    First make an infopass and get a stamp in you passport that is the equivalent of the GC. Next send in the GC with an I90 to the listed address and include an explanation that the name on the card is an administrative mistake. Include copies of your original paperwork if you still have it and copies of your notices and EAD with the name correct. They won't charge you if it is an administrative mistake.
    I have had to do this as they spelled my surname wrong despite repeated calls and infopasses and service requests to correct it. Definitely get the stamp though as it's been 1 month and I still haven't received a new card.

    This appears to be a case to where the length of K1 process has benefited your relationship as apparently your true colors came shining through. As I see it, her father did what a father should have done. His daughter was about to embark on a journey on the other side of the world with what was thought to be with a man of courage, understanding and compassion for his daughter. What he found was a whining individual who thought it was more important he receive a valentines (???) than understand the heart felt, gut wrenching feelings, of parents and daughter who were about to be separated.
    Suspect this type of immature “me, me, me” behavior showed up elsewhere during the K1 wait, tearing at the threads of the relationship and the ultimate decision to leave family and country to immigrate.
    This thread will probably be shut down, as I would expect others have little tolerance in holding back on giving straightforward observations and advice. For those who have suggested you “ignore the members who tell you to man up” sorry to say, in my opinion, they are misleading you in an attempt to comfort you. I would respectfully suggest you let it go and move on and don’t attempt to make further contact with her or her family. It appears, you are clearly not the only one in this relationship that has been hurt by shattered dreams.

    From a non-pregnant person I have to agree with what is said here. It is very hard to leave what you know especially if you have pressure from family not to leave. It is even hard to leave when you have your family's support. It sounds as if you are both very close to your parents. Stand in her shoes and think about how you'd feel if you had to leave your family behind and not know when you'd next see them. Add that to your attitude about how love should be shown. To be honest, I really don't blame her for not wanting to come. However, she should have had the decency to respond to you and let you know why she had changed her mind.

    If you have the funds and available time then you should meet as many times as you can. Don't feel that just because other people can't you shouldn't. Not everyone has that luxury and you are very lucky :-)

    The US unfortunately does not recognise a de facto marriage (a relationship in the nature of a marriage lasting 2 years or more). Therefore they do not offer a visa for partnerships. This is a shame as marriage is not necessarily the route that everybody wants to take. Now that you are here on the K1, as others have said, you will have to marry within 90 days to fulfil the obligations of the visa. Does your home country not offer a visa for defacto partnerships? I know that mine does and I would expect that some others do too.
    YuAndDan, I find it offensive that you refer to a defacto marriage or civil partnership as a 'Shack Up' as this is the path that many people prefer to take; I would have preferred that path if the US hadn't insisted that to be with my loved one I must sign a legal piece of paper to prove that we had a relationship. You are entitled to your views but it is quite rude to belittle views of people who prefer a defacto marriage for whatever reason they choose that path by calling it a 'shack up'.

    Your post is absolutely absurd.
    USCIS has realized that they made an error and are doing everything in their power and pooling all of their available resources to approve the people who have been delayed.
    What you are basically suggesting is that some of the CSC to TSC transfer people should have to wait another 2-4 months(9-11 months total) so that the sept/oct/nov filers can get their applications approved in 4 months or less.
    I don't mind sept/oct/nov filers being happy they they got approved. That is great. But actually complaining that someone who has a priority date 3 months before yours getting processed first is simply rude.

    I have always wondered why on Earth you would subject someone you claim to love to come here unable to work for maybe 3 months or more and not have the means to support them at least during that period- or cover them with health insurance?
    I don't get the whole ' co-sponsor' thing either.....Honestly i would absolutly never co sponsor someone elses fiance(e), husband or whatever...Sorry, but if you don't make enough over the poverty line, you need a better job to help fund the responsibility you ( not me) are taking on.
    But that's just me...and don't bother critisizing my opinion...I said the same thing years ago and was attacked for it already for not being romantic.
    Thing is romance is great in the bedroom...but there's nothing romantic about a sick immigrant spouse who needs medical care that you cannot provide or no food in the cupboard.....

    Actually, the I-9 says they can accept the stamp, but only with an immigrant visa.
    @Alicey, your problem is that you've been talking to low level bureaucrats about a process few of them actually understand. This is comparable to calling a doctor's office and asking the administrative assistant how to perform open heart surgery. Even the people who actually deal with the various petitions and applications won't have much information about parts of the immigration process they don't deal with. For instance, you wouldn't call USCIS and speak to an immigration officer in order to get information for how to prepare for an interview at a US consulate.
    US Department of Homeland Security has a big fat manual full of policies and procedures for handling petitions and applications for USCIS. This is called the Adjudicators Field Manual. US Department of State has another big fat manual full of policies and procedures for handling petitions and applications for US consulates. This is called the Foreign Affairs Manual. On top of this mess, each USCIS service center and field office has it's own office wide policies established by the director of that office, and each US consulate has it's own policies established by the visa section chief and Consulate General.
    There are many thousands of attorneys in the United States who make a very good living helping their clients navigate the minefield that is US immigration law, and departmental policies and procedures. For those who don't feel like feeding the sharks, there are sites like VJ. The parts of each stage in the process which are common to everyone are outlined in the guides - link at the top of every page. The parts of each stage that are unique to a specific consulate or service center can be found by reading the appropriate sub-forums, as well as the embassy and service center reviews.
    This may sound incredibly trite, but the last people you should ask for help in dealing with the US government is the US government themselves.

    Personally I have no problem with prenups as they protect both parties to some extent. In the event of his death his children shouldn't be able to remove any property from you that you own under your own name but I would make sure that you both write a will naming each other as beneficiaries in the event of either of your deaths. I'm not sure that a prenup would have any effect on a will if the children contested it but you should be more protected under the law with a will than you would be without one.

Between now and the time that the State decides to get to it, my future wife can remain in the foreign land I found her in, we can stay separated, and the State simply does not care. Besides, says the State, I should be grateful that the State is spending 15 minutes of their valuable time on a puny being like me to save me from my own choice of lifetime mates, and I should consider myself lucky if they find those 15 minutes in 5 months and not many months later.
    So here I wait, with my life on hold and my future wife uncertain about where she will live and when she will get there. And I wait, and wait, and wait.

    We all know the correct answer. But how many people not married to or looking for a foreign bride could ever imagine something like this happening in the land of the free?
    Why does it take the USCIS five months to do fifteen minutes of work? What business that charges you $455.00 to perform fifteen minutes of work, makes you wait five months for that work to be done, and gives you zero feedback on how that work is progressing would stay in business? Why does a government that is supposed to be the best one in the world work this badly?
    And while we are at it, who the hell is the government to stand in judgment over my choice of wife anyway?

    I am sorry to say it but an attitude like this might really end up in an immigration dead end for you. You are in a disadvantage when it comes to options that are available for you, that's why it is so important that you know exactly, which options you have.
    When it comes to my own immigration process, I would never just trust a friend, no matter how long you have known him or what "pull" he might have.
    You made it sound like he either is a total expert in this field or doesn't need to care because of his "connections" and I have to say I don't believe it.
    Your "we will cross that bridge when we get there" is not going to work in my opinion. Well, it might if your friend indeed can do some magic but I highly doubt it.
    Yes, he might be able to get her a work visa, but will it be one that she can later adjust status from? This is something you need to know BEFORE you start the whole thing because once she is here and it is a dead end, it will be very difficult (not to mention it will take a lot of time and money) to fix mistakes.
    So, forget about your "I don't take no for an answer" and "it's gonna be my way or no way" attitude and start listening to the advice you have been given here.
    At least, please read all the guides and info about the different visas.
    Whether people here do or do not support same-sex relationships, this forum is about immigration and you will be given good advice for the immigration process.

    What the OP continues to fail to grasp is the unlikelihood of her "fiancé" being granted a work visa for something as uncertain and transparent as "wanting to be a stand-up comic." In its place, she seems to think desire, will and tenacity equate to the tangibility of actual professional credentials. No one is questioning the necessity to keep trying if you want to make it, but that is not grounds for bringing a foreign national into our borders only to potentially slough off the system.
    The U.S. is already full of starving and beleaguered native artists whom never make it into the business, funny or not. I do not believe the government finds it in its best interest to also begin importing them.
    When you apply for a work visa, you must declare an employer, i.e. steady source of work. Stand-up comics travel around their home-cities, home-states, and the country, living wherever they must, doing gigs, and hoping they break through. That's actually quite fine for USC's, but do you really think the USCIS or DoS would condone allowing a foreign national to come do so? I think not.
    That's the equivalent of saying someone "sings really good," and wants to come to the U.S. to give the business a "shot." But they've had no demonstrable success in their home country, and cannot provide any proof of excellence that would make it clear that their profession is already established and one could expect a reasonable continuation of it in the U.S.
    She isn't applying for American Idol! It's a visa to enter the U.S.! Stop berating posts for not supporting your "feelings" and what you think she is capable of. All that the system is interested in is what she has already done, and if that translates to actual work directly upon arrival in the U.S.
    Again, third-party love is not a variable in obtaining a work visa for someone that is being sponsored by someone else entirely. Wanting that individual in the U.S. is not a right that can be demanded. And suggesting that a foreign national is "really so funny that she makes my face hurt" as sufficient evidence substantiating a legal work permit is just plain absurd.
    When we speak of work visas we mean steady occupations one can rely upon. Nurse. Medical doctor. Attorney. Accountant. Engineer. Scientist. Something verifiable and substantial. They pre-arrange an employer, and then show up and start working. Not someone that "would make a really good accountant," and then shows up at a POE with a heart full of dreams.
    I saw an episode of some real-T.V. show about Homeland Security, and a young European girl showed up in JFK Intl. with no visa, no employer, no contacts, and a large bag of belly dancing clothes. It was clear to the authorities that her desire to belly dance was not sufficient grounds for entry. Even though she seemed very flexible, and was in fact talented. But that is how individuals end up falling under that radar, skirting the control of immigration, and becoming illegal aliens; or, worse yet, fall prey to people will ill-intent. So they turned her back around and shipped her home.
    Not that your friend would, but her situation is little more substantial than this young girl's. Sure, if your "connections" land her a stable job at a comedy house then you may be able to pass that off. But your portrayal makes it sound a bit more flimsy than that. And if it walks like a duck it usually is a duck. If that is not the case, then your attitude is her worst enemy and I'd leave the immigration process to others. For her sake, at least.
    I found this discussion interesting at first, and then comical, but now I'm just bored with you. You turned a serious question that folks would have been more than happy to assist you with into a farce.
    You'll need more than good luck with that now.

    There are some VJers who are very much concerned with the welfare of the American nation. That is commendable. However, there are also people (like me) who can't care much about the government, politics and its spokes.
    This may not be a very simple request or suggestion but maybe we can divide the OT into half the way there are areas for Regional Discussion. One part of the OT is for anything political such as undying issues about health care, the hot Pelosi, the controversial Senate, Beck's idiocy and more. On the other hand, fun stuff will consist the lighter separate portion of OT like various games, C4C, and most Spooky threads.
    Support from other members and the Ewok's implementation will be appreciated.

    I am going on the assumption that the overwhelming majority of people on this site have gone through a arduous and expensive legal process to obtain legitimate immigration status to the USA. I myself have spent between 3 and 4 thousand on the process.
    I just wanted to hear what thoughts or feelings are generally held by members of this site towards those who either snuck into the country completely or willfully over stayed their tourist visa in order to reap the financial and quality of life benefits offered by this country. this includes people that come for a holiday in a ruse designed to give birth to their child on us soil and insist on being allowed to stay because their child has birthright citizenship. ireland has revoked this right in 2002 and i believe that the us should do the same.
    my personal feeling towards them is that they are a burden to be expunged and/or imprisoned in most cases. I think their action stains the value of the process that we all went through and i personally have zero compassion for any one who is kick out on their #######.
    that being said, i have also heard of plenty of people that did go through the same process as me and my wife have that were denied because of a brain damaged processing agent at uscis. these people do everything above boards and bend over backwards to comply with the rediculous set of laws that are in place and yet are still punished with deportation due to a technicality. I fear, perhaps unjustifiably, that incompetancy at uscis could claim me as a victim and so i therefore have endless sympathy for anyone who has been kicked out after having done everything that was asked of them.
    I recall a case involving a croat woman that married a former us soldier after the bosnia conflict. when the call was sent out for volunteers to go to iraq, out of his inner sense of patriotism, the husband had an inner calling to re-enlist and serve his country in the war on terror. in 2002 they scheduled their interview which was supposed to take place in 2003(sorry I dont have the dates exact). The husband was killed in action defending this country before the scheduled date of the interview. Because they missed their interview uscis/ice initiated deportation precedings against a woman that had lived here for 10 years and had 2 children with her us citizen husband who died honorably in service to his country for a cause he believed in. The long drawn out battle eventually brought the woman to court with the parents of the fallen soldier in her corner fighting on her behalf. The court decided in her favor and allowed her to stay. In their infinite wisdom the USCIS appealed the court decision and resumed deportation preceedings. I do not have the ending of this story but in my story boook world this lady was rightfully granted residency and allowed to persue citizenship, however, as we all know story books dont often allign with real life. My heart goes out to people who are put in these situations.

    It won't. The unemployment rate isn't going to be this bad forever. And your short-sighted strategery will get you into hot water once decent employers become an alternative for the staff you are looking to slave around. They'll run and they won't come back. A reputation is a hard thing to build and an easy thing to lose. Ask the folks at Toyota.

    You will also have a hard time finding good employees. Offer no health insurance, and they will go work for your competitor. Those you get left with are probably not good enough to get hired by a competitor.
    You are basically destroying your human capital, to take more money home with you. In the long term a very poor decision. If all your employees are working in positions that can easily be automated, replace them with robots and you can get rid of most of your salary too.
