  1. I submitted the AOS on Sept 21, 2010.

    I received the AOS I-485 interview date of Dec 17, 2010. Then on Dec 10th, I received a interview cancellation letter basically as follows:

    Notice of Deschedule

    Your I-485 application appointment scheduled for December 17, 2010

    Please do not appear on the above scheduled date.

    You will be notified in writing of a new interview date at such time when a new date becomes available.

    San Jose citizenship and immigration services.

    Anybody else receive this type of letter? Just wondering if it is a good sign that we don't have to do the interview.

  2. I did the K-1 while working and living entirely abroad in China. The only down side was that I had to depend on my parents for the mail. They just scanned and emailed to me.

    In my opinion, I would recommend using your US address, or someone you trust (that won't move). Your parents sound trustworthy enough. Just make sure they have a scanner/email since that would be faster than snail mail.

    Answer to question 2-

    So you are being taxed in China? Then you can go to the local tax bureau in your city to get a 'wan shui zheng ming' which is your tax history statement. Another thing to think about, you should also be reporting your China sourced income when you file your taxes. That would show up on your tax transcripts from the IRS.

    Answer to question 3-

    I wouldn't mention an end date if it doesn't ask and I don't think it asks.

    From my experience, filing the K-1 while living abroad or in the US doesn't seem to make that big of a difference. With exception that you can get a hold of the required documents (birth cert, financial statements, taxes, etc).

    I am a US citizen and my fiance is Indian. He is currently in India but I just started a one year contract working in China and I'd like to start applying for the fiance visa while I'm here.

    My questions are:

    1. On the affidavit of support I-134 should I put my residence as my US address or should I use my current address in China? (I don't want any documents mailed directly to me in China. I want them first sent to my parents' home and then I'll have my parents send them to me here in China)

    2. Will there be an issue with my income coming from my job in China? I can show tax receipts from China but not from the US.

    3. For the I-134 do I have to mention that my contract in China is only for year, after which I don't have a job lined up?

    I will need my parent's to co-sponsor my fiance as I won't have enough saved to sponsor him on my own. I realize that my parent's can show that they have enough to support him but I want to make sure I fill out my own I-134 correctly.

    Has anyone else applied for the K1 visa while not in the US? What troubles did you face by not being in the US at the time of applying?

    Any help or advice would be greatly appreciated!

  3. I just want to make sure that this topic is still correct.

    I am petitioning for my fiance (K-1 visa) and filled out the I-134 affidavit of support. I am also having my mom fill out the I-134 affidavit of support as a co-sponsor. Both my mom and I will be submitting the bank statement, IRS transcripts, employment verification letters, etc. I just want to clarify that my mom should not fill out the I-864. Arguing with my mom:( I thought I saw something on the USCIS website stating this, but now I can't find it.

  4. I am on the 'packet 3' step of the K-1 visa and in the process of helping my fiance on the DS230. I have a question about question #34 Previous Military Service.

    About 4 years ago when she was a 3rd year college student, she was required to attend military training as required by the government for all university students. This lasted for about 2 months and they learned to sing songs, training, etc.

    Should this be included in that question? Thanks for everybody's input.

    I am glad to see your post because I am at the same step as you. I received the letter stating that the packet will be sent to my fiance in China. Now just waiting and nicely reminding her to check her mailbox since mail is not often delivered to "mailboxes" in China.

    Also, I was just curious and do not mean any harm. I see your profile that it lists DPRK (north Korea) as your fiance's country. That is the first time I've seen a fiance from DPRK on this website. Have you been there before? What was the process for a US citizen to visit there? It is not one of the countries on the top of my list to visit but I really would like to visit sometime in the future. At least before any regime changes.

    Well the ceremony (unofficial) may still be held since it may only be at a restaurant with family. I don't think that would interfere with anything. But I will take everyone's advice and not do the official marriage through the government. Basically, the only reason why I want to do it is for the extra vacation days from work so I can get some sun on the Thailand beaches. But that doesn't seem to be worth the hassle and possible trouble for the future.

    Now will just sit and wait for the K-1 application approval.

  7. Happy Chinese New Year all,

    I recently applied for the K-1 visa (Jan 30, 2010). As I am currently living and working in China with my girlfriend, we are planning to have a wedding ceremony here in China with her family.

    I assume that having a wedding ceremony will not affect the visa application but what if we get married officially by the Chinese government? The reason I am thinking about getting officially married through the Chinese government is because I am eligible for 2 weeks off work and would like to take a much needed vacation.
