    Hi Alexa,
    I am in MA, my fiance in DR and we filed in late October and received our NOA2 4/30. I think they must sort applications by beneficiary's country and the petitioner's state. The MA/DR combo seems to be very slow. There is another user here and we have very similar timelines. She's from MA too. Anyway, I would call USCIS all the time and they just kept saying we had to wait, there was a severe backlog and they were saying it was taking 6 months instead of the typical 5. Fill out the service request ASAP. It's just an online inquiry in to why it's taking so long. Or have your fiance ask to submit a service request since it is out of the normal processing time frame. I also contacted Congressman Lynch. The woman I spoke with at his office was very very helpful. I was approved the day after I spoke with her, so she didn't even get a chance to contact them about my case before I was approved. But I am sure she would have helped if there was anything she could have done. You are past the processing time, don't let them take their time. Remember, you don't waste anything by doing the things mentioned here.

    I am concerned more for your anxiety level than how your fiancé's interview went.
    I mentioned in one of your earlier posts this week that it is essential to try and minimize the stress and anxiety through your visa experience. I too suffer severe anxiety, which comes hand in hand with depression and sometimes OCD. My OCD was obsessing over situations in my mind and wildly exaggerating them. This causes anxiety, which caused depression. Its a vicious circle. And I see so many signs reading all your posts that you display a lot of these symptoms also.
    I would recommend discussing your anxiety and how you manage your thought processes with a doctor, who may recommend CBT (cognitive behavioral therapy), or some written exercise which will help you understand your pattern of thinking a bit more clearly.
    Even with what looks to be a successful interview you are seeking the worst possible outcome and whipping yourself up in to a frenzy. This all points to anxiety and a little mixture of maybe OCD and depression.
    Take deep breathes, realize how far you and your fiancé have come in this journey and look forward to his imminent arrival in America.
    But more importantly, look after yourself and seek help for your anxiety.

    The good thing about you being such a worrier is that if we ever get a similar London filer we can point them to your (many) threads.
    Relax, and stop worrying about every small step of the Visa, this process must be even more unpleasant for you than it is for the rest of us.

    I agree... Quit being such a Debbie downer... I heard of glass held full or half empty, but you seem not just to be a glass half empty person... But a glass half empty and broken at the top and the sharp edges likely to cut you and you would bleed to death because you were unable to dial 911 with your bloody stump of fingers so you might as well never bother to drink from a glass again regardless of how full or empty... Sheesh...
    Just sit back, let them do their process and wait for the passport with the visa. No need to microanalyze ... Celebrate for one moment that your fiancé did good... Tell him he did well, give him some positivity that is what a spouse does, supports through positive encouragement... Give it a try...

    Also, if you were my friend or my sister, I would strongly recommend you try to find someone to help you find strategies to deal with your anxiety; you can't live like that and make yourself miserable...

    Ugh. Why do you have to make things so difficult and stressful for yourself? At your point in the process, I was off my tits that the interview had gone well and I was approved, and just kept checking my CEAC every day until it said "Issued". Once it got there, also again very happy, went through at POE with no issues at all. The horror stories are not common. I get the feeling you're a very pessimistic person; you always look for the negative in everything, even his interview that went well. You also said about giving up when you thought he'd failed the medical. Stop being so negative and just look forward to him coming to be with you.

    It took my friend 5 months before she received her approval from USCIS and it's taking more than a month for NVC. to assign a case #. You just started the process. Take a deep breath and calm down.

    In some very limited circumstances, you can stay int eh US and get a greencard via marriage if you are already there (say, on a work visa).

    Is your GC valided for 2 years or 10 years?
    If it is 2 years, then you need to fill out I-751 to remove conditions.
    If it is 10 years, you might be able to apply for US Citizenship depending on the visa that you were entered to US. If you are not eligible to apply for US Citizenship, then you need to fill out I-90.
    It seems to me that you have 2 years GC.

    As for the IRS letter... it's exactly what I thought it was. It's a letter asking you to explain why your SS# came up in 2 different returns, with 2 different filing statuses.
    Respond to the letter. You can call the 800 number and one of the options is something like "If you received a letter from the IRS, press X" That's what you need to do. Or if there's a local IRS office near by, you can go in person.
    You should NOT file an Injured Spouse form (IRS form 8379) since the MFJ filing was illegal/forged. Treat it as if it never happened. By filing that form, you are acknowledging the joint return filing. Make sure you follow through with the IRS regarding the fraudulent MFJ filing by your husband.
    As long as you're at it, you may want to report his tax fraud (writing off equipment he buys for personal use and for family as a business expense). Since you probably have no proof, nothing will happen to him, but at least they will make him sweat at little.

    Yes they do..im the beneciary and i called too. Just provide them with your case number and complete name and date of birth on both petioner and beneficiary.

    Use the new name, include a certified copy of the court order changing her name, new green card will have the new name. And of course all the other stuff required. Hubby did the same thing and by changing it when you remove conditions it saves you some money.

    The rule is clear: the beneficiary can adjust status only through marriage to the original petitioner, and otherwise must leave the U.S. or accrue overstay. The beneficiary is welcome to consult an attorney. These answers have been stated multiple times. Because the thread has begun to degenerate into bickering and name-calling, it is being locked. This thread is not to be restarted, and its drama is not to be carried into other threads. The OP is welcome to return later in a new thread to provide an objective update to the situation, if desired.

    Sworn affidavits in an I-751 are generally used to shore-up a weak application; they are secondary evidence at best. Feel free to include 1-2, but if you're submitting a lot of primary evidence then they won't really do anything for you. OTOH, if you feel your application is a little on the weak side then by all means include some.

    Here is what i have:
    Two sworn affirmation by U.S. citizen friends, attesting to our relationship and marriage.
    Copy of our taxes for 2012 and 2013
    Copies of statements from our joint checking account
    Copy of savings account showing a joint account.
    Document from my company of the designation of her life insurance to my husband
    Copies mortgage statements of our home, showing joint ownership.
    Copy of the sewer bill of our home, showing joint ownership
    Copy of our health insurance cards showing a joint policy.
    Copies of envelopes of mail we have received as a couple, Christmas, anniversary, birthday and thank you cards
    Pictures of us, along with family members, including our friends who completed the aforementioned affirmations
    Thoughts?

    Seems pretty strong.
    I believe the instructions also call for copies of your primary IDs for the two of you (usually state ID cards or driver's licences).
    (Edit) Can't actually seem to find that in the instructions anywhere, but I recall seeing people RFE'd for not including it, so I would certainly do that.

    If he did file a tax return using your social security number without your permission, you can also file a police report for identity theft. I would not hesitate to do that.
    Also, don't contact him any more for any reason. He's feeding off your reactions to his behavior and continuing to at least verbally and mentally abuse you (and perhaps also financially). Don't let him.

    If it was me I would go home.
    She has been here a few months, it's more like a long vacation.
    There is no solution. The K-1 is designed specifically to prevent someone who doesn't marry to not be able to stay here. Because there is no reason to stay. A lot of people have friends and family in the US, but they don't live here.
    It is hard to break up, but the K-1 is not a ticket the US. Things will go back to the way they were, with her living abroad.
    I am helping them by making them realize in plain language that there is no way for her to stay here legally.

    I suppose you're right. It's still weird to me that people intentionally put themselves in the position of this process and actively seek people in other countries.
    I found someone in another country, but that was pure chance and good fortune.

    Wedding announcements, invitations
    Church certificate
    Wedding pictures
    Joint bank account letter (when opened and balance) and recent statements
    Joint credit card statement - including receipts from charges made by both of you
    Evidence of joint life and cohabitation: monthly bills, insurance, assets etc.
    A deed showing co-ownership of your property or a lease agreement with both of your names on the lease
    Receipts of money transfer (if applicable)
    Phone bills showing your conversations
    Receipts of gifts sent online or otherwise
    Transcripts of IM chats or Skype calls
    Copies of letters and/or e-mails
    Copies of holiday cards addressed to you both
    Birth certificate of any child that has been born to your marriage
    Airline ticket receipts showing trips taken together or to visit each other -- including boarding passes
    Copies of the passport stamps from any visits to your spouse's country
    Pictures of you together on vacation and/or with family and friends. It's best to include a range of times, not just a bunch of photos from a short period of time
