    We are doing a K1 fiance visa so I don't know if it's the same for your K3, but the packet 3 instructions from the consulate say you must have sole custody OR a notarized letter from the other parent. My fiancee has sole custody and sole guardianship so, the way the instructions read, we won't need the letter. This will be decided at the interview at the consulate. We'll see.....
