    IMHO, you should ROC with waiver, and get your 10 years Green Card first.
    You ex could still help you by writing a letter stating marriage was in good faith but did not work out.
    From your previous topics, your ex sounds crazy and was threatening you, kicking you out of the house.
    You never know if she is trying to manipulating you now.
    You should wait and see her true color before rushing to remarry her again.

    I agree that OP and her USC should have in depth communication before moving forward with the visa process.

    Sorry about your bad situation.
    Nothing you can do about her immigration, she already has her green card (presumably a 2 year conditional one).
    You can divorce her and she will be on her own for ROC (I-751).
    Find a better girl next time but remember to get to know her well first.

    A prenuptial agreement is not only protecting your fiance. It can also protect your interests in the event of divorce, or death.
    You can add your terms in the prenuptial agreement as well, like stating what you are entitled to, during divorce/death.
    Don't take it too negatively. It hurts feelings when the topic is first brought up.
    Keep an open mind, be honest and frank in your discussions with your fiance.

    USD 30,000 dowry is reasonable if the fiancee is super model or OP is Chen Guang Biao Why should OP bankrupt himself so that she could satisfy her materialistic behavior (someone who has NO savings, living paycheck from paycheck). That USD 30,000 is better off as savings for rainy days or down payment for a new house. I found this bold statement a red flag.
    What else does she has to contribute in the relationship, if OP is going to be sole income earner in the future?
    She seems to be looking for safe harbor so that she does not have to work hard in life.
    OP should just call her bluff. Thanks her for the good time together, wish her the best.
    If she truly values her relationship with OP, she would reach a compromise with OP.

    Options
    1) Find a co-sponsor who will meet the financial requirements
    2) Stop School, work full-time to meet the financial requirements. Then resume school once the immigrant spouse obtains green card.
    3) Delay the immigration process until you graduate and get a job to fulfill the financial requirements.
    You have to decide which bitter pill you want to take

    Yep,  Do not ever be alone with her anymore, in case of any false domestic violence claim.
    As you should know by now, she is probably staging a VAWA case against you by calling the cops on you (Oh she is so scared of you, might served you with restraining order as well).
     
    Not sure if you can prevent her from coming back to your house since it is considered marital home. You should consult your divorce attorney for further advice.
     
    Another thing, once she figures out she can't get her green card without you (K1 holder has to AOS with the original USC petitioner), she might have a 'change of heart' trying to reconcile with you.

    The guy might have a 9C ban which requires him to serve 10 years outside US -> non-waiver able.
    Their lawyers could be guilty of selling them false hope to stay in US.

    3. Merit based Visa System and eliminating the visa lottery.
    4. Requirements for birth citizenship: 1 US Citizen parent
    5.  Dreamers - give the LPR status with no path to citizenship. They shouldnt be blamed for their parents illegal actions nor should they be rewarded.
    6. No AOS
     
    A common sense plan for immigration - though sure the open boarder proponents will scream bloody murder.
