    No need to pay an attorney to tell you what you need to send in for your RFE. In my opinion, don't waste your money. That's what VISA JOURNEY is for ... help without an attorney (I also feel that they can slow your case down ... who is better at making sure everything is done quickly and in a timely matter than yourself?!) If what you have isn't enough, you might get called in for an interview. Send in every piece of info you have from the time you were married up until now, i.e. financial and that shows you have comingled your finances. Also, anything else you have that shows you have comingled your life. THAT is what they are looking for. Life insurance policies = good. Having both of your names on the deed is not a must, in my opinion. Sometimes, it just doesn't work out that way ... just like another poster said above ... wasn't logical for them to refinance at a higher rate just to add her spouse. There are definitely other proofs that you live together, and have a good faith marriage.

    It's ok Really! They just want more information, and once you send it, your approval will follow quickly At least you know now that are working on your application.
    I just wanted to say congrats to all those who have gotten approval since the last time I was here, and it is especially nice to see a few of my fellow RFE'ers get approvals too

    Did you send monthly bank statements from all the years of marriage?
    Without knowing what you sent, we can't say what is missing.
    If you put a list here I am sure that people would give suggestions on what else to send.
    I don't want to tell you how to feel, but personally I wouldn't let USCIS ruin my day. Plenty of people get RFEs and it's all okay. It's more worth a "bummer" and a shrug than outrage and devastation.

    No, see, that's why I think you are confused.
    For ROC you have to prove you have a bona fide marriage. There is not a single item that you MUST supply, rather it is the picture of all of the documents you send. Evidently what you send did not paint a clear enough picture, so they just send you a RFE for "more proof" of a general thing. The list they send is just boilerplate.
    For AOS and other things, yes, RFEs are sent for specific missing items, like a medical, or proof of citizenship. But for ROC, that isn't the case.
    Imagine if they sent you a RFE for a specific thing, like proof of life insurance over the years of your marriage. Not everyone has that, and it is not required that they do. Make sense?
    It's nothing to be outraged over. Lots of people get RFEs and send back some more stuff and it is approved. It's not a big deal.

    First time I hear W2s were required for ROC. I know they were required for the affidavit of support, but that was because they needed to check we were above the poverty line etc. What's the point now?
    I sent a tax transcript for 2011 but for 2012 we had just filed, so I just sent a copy of our complete tax return including all the schedules, but without a W2. I don't see why it's needed anyway. It's the IRS's job to verify our income, but USCIS is only responsible to verify validity of marriage, so how much income one made is none of their business.
    Anyway, now that our 2012 tax return has been processed, I will go ahead and order a 2012 tax transcript and keep it just in case we get an RFE.
    In my humble opinion, if they really want something and it's important that they have it, it should be clearly stipulated in the instructions. If it isn't clearly stated in the instructions, then people are going to send what is their interpretation of what they're asking for, which is what so many of us did.
    Anyway, everyone - let's not freak out about it. Worst case scenario, all of us who didn't send in a W2 get an RFE and we send in tax transcripts and/or a copy of the W2 if it's that essential to them and we then get approved

    We got an RFE during AOS. The things they asked for were things that were not only included, but BRIGHTLY labeled, clipped together, and had a detailed table of contents for. This really makes me think that it is random, and that sometimes they just like to issue RFE's. When the file they are giving an RFE to has everything needed, they just request the same ####### anyway. It's extremely frustrating though. I was madder than a wet hen when my husband called and told me we had gotten an RFE!
    We've gotten 3 emails from USCIS today all saying the same thing-- card production ordered. I never get tired of reading it, though. <3

    John and I went to Detroit yesterday for his AOS interview, and aside from him not remembering MY BIRTHDAY when the adjudicator asked him .... , everything went very smoothly and he was approved. Before we even got home, we got a text that there had been an update to his case. Checked when we got home and card production has been ordered! That was fast.
    The only thing that surprised me about the whole thing (well, aside from my husband not remembering MY BIRTHDAY!!!) was the fact that John's AP is now no good because the AOS has been approved. If he needs to leave the country (has an ill mother), we would have to make an InfoPass appointment and they would put some sort of stamp in his passport so that he could travel. We were so close to Canada being in Detroit and all, it was sure tempting to just cross the border because we could ... should have done it BEFORE the interview
