    I got three RFEs..
    1. My husband's Argentine certified copy of his BC was NOT accepted. Even though it is recognized as a valid/legal document in Argentina, outside it expires every 6 months. Had to get a new copy. It was also laminated, which according to the officials issuing the new BC, once laminated it is no longer considered to be legal. Again, this only applies when the BC is being used OUTSIDE of Argentina.
    2. I, the petitioning sponsor, got an RFE for Form I-864, Part 6, Q#25. I did NOT file taxes because I did not make enough money. I didn't check either of the boxes for that question and I left the lines blank when it asks for reported income for the last 3 tax years. I wrote "see attachment" as I had attached a written letter explaining why I didn't file. I got the RFE for not writing zero. !
    3. My co-sponsor got an RFE for not including his 1040 and "all of his schedules", which he did. We talked to operator and they said to just send them again. ?

    You might want to contact the local office as your spouse will not count for the household size but any income he has will count towards the households income. Not sure how to fill the forms as I don't have them.

    Sorry capri but I'm with the others. The immigrant counts for income, but not for household count.

    The immigrants income counts. If it didn't, the immigrant could work and the USC could quit working and get food stamps? I don't think so. That'd be a pretty big loophole.

    I have seen people post(that have experience applying for food stamps) time and time again that the income IS counted in the household total, even if they are ineligible to actually receive any food stamp assistance, as the poster above stated. Why would you be so certain this is not the case? What you assume to be the way it is, may not be how it actually is. You should refrain from posting guesstimates/misinformation which can only confuse the situation more.
    To the OP> I would go with what belinda63 said. Check with your local office and let them know your situation. They will inform you of the correct way it needs to be done for your case, where you are eligible but your husband is not. You want to make sure they mark him as ineligible.

    I WAS NOT ANSWERING TO ANYONE ELSE BESIDES EMMAMAMA IF I WANT MY ANSWER TO BE FOR EVERYBODY I POST IT IN ENGLISH.. IN THIS CASE I ANSWERED IN SPANISH BECAUSE IT WAS FOR HER..

    There were a total of 4 issues in my 2 RFE's. From what I gather now with the help of other VJer's, it looks like 2 of them are valid mistakes (something overlooked), while the other 2, I have no clue why they were red flagged. Just make sure you go over everything 100 times to make sure it's done correctly because RFE's are a pain and the NVC seems to be really ####### about stuff!
