    There really is little evidence required. The only "proof" of our relationship that we submitted with N400 was our past 3 years tax transcripts. That's it!
    I NEVER wanted to be a US citizen but things change. My mom is still on F-1 visa and cannot get another job to petition her H1B (even though she is more than qualified and the last job offer for such was moot because her lawyer pretty much used her) so I'm doing it to file for her because it'd be selfish of me not to help while she struggles to make ends meet after residing in the states all this time.

    He was charged with domestic violence, he is in removal proceedings, he wants to lie to Immigration, you are dating just two months, girl you should think ten times before getting married to someone so messy.
    I doubt his AOS will be approved,since the Law prohibits aliens in removal proceeding to adjust status, unless the removal is terminated or an "exemption is submitted and approved,and the chance to have the AOS approved is almost non existent.
    Today I was contacted by someone that had last week the AOS denied ,because her husband got married when in removal proceedings.Here is part of the denial,and I saw many decisions like this one here.This couple is married 5 years.
    "A review of your file revealed that you married xxxx , while you were in deportation, exclusion, removal, or judicial proceedings. Therefore, the petition is deniable under section 2 04(g) of the Act unless proceedings have been terminated, or you request a bona fide marriage exemption and demonstrate through clear and convincing evidence that your marriage was entered into in good faith and not to circumvent immigration laws. Section 245(e) of the Act provides:Restriction on adjustment of status based on marriages entered while in admissibility or deportation proceedings; bona fide marriage exception. - ( 1) Except as provided in paragraph (3), an alien who is seeking to receive an immigrant visa on the basis of a marriage which was entered into during the period described in paragraph (2) may not have the alien's status adjusted under subsection (a). (2) The period described in this paragraph is the period during which administrative or judicial proceedings are pending regarding the alien's right to be admitted or remain in the United States. (3) Paragraph (I) and section 204(g) shall not apply with respect to a marriage if the alien establishes by clear and convincing evidence to the satisfaction of the that the marriage was entered into in good faith and in accordance with the laws of the place where the marriage took place and the marriage was not entered into for the purpose of procuring the ·alien's admission as an immigrant.

    She was denied because she has a daughter in the US, who is qualified for US citizenship.
    The CO meant that you should just petition for your mother. The CO instinctively "thinks" that you want your mom to help you take care of your baby therefore have "immigrant intent" that could lead to using the B1/B2 to "adjust status" in the US.
    Very typical scenario for the Philippines.
    Just looking at it from the CO's point of view.

    Where I come from, and, yes, it's been a while, Travel Health Insurance cost about $11 annually, and covers absolutely everything short of a ####### job. No tourist in their right mind would travel to a foreign continent without it, and if a knocked-up woman ready to pop does this, it cannot be explained by reason alone.

    If your boyfriend can't get a visa to the US, and you don't want to go the commitment visa route, why not meet somewhere in the middle, where visa requirements are less stringent? There are plenty of other countries in South America that would make a nice holiday point and would be building evidence that you are both committed enough to the relationship to travel for each other.

    The most important thing is to keep all the evidence of your meeting for the future application. Think carefully about which of you has the more "portable" career or income generating business and decide where you want to set up home accordingly.

    On the subject of an immigration lawyer - you seem like a very literate woman and you've mentioned that there aren't any problematic behaviours in your boyfriend's past (drugs, criminality) so you should be fine to complete the forms and compile the evidence yourself. 1. it's cheaper 2. you maintain control over the process at all times 3. why pay someone to fill in the forms that they have to ask you all the information for? Seems like a no-brainer.

    She views it as "manipulation" in the sense that they wanted to simply visit on a tourist visa. Now since that is denied they have to consider marriage and fiance visas to get the guy into the US.
    It's influencing their relationship in a way they wouldn't have considered had they allowed him a visit.
    I agree that he should have been honest up front and declared he was visiting GF (although I'm sure that would have been denied also)

    I say the two of you get naked in a hot tub/jacuzzi for the weekend and have a long talk about this.
    If you don't want to do that, then print out a big stack of resumes in USA format,
    and go in to his work one day.
    Once you're out of the car, apply at his jobsite.
    Then walk around the rest of the day, dropping off resumes at the companies around his jobsite, and filling out applications.
    If'n yer hired at any company along your walking path, that's a plus! He doesn't have to drive extra, out of his way, to get you to work and you can start squirreling away yer own monies ...

    Id suggest a bit of counselling, possibly?! There seems to be things you guys are not properly communicating about to each other and probably a mediator is a good way to resolve this.
    Id also suggest finding ANY job that you are eligible for; like retail. Although not ideal, this could be a "breather" for him to see you contributing. I understand that he initially was fine with you being unemployed but obviously this has changed. Id say try to get a part time gig even if its barely enough for you to have your own spending money.

    This depends entirely on whether you want to keep living in the US or not. If you want to keep living in the US, file for divorce ASAP. Once your divorce is final, filed for removal of conditions with a divorce waiver. As long as you have evidence that your marriage was entered into in good faith, your conditions will be lifted and you'll have the 10 year green card. Your green card is not pegged to your marriage, it's based on whether the marriage was in good faith when entered into.The key to filing ROC is that you file before the expiration date of your 2 year green card. If you're filing with a divorce waiver, you can file at any time before that date, as long as your divorce is final.
    The bottom line is there are only two ways of filing to lift conditions, either jointly, or with a waiver. Unless your spouse is dead or abusive, the only waiver applicable is a divorce waiver, which requires you to be divorced.
    If you want to abandon your green card, simply travel home. Abandon your green card at the nearest US embassy or consulate. This will have no effect on any future travel or visits to the US.
    If you want to apply for a visa again in the future, here is what the CO will see: 1. Jeremy married an American and moved to the US to be with her. 2. Jeremy and American's marriage did not work out. 3. Jeremy voluntarily moved back home..... Nothing illegal, nothing suspicious, no problem.

    A deity is a God. It doesn't discriminate against which God you're praying to or what religion you're a part of, whereas the term God does. it's not an insult to use the term deity. There is nothing wrong with someone having faith, but blind faith is of course a problem. Have you never heard the saying "God helps those who help themselves"? You need to actually put in effort. People pray and hope for stuff to happen, sit around waiting for it, and then when it doesn't happen, say "well it wasn't God's will"... instead of thinking that God would have directed them down a path, or to a person, or to find a way... People actually need to do the work themselves and believe, if they believe, that God will work THROUGH them and help them. God can't open a door if you don't reach out and turn the handle, but he can help you.

    Dropping a coffee cup is a mistake. Having an adulterous affair that results in a child is a cold calculated decision and choice
    that will have consequences. There is difference between a little mistake and ongoing betrayal.
    I do deserve another coffee cup if I drop one or two......but to abuse someone emotionally with betrayal does not "deserve"
    another chance with that partner.
    That deserves some life changes and integrity pursuing.
    Enablers stopping enabling the one who manipulates and betrays....that is what is deserved.

    OP... Sorry but you will not be able to stay legally... But in some ways I understand and have sympathy for someone not wanting to go back right away... The immigrant spent all this time, money and energy mentally preparing themselves for a life in a new country. All your friends and family have wished you luck. You have said goodbyes and literally closed the door on your old life to start a new one... Suddenly WHAM... You have to give up this dream that you have sp mentally prepared yourself and your family for and are now expected to go home with your tail between your legs, having to hear many of the naysayers at home say "see... we told you so".. It can be pretty devastating and so difficult to do. Like giving up a dream before it even starts... like a failure. Mentally these immigrants are prepared to start their new lives and have so much faith in their significant others, just to have it not work out... I admire all the immigrants who give up their lives and country for a love one and I wish them all the best. Stay strong and reclaim your life back home.

    Well I feel bad for the CO, he was stuck in AP for a whole year and in the meantime his fiance was busy falling in love somewhere else... She should have been honest and saved him the trouble of coming so far just to be sent back.

    Hmm one thing that makes me wonder - i have seen posts like this before, when ppl dont want to get married any more and they are super sad. Your only concern is to stay, not the fact that your girl does not want you anymore? If this was me, i would be more about fixing it with the person, less about staying. Maybe that's what she feels and doesn't want to add more time to this. So start with trying it instead of looking for ways to stay.
    And please don't overstay if you don't solve it. You'll only destroy if for everyone, including yourself, who tried to do this legal

    Have your transcript evaluated by the World Education Service. They are accepted by most Universities and Employers. That is the ONLY way you'll get the answer your are looking for, the rest is speculation

    Interview APPROVED!!!!
    After 1 hour of interview i was finally approved!!! i was schedule for 8:30 at Royal palm beach , FL, but i got there at 8am and because the 8 oclock person never showed they called me in. He asked me to sit down got my application and started to review everything, ask me to rise my right hand , then started to check all the dates that i was out of country, he asked me how long i was working for usgovernment overseas in Brazil. he went to uscis website to do a search on my name to make sure the dates i was out matched with my application, after checking everything he asked me to sign the paper with the days i was out that he printed out off the website, and told me that my time still ok. asked me to confirm every single question on my application, he was really nice all the time, before he asked me the question for test he asked me if i would have to travel back to us for the oath cerimony and i told him i will really appreciate if i can get oath before i go back to work next tueday, he said let me see what i can do and started to ask question. first ws writting test and he gave the question(WHICH STATE HAS THE MOST PEOPLE) and the a anwser i had to write California has the most people. then the question:
    1_ there are four amendments to the constitution about who can vote. describe one of them
    2_ who is in charge of the executive branch
    3_what is one right or freedom from the first amendment
    4_ if the president can no longer serve, who becomes president
    5_What is one reason colonist came to america
    6_during the cold war, what was the main concern of the united states
    I got was 6 right so he said let me see what i can do to have u schedule before u leave. told me to wait out side after 40 minutes supervisor came and we went to his office to do the oath, after oath he gave me my certificatesaid congratulations and gave me direction to go get my passport before i leave the country, he also took my green card. Everything was great, very professional, i because a citizenin less then 2 hours i was there, it was wonderful. Royal palm beach was the best experience ever, could ask for more

    Hello Godswillon73 sorry to hear of your denial. Let me break this down to you.
    First what is done is done. You should have never cancelled your first petition. Now you have no way of knowing why you were denied. About everybody who is denied gets the generic "didn't convince CO of Bonafide relationship". That can mean a million things. Here a list just to name a few.
    1. Didn't have traditional marriage
    2. Chats and emails very generic
    3. USC women is older than immigrant past child bearing years
    4. USC women is divorced with children from previous relationships
    5. Not enough face time (visits)
    6. Visits short in duration
    7. Lack of pictures with friends and family
    This is Nigeria did you by chance front-load your petition? Meaning putting your evidence upfront submitted with your I-130 petition. Or did your husband bring the bulk of evidence to interview hoping to hand over to CO?
    With a denial your case would have been sent back to USCIS and you would either have been reaffirmed (meaning USCIS says they back up the approval and send your petition back to embassy) or
    You would have got a NOIR or NOID which would have addressed each of the denial points the CO listed (like what I said above) and you would have had to address each item with evidence, send back to USCIS and got re-approved and sent back to embassy.
    Most get this done within a year from denial. But now refiling you have put yourself back in the bucket to be denied again if you didn't address what they denied you for . So this is a through the kitchen sink at them time. I pray you front-loaded.
    And unfortunately you have to realize in fact I will just let the words of USCIS tell you what happens after a denied interview about evidence submission so hope you didn't submit anything that happened after interview.
    "USCIS is aware that the type of evidence to establish the bona fides of a marital relationship can be somewhat limited when one spouse lives in the US and the other lives overseas.
    However the burden is on the petitioner to provide evidence that gives insight into that nature of their claimed relationship and the level of their emotional involvement, as a bona fide marital relationship is one that involves a fusion of two individual’s lives.
    Such involvement in their lives together would be expected for a married couple who intend to spend the foreseeable future together.
    Further, any submitted evidence must give insight into the claimed relationship during the premarital courtship stage, the marital stage before the visa interview, and the marital stage after the visa interview. Merely submitting documentary evidence from the period of time after the visa interview will not be deemed sufficient, as the temptation exists to create the appearance of a relationship as the result of a refused visa"
    You cancelled all that now you have no idea so we have to play guessing game.
    my thoughts to you is look through this list of evidence to consider. For Nigeria however leave out any Money transfers (western union, money gram, bank transfers). Just not a good idea going in or coming out.
    Bonafide Evidence suggestions
    1. Evidence of Communication Before and After Marriage
    Phone bills showing who called whom Letters Greeting cards Chat logs Emails / PM’s Delivery receipts (of gifts you send each other) 2. Evidence of Visits / Vacations / Meeting in Person
    Boarding passes Passport stamps Hotel receipts with both your names Vacation / honeymoon photos Receipts or bank statements showing remote ATM withdrawals (to show you were pulling money from that location at such time) 3. Evidence of Co-habitation During Marriage
    Birth certificates of any children born to you together Mortgage loan contract or lease contract with both partners’ names in it Utility bills with both partners’ names Receipts with both partners’ names in shipping/billing address Pictures of you two living together 4. Evidence of Joint Ownership of Assets and Shared Financial Responsibility
    Joint bank account statements Proof of joint credit card use Money transfer receipts Western Union or Money Gram NOPE don't do it! Power of Attorney Wills (never used this) Utility bills Life insurance policy showing spouse as beneficiary Health insurance Car insurance 5. Photographic Evidence
    Photos of you two together Photos of you two with family (such as wedding, parties, kids’ graduation, etc.) Photos of you two in various locations and times 6. Evidence from Others in Support of Bona Fide Marriage
    Sworn affidavits of friends and/or family Letters/cards from friends and/or family
