    Hi all,
    It feels like it was yesterday when I was here asking questions regarding the AOS application. Then, I never imagined that I would be where I am today and asking questions that I am asking right now. Now that a divorce is really happening in a matter of months, I have to get ready to apply for a waiver of the requirement to file the joint petition. Because of the state law here, we can't file for a divorce till the month of October (six months of separation), but I am getting very anxious about the whole application process. My 90-day window opens up in late January next year, and still till late April I think I have time to put everything all together, but I am very stressed out under the circumstances. I've read up all the FAQs, pinned topics, tips, and also those topics written by others and replies to those questions... And I am still worried, and I don't know if I am headed in the right direction.
    My USC wife bought a house a month before we got married. In spite of the fact that we were on the house hunting together, when she bought it, she never put my name on the deed. Simply because she didn't want me to be responsible with mortgages if something happens to her since she was a sole income earner then. And even after I got a (not so glamours) job, it never occurred to us to change it. I was making even less than a half of what she was making then. And we don't have kids. So, I am lacking those pieces of evidence that I think would show that we lived together at the house that she purchased, but no deeds or no child birth certificates.
    Although I understand that they may not be all but significant, I am thinking of explaining about it in a separate letter, along with how our marriage progressed and ended. For now, the following documents are what I am gathering to submit without the aforementioned. Please, let me know if I need anything else.


    • Copies of my passport and green card (front and back).
    • Copies of our drivers licenses (or just mine?)
    • Copy of our divorce decree (when it's available)
    • Copies of the tax statement for 2009 and 2010
    • Copies of our Wells Fargo joint checking account monthly statements
    • Copies of our Wells Fargo joint checking account debit cards
    • Copies of our AT&T Family Talk plan billing statements showing both names.
    • Copies of our ADT billing statements showing my name at the same address.
    • Copy of car insurance policy showing both names.
    • Copy of AKC certificate for a Poodle pure bred we adopted, showing our both names.
    • Copies of our two credit cards and billing statements showing a joint account.
    • Copy of our BCBS health insurance cards showing a joint policy (technically I was under her).
    • Copies of flight boarding tickets (not many).
    • Copies of itineraries of flights on vacation trips we made together.
    • Copy of our Costco membership cards on a joint account.
    • Two sworn affidavits by U.S. citizen friends, attesting to our relationship and marriage.
    • Copies of Comcast Internet service bills showing both names.
    • Copies of Dish Satellite bills showing both names.
    • Copies of gas bills showing both names.
    • Copies of water bills showing both names.
    • A stack of pictures of our relationship before and during marriage since it ended in divorce (hundreds of pictures).
    When my USC wife and I talked about those affidavits that I was thinking about obtaining from our friends, she told me that she would write an affidavit for me as well. Basically, something to that effect of our marriage was terminated in divorce but my ex-husband deserves to be here. So, I've looked everywhere but not found any templates for a UCS spouse to use. Does anyone know where I can find a template I can use? Or can it be a just simple letter? Has it to be notarized as well?
    Please, apologize in advance if I am asking the same question that someone already did. But somehow I couldn't find the template. Thanks.

    I think so, Anh map. My cover letter begins (as one of the templates I found here on VJ but I modified a it) like below.


    RE: I-751 PETITION TO REMOVE CONDITIONS BY WAY OF A WAIVER OF THE JOINT FILING REQUIREMENT WITH THE US CITIZEN SPOUSE OF STATUS ON:
    Name, A#
    Dear USCIS examiner:
    Enclosed please find a WAIVER OF THE JOINT I-751 petition for removal of conditions of permanent resident status regarding myself so and so. Please also find a check for $590, the fee for this form. My US citizen spouse so and so and I entered the marriage in good faith, but we discovered many differences in personalities during our marriage as much as we fell in love very deeply. We tried to work it out but, to our disappointment, in the end our marriage was terminated in divorce. I am requesting that this petition be accepted for removal of conditions by way of a waiver of the joint filing requirement with so and so on the residence of myself so and so.
    Enclosed also please find the following documents to verify that our marital relationship was bona fide:

    You can find very similar lists of evidence that others submitted in the pinned topics as well. They are tremendously helpful. Below is what I submitted with the application.


    • Copy of the Green Card (front and back)
    • Copies of our joint Income Tax Return for 2009 and 2010
    • Copies of our joint checking account monthly statements
    • Copy of my debit card of our joint checking account
    • Copies of our two (2) credit cards and bills sharing the same credit card account numbers and showing our names
    • Copies of our health insurance cards and medical, dental and vision bills showing the joint policy
    • Copies of auto insurance policy and cards showing both names
    • Copies of my card and a billing statement of our Costco membership, showing the joint account
    • Copies of AKC Certificate and Certified Pedigree of our dog, purebred Poodle we adopted, showing our names
    • Sworn affidavit by ex
    • Four (4) sworn affidavits by U.S. citizen friends and family, attesting to our relationship and marriage
    • Two (2) sworn affidavits prepared by ex's college friend and ex's mother before ex and I decided to separate, followed by divorce
    • Copies of our AT&T Family Talk plan billing statements showing both names
    • Copies of our ADT bills, showing my name in account name, and ex's name in the billing statements
    • Copies of Comcast high-speed Internet services bills
    • Copy of Dish Satellite Agreement that I initialled and signed
    • Copies of gas bills showing both names
    • Copies of electric bills showing both names
    • Copies of water utility bills showing both names
    • Copies of summer vacation flight itinerary, boarding tickets, car rental records, airport parking receipts
    • Copy of flight itinerary for Christmas holidays
    • Copies of many wedding cards and holiday cards sent from friends, family and ex's co-workers
    • Tons of pictures of our relationship, including our marriage.
    Some said that affidavits don't count much. Some advised that they do. And some mentioned that an affidavit written by the ex would help too. And since I didn't have my name on the deed of the house or own the car that my ex and I used, so I thought that I should include as many affidavits as possible, obtained from those who knew that our marriage was bona fide.
    And with these, I also included a 5-page letter (more like an essay) addressed to whoever would go over my petition, explaining our relationship, marriage and divorce. I figured that since the IO wouldn't be able to know who I was, without seeing me in person, let alone what kind of relationship and marriage my ex and I had had, so I decided to write about it. I believe that this tip was also found somewhere in one of the pinned topics. Anyway, I really felt that the letter would help the IO understand me better. Of course, I was ready for an interview at any time anyway, but I believed that it wouldn't hurt either if I told him/her about it as much as I could while the IO is actually reviewing my petition.

    It was rejected because you paid extra $340 for I-765. When you filed I-485, if you read the instructions thoroughly, the amount of $1,010 basically covers EAD and AP, if you wish to work and/or to leave the country for special purposes while you're not approved yet. That's why the check was returned to you.
    Since you received all NOAs, you shouldn't worry about it. No action required, like the notice says.
