I just sent in the 3 checks for an AOS of a K1 Visa, and had the work visa check for $380 (form I-765) sent back. I have no clue why. The form states
"Recently you submitted an application for immigration benefits. That form was submitted with an extra remittance that is not required to process your application. Your check is being returned to you with this notice. Not additional action by you is required at this time.
Please be sure to complete the application fully, submit the appropriate fees, and include all supporting documentation."
Seems contradictory.
Under 'Notice Type', at the top , it says "Rejection Notice"

I waited over a month before I finally called them. When I did the woman told me that it wasent normal to wait that long and she gave me an email address to the lockbox. She told me that they had prob misplaced it and that I should email them and request that they look into it.
Why she couldnt do it is beyond me....but I emailed and about a week later they finally cashed the check.
I would say call, it cant hurt, the worst that can happen is that they tell you to wait longer.
I wish I had called 2 weeks earlier.

I sent in my AOS packet to USCIS a few weeks ago by certified mail, so I know it arrived. However, they have not cashed my check or sent me a Notice of Action yet. About how long should I expect to wait before hearing from them ?

I'm wondering if I need to use the non-immigrant or immigrant visa portal to set up an interview at the Manila embassy. I know K visas are non-immigrant, however I've heard you set up the interview through the immigrant portal.

I totally agree. It's just a typo graphical error.
I called NVC and they confirmed it's going to Manila.

Is this a misprint ? Our interview should be at the Manila Embassy but my NOA2 says ANILA.

That's what I would do. For one thing, your finance can physically go to the Embassy if necessary. Just my two cents.

The US plays political games with some visas, partly depending on what party is in power. People from Haiti are poor but guess what, so are a lot of other people in the world. Same with Cuba, there's many other places with much worse political persecution. This is why many other Latinos don't identify too much with Cuban immigration policy which says you are OK as long as you touch land. Given what is going on in Northern Mexico, many of those could easily qualify for refugee status, bot of course they are called illegals.
Have one set of rules for everyone.

Can't speak for anyone else, but my fiance's country isn't exactly the lap of luxury.That's the problem with picking winners in the immigration policy; it should be who is next in line.

The government has the right to deny a visa based upon an interview or evidence. They do not have a right to stick your file in a box for 6 months for unexplained reasons. People are mad at arbitrary and unexplained delays in the process. The matter at hand is the lack of transparency.

If we had a bank account in her name in the US with the amount of the poverty line, would that be enough to meet the requirements of the sponsor thing, or does it have to be an actual income, showing that is what she earns in a year. So if we had say 20k (or whatever the amount is for the poverty line 25k i think) in a savings account would that meet the requirements of the sponsor part although she doesnt make 20k a year.
Also when working out the poverty line, do i need to include myself in the family number, think i do but just want to make sure
Typically it needs to be income. It's a bit fuzzy, but just having $20,000 in the bank isn't enough. For one thing, sponsorship entails a three year commitment. However, the $20,000 could cover part of the minimum income, and I have heard different figures - one lawyer said assets could count up to %30 of the minimum income requirements. Of course if you have like 100 K in a bank you probably won't have any problems.
All in all, they are mostly looking for a steady income stream, either through a pension or a job.

I notice some folks on the forums mention their petition was touched. When I plug my ID number into the USCIS website it only has Acceptance, Initial Review, Decision, Post-Decision..nothing about ongoing actions or being 'touched'. I am on the Initial Review phase, have received first notice. Is there anything else to look at to see if my petition has been 'touched' ? Thanks.
