    Hi. As has been said, the I-864 is the one you need to "worry" about, but it sounds like you're needing to reassure a co-sponsor about the I-134 at this stage. Is that correct?
    The I-134 is only in play for the time until AOS, when the I-864 replaces it--so just a few months. All signs point to the I-134 as not legally binding. I have yet to find a completely clear and irreproachable way to show this, but here's how I explained it to my co-sponsor:
    The I-134 is not a binding contract, but a piece of evidence used at the embassy stage to indicate to the consular officer that the sponsor will be able to secure the "real" affidavit of support at the AOS stage. It is not a required form even at the consular/embassy phase, but most consulates use it as a piece of the information they consider in making their decision. It reassures them you have the capacity to get the job done later, when it counts.
    From a practical standpoint, even if the I-134 were binding, it's still impossible for a sponsor or co-sponsor to be liable during the time it is "active," because the beneficiary would have to apply for public assistance during that time, and he or she is not yet an immigrant and therefore not eligible for such benefits until the Adjustment of Status, at which time the I-134 is dissolved. When a K1 first enters the country, they are still a non-immigrant. Non-immigrants don't qualify for benefits. Receiving benefits is the privilege of immigrants and citizens.
    So co-sponsors should rest easy over the I-134. As for the I-864, should the beneficiary receive public assistance and the government choose to try to recoup the money, the primary sponsor would be the first target. It is extremely uncommon for a co-sponsor to get into trouble here.
    I hope this helps. If anyone has anything to correct or add to this, please do. I think it would help to have a definitive explanation to offer potential co-sponsors at the I-134 stage, as what is clear to vj-ers after lots of research still needs to be translated to friends and family in a way that makes sense and clears up uncertainty.
    As for the I-864, there's no way to dance around a co-sponsor's liability. It's a binding contract in effect for a long time.

    To put it mildly, Mississippi Gov. Haley Barbour ®, a likely presidential candidate in 2012, has a difficult background on race relations. The far-right lobbyist-turned-governor has at times conveyed a demonstrably ridiculous version of history when it comes to civil rights in the South, and Barbour is known for keeping a Confederate flag signed by Jefferson Davis in his office. He's cited Jim Eastland as his political inspiration -- Eastland is best known as a champion on segregation -- and once told a campaign aide who'd made racist comments that "he would be reincarnated as a watermelon and placed at the mercy of blacks."
    But Barbour has opened a new chapter in this story with a lengthy interview with the Weekly Standard.


    In interviews Barbour doesn't have much to say about growing up in the midst of the civil rights revolution. "I just don't remember it as being that bad," he said. "I remember Martin Luther King came to town, in '62. He spoke out at the old fairground and it was full of people, black and white."
    Did you go? I asked.
    "Sure, I was there with some of my friends."
    I asked him why he went out.
    "We wanted to hear him speak."
    I asked what King had said that day.
    "I don't really remember. The truth is, we couldn't hear very well. We were sort of out there on the periphery. We just sat on our cars, watching the girls, talking, doing what boys do. We paid more attention to the girls than to King." It's hard to know where to start with such odious madness. As far as Barbour is concerned, Mississippi -- home to lynchings and other Jim Crow-era violence -- wasn't "that bad" in the 1950s and early 1960s? This coming from a man who "never thought twice" about integration, because he attended all-white, segregated schools.
    Wait, it gets worse.


    Both Mr. Mott and Mr. Kelly had told me that Yazoo City was perhaps the only municipality in Mississippi that managed to integrate the schools without violence. I asked Haley Barbour why he thought that was so.
    "Because the business community wouldn't stand for it," he said. "You heard of the Citizens Councils? Up north they think it was like the KKK. Where I come from it was an organization of town leaders. In Yazoo City they passed a resolution that said anybody who started a chapter of the Klan would get their #### run out of town. If you had a job, you'd lose it. If you had a store, they'd see nobody shopped there. We didn't have a problem with the Klan in Yazoo City." Those "up north" happen to be right, and Barbour happens to be dangerously ignorant. As Matt Yglesias noted, "The Citizens' Councils were, right in the state of Mississippi where Barbour is from, the respectable face of white supremacist political activism." Josh Marshall added that these Citizens' Councils were so transparently racist, the conservative mainstream "would have nothing to do with them."
    But from Barbour's twisted perspective, he's inclined to credit these white supremacists for keeping Mississippi calm during the civil rights era.
    I recognize, and have written about, political reporters' love for Barbour, in part because of his willingness to feed their egos and serve them alcohol.
    But as the 2012 race draws closer, I can only hope the political world recognizes Barbour for what, by all accounts, he appears to be: an old-school Southern racist.

    You just love a daily dose of nonsense don't you? The problem with policies like 'don't ask don't tell' is that they are discriminatory in application and that they lend themselves to an abusive subculture. Don't ask don't tell implies that there is something that could be told should it be found out, and only applies to same sex relationships, no one gets booted out the armed forces on the discovery that, shock horror, they have indulged in a heterosexual relationship! What a nonsense and the sooner it is removed the better.

    I just want to commend Saddened (the OP) for demonstrating such personal character here. All too often we hear about when the beneficiary is scamming for the greencard (unfortunately there have been too many of those threads in the PH forum lately) but seldom do we get to see this side of the situation.
    Having family already in the US Saddened could have "gone TNT" and tried to stay here working illegally but instead she has chosen to follow the rules.
    Even more to her credit, not once has she smeared the man who sponsored her entry on the K-1. In fact she seems to understand his reason and is doing her best to move on without feeling a need to leave scorched earth behind her.
    @Saddened, I wish you the best in all of your future endeavors. In due time everything that you need will find it's way to you.
