    All of this only matters in the Philippines and The Vatican. Those would be the only places on earth that don’t allow divorce. There is no reason for annulment or recognition of divorce unless you wanted to marry another Filipino. CFO would be the stumbling block. There are “helpers” that issue Sharia divorces so the law states that the Sharia divorce requires a Nikah (Muslim wedding). So many were trying to convert the divorce that the government clamped down. There are a lot of people paying serious money for Sharia divorce and it ends up not recognized so they need the annulment anyway. We are talking hundreds who paid the helpers but got nothing. Some pay over ₽200k for the non-help. $5k and you have to get an annulment anyway would suck.

    What would be helpful is developing petitions to police the USCIS through congressional laws 
     
     
    as well as ideas about how it could be improved - for example ;
     
    Online databases of information to be verified rather than making people pay ridiculous fees to print out documents to send from one department to another…

    CFO is a nightmare these days, one lady in my fiance's class had a PSA certificate of marriage but they wouldn't accept it as evidence unless she brought the receipt she got when she paid for it...
     
    where is that requirement posted for all to see?

    How are you getting in?  Tourism is still closed and you have to be married to get the visa. They don’t really ask for proof. Basically you have to physically be together after the wedding. 
     
    Getting married there is a little complicated and takes 3 weeks if you are very organized. Expect to be there a month to get everything done.

    The I-130 instructions say who can't file, so it's not a gray area as far as USCIS is concerned --
     
    "You may NOT file Form I-130 for a person in the following categories:
    [...]
    4.  A spouse, if you and your spouse were not both physically present at the marriage ceremony, unless the marriage was consummated;"
     
    And as the USCIS field manual said, consummation of a marriage can only occur after the ceremony.

    But  that doesn't say when they can file and consummation after the wedding will retroactively make them a "spouse" so once consummated, they would be legally a spouse no matter when they file as long as it is after the wedding...  This is a very gray area.  So they are not "spouse", "wife" or "husband" until consummated but consummation after the wedding will retroactively make them a spouse, wife or husband, at the date of the wedding.  LOL  I love governmentese...

    Yes, that was part of the CFO pitch, plus they also talked about making pinays sex slaves and physically abusing them. I tried to actually enter the class and tried to play dumb, but that didn't work. I walked down the street to Shakeys Pizza and ate while my gf attended.
     
    Around 2000 CFO was pitching the girls to make sure they remitted money back to Philippines Social Security once they started working in the USA.  
     
    But at the time St Marys was known as the easier of the two, they had PRISM on Taft which had the reputation as being the difficult one that would seek out the weak, shy, and the ones whom lacked confidence and exploit them.

    Exactly right. Very jealous of those attending.   And believe it or not, it used to be much worse with the spouses and fiances being made to cry because it was run by nazi nuns who asked a lot questions well beyond their business. My wife was sent home to get docs that weren't on the list and then sent home again for more stuff.  BS.

    I expect both USCIS and the embassy will verify dates on the evidence of consummation.  As long as the dates are before filing and after the wedding, they should be fine.
     
    The significance of that provision in the DOS FAM is in determining the length of the marriage at visa issuance.  Hopefully your son's case won't take too long, but if they are not so lucky and can only get an interview late 2023, the case should be upgraded to non-conditional F2A based on the Utah marriage date, not the date on the evidence of consummation.

    Use the name on the birth certificate when filling most forms.  They usually specify current name or name at birth.  The US and Utah dont care about middle names like they do in the Philippines.  Our middle names are given and that was one of my biggest challenges when I got married in Manila, but that is another story.  We used the birth certificate name for filling out the information except where it asked for current name.  We filed the I-130 for my step son's wife a few days ago.  I will update on their journey as needed. ROM is next.  We are just waiting on Passports for the mother and child.

    ROM is a Philippine government thing.  The Philippines does not require consummation. USCIS, NVC and the Embassy don't need the ROM at all.  For a Utah online marriage they want to see a certified copy of the Utah marriage certificate and proof you were together during OR after the wedding.

    they do not connect to the databases that are used by the CIA, NSA, FBI. And require you to communicate between agencies for them.

    as for the USCIS, the CATO institute did a study which said that COVID was not a valid excuse for the present situation - not that the wait times were acceptable before COVID
     
    any institution without legal requirements to perform and without competition 
     
    will likely be as slow and painful as the USCIS 
     
    The wait times cause harm to families and individuals… and the processes need to be completely spelled out and transparent so that they can’t be abused by agents due to their emotional whims

    I would be much more expensive and take longer to send it from Philippines. Jusy have all of your things in order then send it off when you get back to the US.
    I would send them both when you get back to US. I know when I got married in the PH I needed the PSA marriage certificate (equivalent of a ROM) in order to file CR1. Since you will technically be married in USA I don't believe that you need the ROM prior to filing CR1.
     
    @John & Rose is very knowledgeable on Utah weddings (I believe his son did it) hopefully he will chime in. The topic that John started and @Dashinka shared above should have all of the info you need. Just make sure you know all of the requirement for ROM and CR1 and get everything prepared in advance. That way you can send it all in after you return.
