    Hello fellow VJers!

    I came here to give an update and let you know that I was approved yesterday!  
     
    My interview was scheduled for 10:10am in the Lawrence, MA office. I arrived 10 minutes before my appointment, checked in and sat in the waiting area for 20 minutes until an officer called my name and led me to an interview room.
     
    First he asked me to stand and raise my right hand.  He then asked "Do you solemnly swear that you will tell the truth, the whole truth, and nothing but the truth, under pains and penalties of perjury"? After I said "I do" and got sworn in, he asked me to sit down and provide him with my passport and green card.
     
    We then moved on to the test questions:
     
    - What ocean is on the East Coast of the United States?
    - Name one branch or part of the government
    - If the President can no longer serve, who becomes President?
    - Who did the United States fight in World War II?
    - What is an amendment?
    - Why did the colonists fight the British?
     
    Next came the reading and writing test. He asked me to read a sentence off the tablet:  "Where is the White House?" 
    And then I was asked to write on the tablet: "The White House is in Washington, D.C."
     
    He asked me about when I arrived in the US, how I met my husband, how many kids I had, how often I get to see my family in Brazil etc... in a very conversational way. He even asked about how Brazil is handling the COVID-19 situation and if I was happy that the US borders are now re-opening for Brazilian visitors. He asked what I did for a living, and when I mentioned that I work with cancer research he wanted to know if we had any recent breakthroughs  
     
    We then went through the application and the Yes/No questions. When he asked about ever being cited by a police officer, I mentioned that I had a speeding ticket from 10+ years ago that wasn't included in my N-400 application (I had forgotten about it). He said it was not an issue, asked me if I had paid the fine and then moved on the next questions.
     
    He asked if I had paid my yearly taxes, but didn't ask to see my tax returns or any of the other documents that I had with me.
     
    He was extremely friendly! The whole interview was done in less than 15 minutes.
     
    He said I was approved, and then told me to wait in the reception area for a same-day oath ceremony. The waiting took a while, but I was out of there by 12pm!

    Logged on to my account this morning and interview has been scheduled for November 16th at the Charlotte Field Office.   So excited!!  I was checking my account every hour since 7am this morning because my husband and daughter got their interviews scheduled yesterday for November 15th.   Our applications all went in on the same day, March 19th 2021 and our biometrics were all reused the same day.   Now on to the civics questions!!

    Exactly this. History is full of stories of royal families inbreeding with close relatives and the genetic defects in children born from these unions. That's why there are laws against it now.
     
    Comparing first cousin marriages to same sex marriages is just comparing apples to oranges.

    This is a legal question, for cousins the law varies by US state as others have posted.  In some states it is not only prohibited, it is a crime.  The closer the blood relationship, the more DNA the partners have in common.  There is medical research on the higher risk of genetic abnormalities for children born of first cousin parents.  From Wikipedia:  "Children of first-cousin marriages have an increased risk of autosomal recessive genetic disorders, and this risk is higher in populations that are already highly ethnically similar."  This medical risk is no doubt one of the factors considered when passing or repealing such laws.  The history of making cousin and other close relative marriages illegal goes back to ancient Rome, where they based the legality of a marriage on degrees of consanguinity.  Cousin marriage was seen as a form of incest.  So the reasons are moral and ethical, as well as legal.

    Not the same at all.  Same sex marriages are legal in all 50 states due to the supreme court ruling.  There has not been anything like that for cousin marriages.
     
    A better argument would be: if cousin marriages are allowed, why not marriages between other close relatives?  Siblings?  Parent/child?
     
    And if you came here to argue about the laws, then you're barking up the wrong tree.  The laws are what they are.  If a person's culture dictates that they can or should marry a first cousin, and their eligibility to immigrate is based on that marriage, then they need to find a place to live where it is legal.  Full stop.

    No, because the person standing in for you signs their name, not yours. That's not state by state, even with POA you don't sign another persons name, you sign your name FOR the individual. So I'd sign Jess for Lucky Cat.

    My journey is finally over. Had my interview and same day oath ceremony at the San Jose, CA office today.

    I just got an update saying my interview is scheduled and they mailed me a notice.
     
    I am looking in the document section however I dont see any document update yet to know the date but the case updated that my interview is scheduled

    Applying for paper work for a marriage based green card means adjustment of status.  The US customs officer asked him if a) he was considering moving to the US  and b) if he was considering adjusting his status based upon marriage to a US citizen to become a Permanent Resident - aka 'getting a green card'.  He told the Customs Officer at the Airport 'yes' to both questions.  The Customs Officer then said he could not be allowed to enter the US as he had presumed immigrant intent, and as such, had to file for and obtain the proper visa - a CR-1 (marriage based) visa - before he could be allowed back into the US. It is very straight-forward and happens far, far too often.  Canadians often forget that the US is a foreign country and that Canadians are 'foreigners' just like everyone else and are subject to the same rules and regulations.
     
    USCIS does not care if you make a mistake; it does not care if your intentions were different than you said they were; it does not even care if you misunderstood what they were asking.  This conversation and the results of this conversation are now a record on the file of the OP.  Any time he tries to cross the border in the future, this information will come up.  If he changes his story from this information, USCIS will believe in the 'worst' interpretation of his intent, and they will have no compunctions about enacting the appropriate consequences.

    You're not OP, you're playing roulette with OP's status.  Right now they've gotten a strong mark against them.  Maybe they can convince the next agent of the things you say, maybe they get a 5-year ban.  50/50 right?  What have you got to lose?

    This is immigration fraud.  The OP has already said he plans to Adjust Status and has been denied entry.  He has moved his whole life down to the US and is basically living there.  To tell immigration that he is not planning to adjust status and is just visiting is lying to immigration and will result in being denied entry, possible detention at the border, or a ban, either minimum of 5 years or a lifetime ban.  If the OP succeeds in entering the US after lying to immigration, if they don't catch him right away and put him in detention in preparation for trial and deportation (and you DON'T want to go into any of the ICE facilities), it will come back to haunt him on one of the many different petitions he and his spouse will need to file over the next few years for him to live and work in the US, and during any future petition for citizenship.  One lie haunts you forever and there is no statute of limitations. 
     
    Mistakes happen through ignorance of the law, which is the situation in which the OP now finds himself.  It isn't an excuse nor will it hold any weight with immigration.  They do not care.  What the OP needs to remember is that you don't mess around with US immigration because you do not want the consequences, especially if you are married to an American citizen and want to spend a happy life together.  It may be long and tedious and involved, but going through the proper immigration process - his spouse filing an I-130 and working on a CR-1 visa - is the only way he is going to get back into the US and it is not likely to be any time soon.

    Yes, it's certain you're in the system.  

    If you try to visit in a month, you will be forced to buy a return ticket home and you will listed as a repeat offender trying to enter the US and it will make it worse for you.  You will likely be deported with a 5 years ban.  This means you would be denied a spousal visa after waiting 12-18 months and you would need a waiver for your deportation - yeah, so making your situation way worse.  You might not get the waiver.  DON'T EVEN TRY THIS.
     
    You have to look at this from CBP's point of view.  You spent over a 100 days living and working in the US without proper authorization.  Essentially, you were an illegal immigrant.  You have been flagged as such.  Trying to enter again without a visa would be a BIG MISTAKE because you will be deported with a 5 years ban.
     
    Your chances of a B-2 visitor visa are zero.
     
    Either your wife files for a spousal visa which will take 12-18 months or she moves to Canada.  She can visit you.  Your days of visiting her are over.
