    Exactly what @Chancy said. The visa is not based on his residency, is based on his nationality. 
    Even for other countries the wait is not lesser that 10 years.

    In general, it depends on the applicant's country of birth.  Even if your brother acquires Canadian (or any other) citizenship in the future, the F4 visa wait time for India will still apply in his case.

    The visa bulletin link above shows that it does vary by Country.
     
    Where he works is irrelevant.

    Hi guys.... I have my AOS interview on the 21st of May and I am getting stuff together for the interview. I would really appreciate if you guys can take a look at the evidence and documents I am carrying and let me know if I'm missing anything... Thanks in advance and wish us luck... I'm pretty nervous ...
    1. Photocopies of everything that was submitted as a part of the AOS packet (all the forms and supporting docs)
    2. All original documents
    a. Both of our passports
    b. Both of our birth certificates
    c. Both of our SS cards (including my new SS card with my married name on it)
    d. All of my H1B petition approvals (different employers/expiration dates)
    e. All of my I-94 cards (one original I received the last time I entered US, all I-94's that come as a part of the visa petition approval page)
    f. Our original certified marriage certificate
    3. My husband's and my tax transcripts from years 2006 - 2009 (We've filed taxes separately so far but will file as a married couple for 2010 (got married in Feb 2010)).
    4. Letters from both our employers attesting to our employment status. Pay statements for last 3 months for both of us.
    5. Account statements for three bank accounts where we both are on the account. Lease papers showing both our names on them.
    6. Itineraries of all trips we've been to as a couple (one trip after marriage and 2 before)
    7. Copies of personal and casual emails between his family and me (kids birthday discussions, general discussions etc.)
    8. Emails around our (him, me and all of his immediate family) planned trip to India later this year, for a traditional ceremony and sightseeing. I will also include our e-tickets and our sightseeing schedule as discussed in emails.
    9. Around 30 pictures of our wedding in Vegas with his parents. About 15 pictures of his family and me after the wedding and during Easter this
    year. Will also include a family pic that was sent out to relatives for Christmas.
    10. All cards that we gave each other and that his brother, sister, nieces and his parents gave us or me for different occasions.
    Question - Should I still include an affidavit from his parents or his brother vouching that we have a bonafide marriage? I feel like the email
    communications, cards and pictures should be proof enough. What do you think?
    Also, I don't have any id in my married name yet. Will that be a problem? Should I still apply for one, so I have something to show?
