    You failed to read the second paragraph of my response to the OP. I said a lot of people sent in un-notorized and got approved. That will fit your case exactly. I also mentioned that it is because most of those people sent in overwhelming evidence that made those un-notorized affidavits "moot".
    That being said, I'm sure if USCIS decides to make a decison soley on affidavits, one not being notorized will not make the cut. If it's not notorized, then it's just a letter which may or may not have even been written by your friend. I'm pretty sure uscis is smarter than that. Maybe we should all take time to look up the WORD "SWORN" affidavit.
    Having it notorized, makes it a SWORN DOCUMENT.

    She can stay as long as needed in the Philippines for her studies. U S citizens don't have to worry about being out of the country for too long.

    There's no yes or no answer to this question. Many people sent it notorized and many sent it without it being notorized and no one had an RFE yet or been denied because of that.

    I'm not quite getting this story. You and your husband applied for a green card. Immigration has the right to investigate the legitimacy of EVERY MARRIAGE based application. That include unannounced visits to your marital home. When he called to ask you guys to come over, that was a chance for you to prove you have nothing to hide like you keep saying. Was it an inconvenience for you to leave a party? YES. But your application for a green card must trump any food and drinks that day. Also you mentioned you husband didn't want to leave his daughter's birthday party. If the daughter was 2 years old, that would have been a good excuse. But the daughter is 25 years old. Come on. You don't think a 25 year old woman will understand her father has to make a quick trip home to attend to an important thing and come back to the party if necessary? Your refusal to co-operate with USCIS can back fire or slow down your process. I'm sorry but a request to prove your truthfulness to the Govt. for a benefit (green card) should be very important to the applicant. Let's not forget. Green card is not a right. It's a privilege. The U.S government is not required to grant anybody a card. Unless you are a born citizen, you don't have much expectation from the govt to do things you want or apply for. I hope you guys get approved but I won't advise anybody to blow off USCIS because you think you have human rights especially if your rights are not being violated. Yes we all have human rights.     When you sent in your application, you didn't know you'd owe any money and IRS hadn't sent you a bill so YOU DID NOT LIE on the N-400. Besides that question of owing taxes does not include this tax season since you had till April 15th to file anyway. Don't lose sleep over this. You'll be fine.

    WOW. The responses to this question have gotten technical by the minute. Here's a simple answer. If the OP did not put her name and signature on an application for food stamps, then there is no story. Her eating some of the food is none of the government's business since the husband (usc) got the food stamps on his own and can share with who ever he pleases. No need for the OP to lose sleep over this.

    I think things are looking up and up for you. Considering a year ago you were half way back to your home country. The immigration judge has thrown you a huge bone and USCIS is just trying to nitpick here. All you can do at this point is wait. You can renew your EAd as many times as needed until a final decision is made. I went through 2 EAds and my application was a simple one so hang in there. You've been through the toughest part already and survived. I'm assuming you must have a child by now since your fiance was pregnat last year. Congrats if you have a baby. You will be getting some good news soon. Good luck and keep us posted.

    I will like to thank you all for coming along on this journey with me. My oath was at 12:00pm today in Milwaukee. Got into the buildiing around 11:35 with my family and cleared security. We were told to go to the 3rd floor. Huge beautiful building by the way. The line had began to form so I promptly joined. At 12:00 they anounced for us to make sure the back of the notice with the YES NO questions have been answered. I checked in and surrendered my Green Card and took a seat. The room filled out prety quickly. There were 74 people from 21 different countries. The judge gave a little background on immigration and had us take the oath of allegiance around 1:20pm and said congratulations and welcome to your new country. Then a lady spoke about voting and the need to get an ID for major elections starting January next year. We were asked to "approach the bench" and receive our certificates on the way out. Families and friends were allowed to take pictures and video the whole time. Mexico was the country with the most applicants with 17. My 3 year old kept shouting go daddy go the whole time . We were out of there by 2pm and went straight to the post office and applied for a passport.

    It seems your fiance is still holding some cards to his chest. The United States has no right to confiscate a legitimate international passport from the rightful owner. They can only sieze a U.S passport being used fraudulently or if the passport your fiance tried using belonged to a citizen from a different country than him. If it was a case of just expired visa, the airline wouldn't have let him board in the first place. It could also be that CBP officers saw him as trying to enter with fraudulent documents which would have made his entry illegal. They have the right to take away that document since technically, it wasn't produced by any Government and not a genuine property of any country.

    Why would a marriage certificate ever come into play while travelling with a greencard? Greencard trumps a marriage certificate anyday at the borders. If you have a valid greencard but a CBP officer is giving you a hard time entering the U.S, I doubt pulling a marriage certificate will shake that officer. A passport and greencard is all the OP needs to travel outside the u.s. The only other paperwork the OP will need will be a re-entry permit if the Op plans on staying for more than 6 month to a year.

    You mentioned she left you numerous times and she just left again. Probably for good this time. How many times does she need to leave before you realize you're not in her plans? You think she used you to get here. Now it's up to you to decide if you want her to USE YOU (again) to stay here aswell. As for having the aos denied, you can either go to the interview and tell the IO you want it withdrawn for the reason you've given. You will be given a statement to sign that offically pulls the plug. Or of you don't want to waste gas by going to the interview just stay home. Without your signature on all the forms, the application will be denied.

    You may want to send your lease or mortgage. You sent partial 2008 tax? 2007/8/9 tax transcripts will do a lot of good. They already have pictures of you as a married couple. If you decide to send pictures, they want to see you guys stayed married and have proof besides the one you sent during I-485. If you have drivers licenses showing that you live together, you should have sent that with I-751 but go ahead and send it again. Any children together? Do you have bills dating back to when you first got married?

    It's not a required document to have unless you have plans of travelling while your application is pending. Do not even bother applying for it if you are an overstay for more than 180days. They won't let you back in.
