HI visa journey members finally my family got interview letter. Nvc schedule our four family members interview dated 2april, 6,9 14, with same priority date.

MY mom and my three uncle going to interviewed next months. My name is missing because my cspa age is over i already share with you.my age was over oct 2013
PD is 30may 2002.

First Welcome...."Always" the appropriate time to contact NVC is... "NOW"....Call them or Email them with the following details ....
1. Include Case Number, Petitioner Name, Address, and Birthdate.
2. Your Wife's Birth Certificate and Your Marriage Certificate.
3. Child's Birth certificate.
All documents shoud be with certified English translation if it is in a foreign language.
Till NVC confirms on the addition....Do not send in the I-864. Hold Off until your family details are added.

Happy to answer that for you... I had my son email me his birth certificate and biographic data page of his passport earlier. We also scheduled the police verification as soon as I knew his PD would be current in the next bulletin ( I think it has a 6-months validity) and that happened soon after we paid the fees. He received the certificate immediately which he emailed to me. Since I have to only submit copies of all these documents, that was easy with the info on my PC. Even the 2 photos (2"x2") were put up and I saved it in a flash drive and had them printed here. As soon as that was done I put all the documents together and sent via Fedex. They received it today, I tracked it. Now I just hope all my efforts are not wasted with the "DHS Shutdown". Hate Boehner & co for that...

I am here in US on H1B and I have also experience of filling 485 based on employer case. I have also family based F4 petition going on for me. Based on my experience of both employment and family based petitions, in your situation it is better for you to travel to India and appear for interview with your parents and get the green card.
If you do decide to go for 485 please hire an experience attorney. Do not try to do this on your own otherwise there is great chance you will mess up your green card. Considering the legal fees and dual processes (one for your parents and one for you) I would still advice you to follow the first path. Hope this helps.

Send an email to NVC stating that he wants to add his wife and children into the petition. Include scanned copy of marriage certificate, wife's and children's birth certificates.

Hi,
Did your brother ever informed the US government that he was married and had a child? No?
The NVC is processing the case for your brother only because he has not informed them that he is married and has a child.
Do not send in the I-864. Hold off until the wife and child can be added.
Your brother needs to inform USCIS about adding his wife and child as derivative beneficiaries. He writes a letter to the NVC;
1. Include case number, name, address, and birthday.
2. Wife's birth certificate and marriage certificate.
3. Child's birth certificate.
Everything with certified English translation if in a foreign language.

Do NOT worry. It will not be a problem at all.
Having green card doesn't mean, they want to cage and force you to live in US. This is true that GC is given for you to live in US, but they dont return you on your first flight. I have relatives, who came here on return ticket and went back and then came back again.
I'd only advise you to wait for the plastic GC card, if you can. Even if not, still it will not cause you any trouble as the I-551 stamp on your passport would be valid for one year.
Do not cancel your tickets or anything. You're good

Thanks Limenita22. Yes I have been tracking other cases so I had been preparing for at least 2-3 months now with my financial documents and within an hour of receiving the NVC email, I helped my son who is in India to fill out the form online. NVC was also quick with their response about letting us know about the payment of fees. So we have been lucky this far. Now let's see when they schedule his interview.

Too risky to mail the GC. If the relative can hand deliver it to you much better.
You're putting your LPR status at risk as well because you only stayed a few days in the US (considering that's your first time entry as an immigrant).
Based on my hubby's experience, we wanted to get married soon too but he opted to wait for his GC then open a bank account and get a driver's license first before flying back to the Philippines. Just to be on the safe side although he was only abroad for 3 weeks.

Do not fill out the DS-261 unless you receive the email. They have just streamlined their processes, but nothing moves unless the PD is about to become current. If the applicant's PD is current in the next bulletin, then NVC sends out emails between the 28th to 6th of the previous month.

At first you will see the petitioner name, and then when the name is not their anymore, it mean your COA is active and you can proceed to check that go to this link.

COA (DS261) is the first step without filling it you cant pay any fees. Just wait for ur COA and fill it once it turns up.
Ds261 is the choice of agent. It means you can appoint yourself as an agent and fill out your details in the form.
You can check ur status here: https://ceac.state.gov/IV/Login.aspx Enter ur case number and invoice id number and you are good to go.
If it states "Start your application" then you have received ur COA (DS261)

She said that there is no problem to travel as long as the main applicant goes first then the other ones.
About my experience was pretty fast and easy,
I was at the embassy around 7:10, the interview was scheduled by 7:30, We had to wait for like 40 mins before we got the call.
They said that me and my siblings were over 21 so they were going to check if we are eligible for CSPA, they made us wait for another 30 mins and they called us again that everything is OK and that we are eligible and made us fill some documents to not to marry until we arrive to the US.
After that they asked my mom some easy questions about her sister in the US, how long she was living there, why did she move there, in what VISA condition, when was the last time we visited them. She opened the medical exams took the papers and gave us back the MRI and then she made us wait for some more 30 mins...
After that we get to talk to the CO, she didnt ask much and she was very friendly, she had a partner next to her and she was like training him... so the conversation was very comfortable. She made us read some kind of oath and then fingerprints, the only question made was if we know we had to sign for the military service and then she said that all our papers are in order and that we are getting the VISA. She cancelled my tourist VISA and then ... that's all.... pretty quick and simple like 15 mins only. After that my dad asked the questions I told you and then.... we left happy

Sorry to hear. But do not worry. You are protected by the law. Yes, there was a law signed in the end of 2009 that allows a beneficiary of an I-140 or I-130 to continue eligibility if the primary beneficiary (or the petitioner in case of I-130) dies. Your friends family should be fine. They probably just need a consultation. Why not speak to a good immigration lawyer. They charge nominal $300 for consultation I believe. Also the petitioner can hire a free of cost legal aid which is provided by USCIS to pursue this case. I know exactly what you have been going through. Way back many years ago our file was denied in 1989 when my uncle got expired. At that time they did not have any protection to principal beneficiary or petitioner. We fought a case but the plea was turned down as at that time the files were getting current faster. No one anticipated the concept of retrogression will come due to IT boom those years.
But now law has been enacted. Please read excerpts from the below case.
