccinations and radiography. All these were part of the medical exam, approved by the US embassy.

****** update***** Recieved phone call from my Congressman's office ( Gus Bilirakis ) -- Apparently this is the most common RFE for visa's, and was informed that the I-693 is in fact the brown envelope and with the k-1 visas it is not even needed to send in an I-693 since it was already surrendered to CBP --- Was also informed that this is an issue being raised with USCIS and some upcoming hearing regarding these denials with general /vague meanings ... I remember reading something about this hearing on capitol hill, but cant find it....
I can suggest anyone with this RFE issue to contact their congressmans office!

You're technically supposed to be able to submit the DS-325 if adjusting from K-1. Most people err on the side of caution and pay $50-75ish to get the vaccinations part transcribed onto a I-693. So let's keep it simple, and try and figure out what's happened?
What date was the DS-3025 (medical before K-1 interview) completed? Dated 9/29/2010
Was the vaccination history marked as complete on the DS-3025? YES
Did you submit any proof of payment for the medical, clearly indicating the date of the transaction?
Did you get an I-693 as well? Surrendered to Border Patrol / Immigration at point of entry
If so, what was the date on the I-693? 9/29/2010
If so, did you send the DS-3025 and the I-693, or just the latter? Sent I-693 filled out with section 1 only, with copy os DS-3025

I read the dates differently, in that the DS-3025 or I-693 was completed in September 2010 and the AOS package was submitted in January 2011.
Correct -- her medical exam was dated 9/29/2010, and the I-485 was submitted Jan 2011 -- I have copy of radiography and vaccinations (ds-3025)both dated the same, as we took care of all the medical exams and vaccination in one day, I know I was there LOL -- the brown envelope (I-693) is surrendered to border patrol upon your arrival to the united states, and from there they are responsible for sending to DHS ..
I contacted my House Rep and I am awaiting response, but I also contacted immigration at orlando airport and was told by a supervisor there that everything is sent to a texas lockbox and has a tracking number assigned to it, and he is looking for the package and will contact me back.
The RFE is very vague, and doesnt tell you exactly what the problem is, and that in itself, is the problem....

If I am not mistaken, the fact that she had the exam less than a year ago at an approved doctor inside her country for use at the K1 interview, doesnt this reflect the exam that they speak of?

My ds-3025 is completed by the doctor, and is dated numerous times on it --the rfe states "you submitted form i-693, medical exam and vaccination record. However, the civil surgeon certified the exam more than 1 year before the date the applicant filed form I-485. the form must be dated within one year of filing form 1-485" === it was dated on 9/29/2010, and AOS filed on 1/21/2011 -- not sure why recv this RFE

Just recieved an RFE for medical/ vaccinations not being dated within one year of filing, even though it is clearly dated 5 different times on the documents 9/29/2010, well within the 1 year mark.... anyone else had a problem like this regarding?

Just put the address where she currently lives, even if it is 125 mtrs south of church, blah blah blah ...They will not send ANYTHING to your fiance in Costa Rica, once the packet is recv at embassy, they will call your fiance to come pick it up.... hope this helps!
all forms are sent to texas, they will send to appropriate svc center

Dont lose faith everyone.... if you look at the timelines in VJ, it shows that members of VJ are recieving noa2's from both service centers in november, and starting again in december... just remember that members of V.J. only make up 1% or less of the people who are filing petitions....
Everyday that passess is one day closer to recieving that NOA2!!!!...... keep that in mind.

FYI
I called the USCIS office on November 15 and they send inquiry on my case to Vermont Center. Yesterday i recevied the letter from them stating:
"Our review indicates that this case is actually within our current processing time. We are currently processing cases filed on June 22, 2010. We regret any misunderstanding. If you dont receive a decision or notice of other action within our current processing time, check our website for an update or call customer service at the number provided below..."
Letter is dated November 22, 2010 and it was mailed on 11/26/10.
I got only seven more days until 5 month is up....
Im afraid they may be blowing smoke up your #######, since the letter was generated on nov 22, and they gave you a processing of cases date of june 22 ---exactly 5 months-- I also say this since my NOA1 was june 25th, and my wife is already here and processing AOS -- I dont think there is a method to the madness of processing the cases --it seems like nowadays it almost like the lottery....

Just as an C.Y.A.... ask your lawyer if he has a copy of your divorce decree with the judges signature and stamp... There is a possiblity you may have been sent a copy of the divorce prior to judges signature, and it would be good to double check just in case, since a possible RFE will only delay the current loing and drawn out process...

Thanks! its funny, I just received a text and email stating her card is in production. It only took them 10 days to find our file... If you feel you are over any time limits, by all means call them, and/or get your congressmans office involved....Its the only way to get them moving
