  1. Hi Everyone,

My husband got a notice in February saying his green card was approved and that they were mailing it within 30 days. Well, 30 days came and went and we never received it. It got lost in the mail (probably somewhere in our apartment building) and they are saying that he has to file again (using an I-90 form) and pay the fee of $450 again. This seems crazy to me because his AOS was already approved, he just needs a new card printed. Does anyone have any advice? I sent a letter to our congressman's office today to see if they can help. We have followed every step exactly as we were supposed to. We can't possibly have to reapply and pay again.

    Thanks for any advice,

    J

  2. My fiance will want to be able to leave the US while his AOS is pending so that when he gets a job he is able to travel internationally if necessary (very important for his work). Is it ok if he does not know exactly where he will travel to when he fills out the I-131 Advance Parole form?

    Thanks!

  3. Hi everyone,

My fiance has his interview in 3 weeks and in the packet it says he needs his old passports. He has travelled a lot in his life and does not have his old passports any more. Will this be a problem? Is there something we can present instead? Have a lot of people been asked for this?

Thanks for any information you can give!

    J

  4. Ok, so getting a co-sponsor may be the best way to go, which shouldn't be a problem. So I will do that. And I will have my 2009 taxes and a letter explaining why I didn't file in 2007 or 2008 (citing the line in the tax code that explains). Then I will also have a letter from my current employer and from my bank where I have some savings.

I could also bring older tax returns that show about 4 years of steady employment and income.

If we have all of this, does it sound like it should be ok?

  5. Ok, but I didn't file in 2008 because I was a student making now money. At the beginning of the year I got a small stipend when I was working in Costa Rica. But, my earned money (we're talking only hundreds of dollars here) was below the amount necessary to file. I suppose I should get an accountant to find the line in the IRS tax code that explains this and have it available if necessary? Wow, what a pain.

  6. Hi everyone,

I have sent in the i-129f form and am awaiting my noa2 (we are filing for K1, my fiance is British). For the next round of paperwork I know I need to send in proof of financial stability. So, I have a job (that I started in September) that is over 2 times the poverty rate and I have some money in savings. So, I can send proof of all of that from my employer and my bank. However, for the last few years (since 2006) I have been mostly out of the country working for a couple of years making a small stipend and then last year was in school in England. So, I haven't filed my taxes since I think 2005. So, my qeustion is, do I HAVE to show tax information for the last 3 years? Or will they be happy with this year and with my job and savings.

    Thanks!

  7. Well, I am going to visit him but I can't take that much time off of work so we would like for him to visit me, too. If he has a copy of the NOA1 and a letter from his employer in case they ask anything, should that be enough? When he came in over Christmas he had no problems at all (and we had send the i-129f in November). I don't think they even really asked him any questions...was through really fast.

    Any other thoughts?

  8. I have a question,

My fiance is from the UK and I am a USC. We filed an i-129f in November 2009. We would like to visit each other as much as possible during this process. He visited me in December for Christmas. We are hoping he can visit again in March/April. Are there an limitations on how much we can visit one another while we are waiting for the k1visa? We are hoping his interview will be around May/June time.

Thanks for any help you can give!

  9. That might be a good option. What I didn't want to do is get married in a courthouse then have a wedding several months or a year later. But, an option could be to get married in a US state then have a wedding in the USVI. It would be nice if it could all be in one, but I don't want it to delay any of the next steps. Not sure yet what we'll do, but thanks for the heads up!

  10. Ok, just to clarify, yes we have filed the I-129f and he will be here on a K1 Visa. We want to get married on a beach or on an island. So, we were thinking the US Virgin Islands might be really nice. We would fly directly there, not go outside US waters and not got the the British VI. If we do get married in the USVI, will there be any problems in the future, like when he applies for residency? Thanks for any help!!
