I hope everyone is doing well.
We are applying for a B2 visa at the Beijing Embassy for my father-in-law. Seems like the required supporting documentation is much less than what it was when I applied for my wife nearly 10 years ago. Can someone tell me their recommended list of Supporting Documents that my father-in-law should take to the B2 interview in Beijing?

Now that yer wife is a USA Citizen, tell her that she can file for her mom, the I-130, culminating in a IR-5 visa. Can start prepping the package tonight - and tell Mom that she needs new civil documents for the DS-230.
Good Luck ! Leaving tomorrow without an AP document in hand - well, she'll turn in her I-94, and eventually, USCIS will get wind of it - and they'll note that since she left? She's abandoned her pursuit of the AOS process.
To come back, she'll need another visa - suggest the IR-5 this time.
My wife filed I-130 for my mother in law's I-485 AOS. Will this have any negative impact on my wife if my mother in law abandons the I-130/I-485 that my wife submitted?

it depends, how long has she been in the US? has her i94 expired, has she overstayed? please explain her situation in the US.
Yes, her I-94 has expired. We filed for AOS prior to its expiration. I thought that they would stamp her I-94 when they did her biometrics but they didn't.

Hi everyone! We applied for my mother in law's AOS back in November. We got the letter from USCIS quickly and her biometrics were done within just a few weeks. Much faster than my wife's experience! But since then we have not received an appointment or heard any update, other than the fact her case was transferred to CSC.
Unfortunately my brother in law back in China has some health problems and my mother in law must return to help him. Are we hopeless in this situation and must abandon her AOS package? Please let me know our options. She wants to leave on Friday.

Well some time has passed since I asked about this. My MIL went back on time on her first visa. Now she has been back for several months on a second visitor visa. We are preparing to adjust her status because some unforeseen circumstances arose in China that makes it impractical for her to return.
I am completing the forms and had a couple questions.
1) On G-325A it asks for occupation. She has been a housewife her entire life. Should I put HOUSEWIFE or NONE? I guess NONE is easier because then I don't have to worry about dates and such.
2)On I-485 it asks for current USCIS status. Is that VISITOR?
3)On I-485 it asks "were you inspected by a US Immigration Officer?" What do they mean by inspected? She obviously went thru immigration and got an I-94. Does that constitute "inspection by a US Immigration Officer"?
4) I don't believe she has an A-number yet because she has only applied for visitor visas. If she does have one, where would I find it?
5) On I-485 instructions it mentions "Criminal History" as initial evidence. My MIL has no criminal history. Do we need to put anything in the cover letter addressing that she has no criminal history? Or can we just submit nothing for that part?
6) My wife is submitting the application as the sponsor. Is there additional evidence to prove relationship that we should submit in addition to the birth certificate which shows both names?

Happy Holidays! We are pleased to announce that as of December 25, 2010 the fees for drop-off visa renewal services will be significantly reduced – to 100 RMB for student visa applicants applying for F and M visas and senior citizens who are 70 and above, and 120 RMB for all others. Drop-off renewal is the easiest, fastest, best way to renew your visa because you don't have to wait for an appointment or stand in line! Drop-box applications are processed with the same priority as walk-in applications. NO interview is required and applicants do NOT have to make an appointment or wait in line at the U.S. Embassy or Consulates! As of January 1, 2011, it will be MANDATORY for all drop-box eligible applicants to use that avenue to apply. This move is being made to improve services for all applicants.

China now requires that B2 visa renewals be sent through CITIC bank. Is there a way to set it up so that I can pick up my visa from the Beijing embassy if I submit through CITIC bank? Normally when you go for an interview they give the option to pick it up if it is granted. However, since there may be no interview with the new renewal process, I am wondering how to specify that I would like to pick it up at the embassy? Any ideas? Thanks.

What status is your wife, LPR, Citizen or some other VISA? That will determine if you are eligible to apply for a green card for your wife's mother
Don't let her stay past her expiration because depending on your status, she might be barred from re-entry for from 3-10 years. And there is also going to be a question of if she entered on a non-immigrant VISA with the intent to immigrate.
At least check with someone on this

My mother-in-law came here on a B2 visitor visa earlier this year. On her visa was stamped "No Extension or Change of Status". Is this always stamped on non-immigration visas now? Or was this specifically done on hers for some reason?
If it says "no extension or change of status on my visa, can we still apply for a green card for my mother-in-law? What are chances of approval?

Good news. Wife passed the interview on March 1. Her oath ceremony is April 7.
A couple of questions about things we need to take.
1) It says bring "Reentry permit or Refugee Travel Document". What is that?
2) It says bring "Any immigration documents you may have". Seriously? We have hundreds of papers all the way back to I-129 application. What do you suggest we take?

1) Is there anything we can do, despite the fact that it looks like we are out of luck?
2) Do all B1/B2 visas say "No Extensions or Change of Status"? Or was it done specifically in our case?

I am USC and my wife is LPR (with a pending N-400 citizenship interview). We invited my mother-in-law to come for a visit from China. She applied for a B1/B2 visa and received it. She cannot read English so we didn't know how long the visa was for. Based on other people's comments we assumed that it would be a 6-month family visa. Therefore, we purchased a round-trip ticket with a return trip about 6 months after her arrival.
She just arrived yesterday and we noticed that she was granted a 3-month family visa. The visa says "No Extensions or Change of Status".
My questions:
1) Is there anything we can do, despite the fact that it looks like we are out of luck?
2) Do all B1/B2 visas say "No Extensions or Change of Status"? Or was it done specifically in our case?

Good news: We got an interview letter for my wife's N-400 application, the date is set for Feb. 2
Bad news: Our baby's due date is Feb. 4
There is a good possibility the baby will be delivered right around the interview date and I would hate to cancel at the last minute. The letter says if we need to reschedule we can return the letter to local office and include an explanation why we need another appointment.
My questions:
1) Have others done this before?
2) What do you suggest we do?
3) Is there any chance of getting an earlier interview?

My mother-in-law was fortunate enough to get a visa to come visit us after the new year. However, she speaks nor reads English. I am worried about her ability to make her connecting flight in Newark. She is flying from Beijing to Houston, via Newark.
Has anyone written a letter to be presented at the airport so perhaps someone can help her? Any other ideas?

NARocks, my wife just filed N400. Our thinking was we would submit AOS for MIL toward end of her 6 month stay. However, if wife doesn't become USC we will just let MIL return to China and file for immigrant visa.

Has you spouse already gotten her citizen ship? I do not see this in your time line.What will happen is they may question your intent as far as your MIL as they Do with some who AOS from a tourist visa. Just be prepared to answer questions honestly. Hopefully the plan was not to adjust the first time she has been here on the B2 visa.
No as far as the criminal check this will be done through the USCI during the AOS stage no certificate needed

I read the links. That was my point, it seems if you adjust from B2 you never go through NVC processing. Hence no police certificate is required. Do you agree?

The I-130 instructions rarely reference the NVC processing stage.The Police Certificate is required at NVC Processing Stage.

Darnell, Appreciate your feedback. I can't find anything in the I-130 or I-485 instructions that indicate criminal check is required for filing those forms.
I do agree it may be required if she were applying for an immigrant visa. However, she already has a B2 visa in hand. After she obtained the visa and my wife came back to US, we decided that it would be good for her to stay for a couple of years while the children are young. Hence we are pursuing adjustment of status from B2 visa.
My wife will apply for my mother-in-law's AOS once she becomes a citizen. We have already submitted N400. Here is situation so you are clearer on scenarios:
Me (son in law) - USC
Wife (daughter) - LPR that has filed N400 to become USC
Mom (mom) - Chinese citizen with B2 visa
Do you see anything in I-130 or I-485 that indicates a police check is required if we AOS from a B2 visa? Are there any forms other than I-130 and I-485 that must be submitted to AOS from a B2 visa? I understand those forms require other stuff, i.e., affadavit of support, G325A, etc.

No, I don't agree about the criminal check.It's part of the I-130 set, but it's collected during NVC processing.

I can't say whether or not you'll be successful with the AOS whilst she's here on a tourist visa, or NOT. Usually, it's for a recently-married foreign spouse, and the onus is on the USC spouse to prove up that the foreign national did NOT come into the USA to be married.
It's a category of visa fraud, but I'm not the expert about it - others here hopefully might chime in.
If the mother's child is already a USC, it is infinitely easier to file an I-130 (solely ) petition , granting an IR-5 visa, whilst Mum is still in China. There's not waiting for a visa number, things usually fly through USCIS and NVC if it's for a parent.
I guess I'm confused, though - is Mum Chinese or Japanese?
Yer wife has a greencard date of 2006-06-17 - so she qualifies to file for Citizenship, today. I'd suggest she file for citizenship, then once she receives it, file the I-130 for Mum (whilst Mum is still overseas ). This route nullifies any hint of visa fraud, in its entirety.
