    Woohoo, who doesn't like to spend more money! Congratulation JlovesA. Wow another texas filer approved. I guess they're running faster than the VJ stats are showing. Well my case status has never updated, I guess I just have to take Texas on their word.

    SeaTurtis, it sounds like you are a bit confused about the process.
    Typically the petition is the part that takes 5-6 months. It takes a few more months after that to go through NVC, the embassy, and to receive the visa.
    There is only one visa you can apply for your wife, and it's CR-1 (or IR-1 if you've been married more than 2 years). You filed an I-130 petition which is the correct thing to do.
    If you were applying via DCF as JFH mentioned, it can be much quicker, but it doesn't sound like you live overseas with your spouse so it's not an option.
    Unfortunately it's just how the cookie crumbles!

    I'll repeat what was said before when you asked about time scales a few weeks back.
    Every case is different. Those who live overseas with their spouse in certain countries (e.g the UK) can file locally and the process is much quicker. Military spouses are also processed quicker. People from the Philippines are often processed quicker due to a policy that was put in place following the big typhoon. Some people request an expedite for health reasons - I personally know someone whose case was rushed through because the US citizen was about to have a liver transplant. There have been claims of cases being expedited due to pregnancy.
    The reason the answers vary is that this forum is made up of people from all over the world. Each couple is different so each case is different. It's like asking a doctor how long it will take you to recover from an illness. Everyone will be different. And in the hospital there will be people with the same illness but recovering at different speeds. It's the same here.
    All we can do is give your own personal experiences. We are not saying your situation will be the same. We present the facts of our cases in our timelines. How you interpret the information and relate it to your situation is up to you.

    But who are you to make that determination of someone's relationship being real or 'just for a green card'?
    See my K1 timeline? See how long that took? I can guarantee there are plenty of K1 couples that took even longer. For no understandable reason beyond the claim of 'backlog'. It wasn't due to background checks, or problematic cases, or poor paperwork, or even lost paperwork. It was due to the stupidity of the USCIS process. K1s don't go in front of you, they get processed by a completely different service center and undergo different methods. It may be frustrating that those persons may through whatever hardships they face in their own process get to be with their loved ones before you, but I assure you it is no less frustrating for them. A DCF is going to get through even faster, is their relationship less valid and should be slower?
    As a K1 we proved our relationship was real and genuine. The length of time we had known and been in a relationship with each other was vastly longer than probably the average couple, but this makes little difference to me. How do you define the love that someone has for each other based on the length of time you have known them? I cannot judge someone like that.
    Did it make me upset to see so many K1s get 'finished' months and months before mine? Sure, but I wasn't going to begrudge them their happiness or question the validity of their relationship. Did it make me further annoyed that despite all the lobbying, that when action was taken to rectify the processing times, it only helped those already at the front of the pack instead of those stuck in the back? Oh absolutely, but there is nothing you can do about it. Someone is always going to go in front of you.
    Do I agree it's a horrible and lengthy unfair process? Yes. But you're pointing fingers at the wrong place.
    And remember just because my spouse is now in the US with me, and you are still waiting, doesn't mean that we aren't still bloody waiting. There is no end in sight to the wait we're now enduring for AOS, a process you won't have to go through at all. We all want our loved ones here, and it's a shame how this process is... but it's not their fault. We've only the government to thank for it.

    You should have received your receipt notice from Nebraska by now. You should call USCIS to find out what the receipt number is, as it will allow you to track the petition online (well, it'll tell you when anything major happens).

    What your boyfriend does is not relevant to anything.
    What do you that you can just take 6 months off? Do you have a job?
    Either way it looks like you have no good ties to your home country, which is a big reason to refuse you entry.
    VWP is used for visiting - not living which is basically what you want to do.

    You asked for advice. You got it. It wasn't what you wanted to hear. Doesn't mean the advice is wrong.
    I work very hard for my plane tickets. I do overtime. It's my absolute priority. I don't even have a car and I rent a small place in order to spend more time with my husband. You could do that too, just depends how badly you want it. If you can afford to be out of work for six months, you can afford a few plane tickets.

    Someone who is not even willing to support removal of your conditions is not worth staying married to. The foundation of marriage is not slavery and threats.

    So to confirm the best way to do this would be to obtain a K visa once she has divorced and naturalized. This cannot be done before she becomes a citizen or it is not advised?
    A part of the requirement for the fiance petition approval is prove you are a U.S. Citizen and submit any divorce decrees. Without that, it will be denied.
    Travel to the US on the VWP in the interim and adhere to the 90 days length of stay period.

    I gather obtaining a K visa can take between 2- 12 months currently in the UK with all the correct paperwork, i cannot travel to the US within in this period, is this correct?
    The petition part yes, but there's the visa application and processing in the UK that is about 2.5 months minimum. There are many parts to the process. You can travel. .
    Once the K visa has been obtained i can stay in the US and adjust status my status once we are married.
    Only of you marry within 90 days of coming on a K1.
    Anything else?

    This is not complex at all. This is rather simple.
    You can not extend your 90 days on the VWP. That's one of the condition of using the VWP; no extensions.
    You don't need a visa if you are already in the US. Visas are for entering the US.
    Only a USC can file for a fiance. Green card holders can not file for a fiance.
    You can not wait in the US to process for your visa.
    Your girl is getting divorced in March. She hasn't file for naturalization which could take a year.
    There is only one choice until she becomes a USC. Once her divorce is finalized, you two can get marry and start the immigration process. It will take 1-2 years. She can upgrade the case when she becomes a USC.
    There is no path that will get you into the US this year to immigrate. You are looking at end of 2017 or 2018.

    I haven't spent much time on these forums in years but I work as a support assistant in a law enforcement agency that deals with these sorts of things (I'm not going to specifically name it because I don't like being findable in google searches). I can tell you a few things almost with full certainty:
    The USA more than likely does not know anything about this.
    This is what's known in the "biz" as a "no case seizure." Your drugs were taken from you, you paid a fine, it's over. You may be searched or have a bit of difficulty returning to Canada the next few times, but you don't have a criminal record of course (I think you said you realized that). Any kind of flag is on CBSA's system and that's it.
    I don't think there is anything you can appeal...maybe the fine? But I doubt it. You admitted you brought a prohibited substance into Canada. You learned your lesson, don't do it again, yada yada. I wouldn't worry TOO much about this.

    Just to clarify, it's not illegal to come to the USA with the intent to marry; it's illegal to come with the intent to STAY if you don't have a visa. You can get married anywhere you want, as long as you leave afterwards.

    It all depends on the detachment how they handle record checks/police certificates. Some detachments get so many police certificate requests that it's just more feasible for them to do them one day a week instead of all the time, everyday. That's how I did it at the first detachment I worked at (as you can tell, I work for an RCMP detachment in Ontario).
    I forgot to mention that fingerprints are a different story...we will still do them if required, just not the police certificate.

    At the end of November (the last month for which statistics have been published) pending applications included:
    449,823 I-130 petitions
    402,035 I-485 petitions
    179,840 I-765 employment authorizations
    202,881 I-90 green card renewal/replacement applications
    73,599 I-129 petitions
    70,121 I-131 travel document applications
    45,708 I-821 TPS applications
    Do the math yourself. TPS applications were 3.2% of the total pending applications for immigration benefits (not including applications for naturalization). This doesn't include a variety of other applications USCIS processes. Only applications for immigration benefits. Even if TPS applications had grown from nearly 0% to the November total of 3.2%, that would not explain the sudden increase in processing times. It simply is not enough to make that much of a difference.
    As I said, the PDF was a statement by the director to the Congressional committee that controls his budget. What's more, the statement was made last March - 10 months ago. The numbers I provided were from a USCIS report from November. Draw your conclusions from real statistics, and not speeches given by government bureaucrats to other government bureaucrats.

    You know, I didn't really look at the website for the first couple months either. Luckily for you, that's when your petition was approved. Those of us nearing or past the five month mark have a right to be frustrated and curious as to the state of the petition.
    While I agree with the majority of your post and that there is a lot that needs to be prepared for and this is a good time to do it, I disagree with anyone judging someone or telling people to find something better to do with their time in regards to the website. Easy to say when your application was so quickly approved.
