    A pre-nup covers substantially more than what an affidavit does, including but not limited to pre-marital property.

    I am no longer married, applied for the i-751 with a divorce waiver. I don't anticipate ever coming back to the USA to live. Having the citizenship means I'll have to file taxes forever to the US gov, and pay taxes to the IRS in every deal I ever make in the future. Screw that

    It's easy to move back. I have dogs so I have to wait 180 days anyway. Booking flights 6 months in advance in easy and cheap (1k instead of 10k now). The main reason for giving up is that if I don't I'll have to pay capital gains to the US for the rest of my life. Screw that. I love america and the US is a great place to live, but is't not worth 20% of my capital gains for the rest of my life. Plus, australian beaches

    The very first thing some K visa holders including my wife  do  is get an SSN.  As we have noticed on the web site, some don’t. Some come to VJ after the mistake instead of before the mistake.  
     
    So I don’t presume OP’s son had an SSN and even if he did, I don’t presume USCIS utilized that SSN even if this SSN was provided in the I-485. 
     
    I am also getting weary of the incompetence of various agencies like USCIS, USPS, and State when it comes to handling immigration.  OP’s son paid substantial fees to USCIS.  The I-485 doesn’t say USCIS might handle the selective service registration it says it “will” register the beneficiary. Words have meaning. 
     
    So I stand by my advice.  There was no willful attempt to evade the military draft. In fact substantial money was paid to the US government to register and the US government apparently failed as it often does.  This is a breach of contract.

    Witha K the very first thing you get is a SSN.
     
    It  is his responsibility to ensure he registered.

    @sadgirloverseas go ahead,  book your ticket,  travel,  keep quiet. If you travel they won't send you back on the next flight.. most likely you'll have a hearing at the airport or locally.  Worst case scenario will be equal to the same and you'll be right where you are now.  
     
    When does the ROC card expire???
     
    Book it, Travel...  maybe they are nicer on Christmas eve?

    Actually I'm still a green card holder. Only a judge can take my green card away or I can surrender it.

    By the books I abandoned it, but in reality I can go back and take my chances. A CBP officer said it.

    Hello All, 
     
     I'm here to source some information on CSPA for a friend in need.   Her step-father, a U.S. Citizen, filed the full AOS packet and her priority date became a day before her 21st birthday.  USCIS correspondents all went to an address where they lived.  In 2017, at the time of their discovery, USCIS had already issued a letter. The notice of intent to deny letter was retrieved from the old address after the RFE timeframe. She also was outside of the timeframe in which an appeal could have been successfully filed as stated in the letter. 
     
    Now,  to help her, I would like to know if anyone with experience and knowledge can give some information since she is in limbo.  She is now 22 and would like to know if her case can be reopened or appealed through higher channels.  Also, to make things clear, USCIS did not make an error in her address that would have caused a delay. We know that if she should re-file, she will be in the F1 category due to age and new application and may be ineligible to file AOS due to being out of status.                                                                                                                                                                                                                                                                                                                                                                                                                                                                   Thank you and best regards!

    First,  bed sure to work with the Child Protection and Family Services Agency (CPFSA) as they are the only acency approved to take you though the adoption process.  The child must be able to be classified as an orphan and you must be a resident of the child's country.  Once final adoption is granted.. standard immigration processing would follow based on the (now) parent's legal status.

    I'm sorry that this happened to you however, quit overworking yourself.  They will resolve it very soon with the service ticket they have created. Unfortunately even with the best of technology in place, things like this will happen. 
     
    If it is indeed lost, unfortunately the process will be slowed down. You will be required to get a new passport so that the proper documents can be issued/tied to it.

    the only requirement is that you have MET them in person ONCE within 2 years.
     
    2 hours worth or 2 years worth, doesn't matter.
     
    However, as much as you may not want to hear it, meeting someone while on vacation and getting along smashingly does not mean you would make good spouses. Give it time to get to know each other under ALL circumstances. good, bad, emergencies, all of it. that takes time. no way would i marry someone only meeting them once or twice or even a dozen times.

    The fact that you're asking if it's too soon answers your question. Go for Christmas and have a good time. Would I get married to someone after 5 weeks facetime? No, I aint cray cray. People that use the K-1 to 'get to know' the spouse is ridiculous.
     
    Hopefully someone will chime in to confirm if it's a red flag.
