  1. My case was 12/23. I am worried as I received no RFE, no interview date...I hope they did not lose the case.

    You might want to do what I did and call them. I don't put a lot of stock into the case query, but at least it's something. And you can take solace that you're not alone -- given my case status, as well as some others on the list in this thread that seem to be unresolved, it's likely that some files either get extra attention, or perhaps are allocated to different agents who aren't as efficient or something. It's hard to say exactly how these things are determined.

  2. I looked at your timeline, and I've seen that you applied around december the last year. If I were you I would go ahead and talk to the congressman, and try to get him envolved. I mean I think that your application is sitting somewhere, since february is almost done. I think they will start in march now, I'm talking about vermont. Look in the processing dates it will say that it is working on january 16, but that's not true they are way ahead of that. Good luck.

    Yeah, I'll give it a little more time. I put in the query, which was responded to by USCIS on Wednesday. They indicated that I will receive a decision or other notice of action within 60 days. If I don't have anything by mid-December, I'll see about getting a congressman involved.

    on USCIS website they are showing that now they are working on January cases, I haven't heard anything yet sent an e-request and called 'em multiple times still no luck :(

    I feel for you. I'm in the same boat. It's been well over ten months now, and I have yet to call. I keep thinking I should call, but part of me knows that they won't have any answers. I'm starting to get a bit concerned though, I can't deny.

  4. It is the same with mine. I believe many people are in the same boat. The best indication for any approvals or any movement in both service centers is following up on this forum. If someone is approved for a particular date/month we can easily assume that they are working on applications for this month. Do not follow the USCIS website, follow the activity on this website for each particular month.

    Even that isn't very precise, unfortunately. I filed in December, the website still says "initial review," and I'm waiting...while people in January and even February are getting approved. I'm truly happy for them, of course, but I'm starting to get concerned about my status. I just know from experience that calling the USCIS number doesn't get you very far. I'll give it until the month changes over, then will start looking into it seriously.

  5. We visited this site and were alarmed that applications going to Vermont that were submitted after us were already over and done with, with positive results. Our case is not hard, we had all the documents that was requested, yet we haven't been called for interviews yet, and our letters of reference haven't been contacted either.

    Should my wife be worried about this?

    Nope...you've probably got a couple more months to wait. I've been waiting since December.

    I truly have no idea how they sort through their files -- some folks get through the process quickly for no apparent reason, while most have to wait nine or ten months, and some upward of a year.

  6. hello im in a similar situation i have a question regarding this, when i first submit for adjustment of status i was at my old address, then after the whole process was over and got her conditional green card we moved to our new address. ok so here is my question im about to submit the removal of conditions i have not yet, do i need to submit the change of address before i submit the removal packet. i was under the impression that once i submit my removal form they would just use that address on that form. i thought the change the of address form was only if you moved during the "NOA".

    Can i just submit my removal of conditional status with the new address on the form or do i need to submit a change of address form at the same time as the condition removal?

    According to the instructions on the USCIS website, you're supposed to file the AR-11 (change of address) and I-865 (sponsor change of address) as soon as you move. They're separate from the I-751 process, so you should do them as soon as possible...preferably before you send in your I-751.

    I ran into this post. My husband and I moved in to a different city couple months ago. so it has been 5 months now since my biometrics. I submitted AR-11 a month ago, and didnt include I-865 since i didnt know about it. Should I get worried now? or should I mail I-865 asap?

    Yes, I would send the I-865 a.s.a.p.

    Like I mentioned above, it's often forgotten about, but the reality is that USCIS is just as concerned about where the "sponsor" is living as where the immigrant is living. In spousal visa situations, it's even more important, as if the sponsor (U.S. citizen spouse) is listed as having a different address than the immigrant, it can look like a green card marriage.

    I had forgotten about the need to file the I-865 until a couple of months after I filed the AR-11. I've been waiting 9.5 months for my permanent green card, but it remains to be seen if I'll get an RFE...

  8. Good Afternoon my wife did ther I-751 (Removal of Condtion application) and she did her Biometrics process. Now that we are moving to another state what are the procedures that my wife needs to in changing her address? Please reply anyone and thanks

    Fortunately, it's pretty simple. You'll BOTH need to fill out change of address forms. Your wife will need to fill out the AR-11 form, and YOU (assuming you are her U.S. sponsor) will need to fill out the I-865 form. A lot of people forget about the latter, and it seems to result in RFEs quite regularly.

    Just file those two forms, and be sure to set up mail forwarding with USPS. Sometimes it takes awhile for USCIS to fully process the two above-mentioned forms, so there are instances of them sending mail to old addresses.

    Still several of us in the same boat, sadly.

    Don't worry too much -- so long as you're with your spouse, all is well. I'll start getting concerned if I don't hear anything by December, as that will have been a year. As it stands now, I'm just waiting patiently. Getting a tiny bit more anxious lately, I'll admit, but not by much.

    That's great advice. Yeah, it's a HUGE pain in the butt -- I cannot wait to get all this done and naturalize and not have to worry about all this flurry of gather documents and such ever again. Seriously -- this is getting old...

    I would venture to guess that most folks forget. They fill out the AR-11 for themselves, but when there's no indication that the sponsor (spouse!) has moved as well, it probably raises a red flag on USCIS' end.

    It's been over nine months since I initially sent my package in (I had a minor RFE at the very outset). The waiting sucks, but being with my wife and able to live a functional life in the U.S. is what matters the most.

    We bought a house and thus, have moved and I changed my address with USCIS and of course they RFE'd us w hich makes sense. So, I'm just wondering... what from our mortgage package should I send? I have the HUD docs that show the transfer of the new house and such and I have the tax assessment bill and as well, a copy of the bill we're sent from our mortgage company to pay our mortgage... Do you all think that this is the right documentation? it's hard to figure out which document they want, I figure as long as it shows a loan, a purchase agreement and the address, we'll be fine?

    If any knows anything else or can add, that would be lovely. I don't want to send them the whole entire mortgage package as that seems stupid to me.

    BLAH! I don't have any particular advice, but I'm sorry to hear you got RFE'd! It's kind of incredible, since you're one of the most organized people I have ever come across on VJ. It must be a completely random "check" by USCIS. I suspect that a copy of your mortgage and tax assessment bill should be fine, as well as a copy of your most recent tax return (since you likely didn't include the 2011 return in your initial package). Changed addresses on bills etc. is always good too.

    Hope it's a quick turnaround for your RFE!

  12. I sent my ROC package today and it will be delivered tomorrow. When should I expect to have my biometrics appointment scheduled? I will have to travel overseas for work, and I want to make sure that I won't be gone when I would have to go in for my fingerprints. I am pretty free in scheduling my travel, so I was thinking November 1st onwards would be a safe bet.

    Hard to say. Mine was scheduled for two months after my package was sent in. Bear in mind that some folks have been successful in rescheduling their appointments, though that's always a little bit of a gamble.

    My packet is almost ready to send! Just two quick questions I was hoping someone could help me out with:

    1) Did you black out anything on your bank statements? I was thinking of blacking out my account numbers. It just seems odd to send all of my financial information to a complete stranger....

    2) What format did you submit your evidence? Right now I have it in a binder organized by tabs with a table of contents. Is this ok?

    1. I wouldn't black anything out. While I can understand your reluctance, bear in mind that the USCIS already has everything they need to utterly screw you over if they wanted to -- SSN, fingerprints, medical history, credit history etc. So worrying about them knowing bank account numbers is probably akin to worrying about catching malaria while standing in quicksand.

    2. A binder organized by tabs and a TOC sounds above and beyond what is necessary. I had a letter detailing all of the contents, then made sure that all the contents were in order, and either stapled or clipped multiple pages together. I don't think I had tabs on the top (I did for my original USCIS interview in Montreal), but it can't hurt. In other words, you sound well-prepared. :thumbs:

  15. Why on earth would you put your lives on hold? That makes no sense to me whatsoever. And politics has nothing to do with it -- immigration was a pain in the rear four years ago too, with USCIS offices backed up and clogged. You can check the VJ archives if you don't believe me.

    My wife and I have changed cities, I've worked two different jobs, then committed to going back to college full-time...all in the 2.5 years I've lived here. I'm not expecting the ROC process to end in deportation, because it's extremely improbable that that will be the case. So buy a house, settle down, go through the immigration motions like everyone else, and move on!

  16. We filed the I-751 last spring before the birth of our son on May 15. We received an extension of the green card for one year while they process our application. Should we send in my son's birth certificate even though our application is currently under review or should we just sit tight and wait to hear from them?

    Just wait and hear from them. If you get an RFE, then you can send a copy of your son's BC as part of the package.

  17. There is no reason to expect a problem travelling with her unexpired green card. If you are worried, she could take a photocopy of part of your I-751 package. Or, if she will have internet access you could scan and email the NOA1 to her once it arrives.

    Actually, there was a person on here a few months ago who tried traveling with a photocopy of the NOA1 and was detained in Argentina until her spouse could courier the original to her. So traveling with a copy is not a valid option.

    The only infallible scenario is to NOT travel out of country during the process. If it was me, I would either postpone my trip until after the biometrics was complete, or schedule the trip for earlier so that it doesn't interfere with the start of the ROC process. Personally, I would file for ROC on the earliest possible date, then go to the biometrics appointment when it is scheduled, and then schedule the trip out of country. Traveling with the expired green card and extension letter seems to be the most trouble-free method.
